HomeMy WebLinkAboutRDA DEMANDS 07-20-92AGENDAJ-Ab-,I,,� _.l_�— RATIFICATION OF DEMANDS TUSTIN COMMUNITY REDEVELOPMENT AGENCY RECOMMENDATION: RDA DEMANDS 7-20-92 That the following demands listing be -confirmed and approved as submitted in accordance with Government Code Section 37208 as recommended by the Finance Department: Type of Listing Date Amount WARRANTS 7/02/92 $ 185,344.94 The Director of Finance has certified that the above listing is in accordance with the approved budget with the following exceptions: Exceptions: NONE BACKGROUND: In September of 1972, the City Council approved the use of Government Code Section 37208 which expedites payment of City payroll and accounts payable obligations which are in accordance with an approved budget. Under this procedure,.each purchase is not only reviewed at the time the purchase order is issued, but is reviewed by the Finance Department prior to payment of the invoice from the vendor to insure that it conforms to the approved budget. The City Council is then provided a listing at each Council meeting of the payroll and general warrants issued since the last report so that it can inspect and.confirm these warrants. HUSTON, EXECUTIVE DIRECTOR FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: DESIGN REVIEW 92-036 (BURNETT-EHLINE) RECOMMENDATION It is recommended that the Redevelopment Agency approve Design Review 92-036 by adopting Resolution No. RDA 92-11, as submitted or revised. BACKGROUNDIDISCUSSION The applicant requests authorization to construct a 680 -square foot addition to an existing commercial building located at 13041 Newport Avenue. The addition is being proposed to accommodate a new restaurant tenant and will increase the f loor.area available for seating, to provide additional storage and chige the main entrance to the restaurant to front onto Newport ."Aver u&: Based upon previous approvals for this property and. existing parking conditions, the subject restaurant space would be permitted a maximum of 89 seats. The actual floor plan for tenant improvements will be reviewed by staff at building plan check to verify the seating count. The tenant space is part of the LaFayette Plaza shopping center located at the northwest corner of the intersection of Newport Avenue and Irvine Boulevard. The site is bounded by commercial development to the north, south, east and west. The subject tenant space is immediately adjacent to "Nieuport 17" restaurant. The center is located within the Town Center Redevelopment Project Area requiring final design review approval of the proposed site improvements by the Redevelopment Agency. The subject site is located within the C-2 - Central Commercial District zoning designation. The project has been designed in accordance with the listed development standards for the district. In addition, City Code Section 9271(u) requires a building line setback of 65 feet, measured from the centerline of Newport Avenue, which has been satisfied. Redevelopment Agency Report Design Review 92-036 July 20, 1992 Page 2 The submitted elevations indicate that the addition will be a f lat- roof projection from the main building. The window types, door type, architectural elements and finish materials are proposed to be consistent with and will complement the existing architectural character of the center. CONCLUSION Based upon the above analysis and the submitted plans, it is recommended that the Redevelopment Agency adopt Resolution No. RDA 92-11 approving Design Review 92-036, subject to the conditions contained in Exhibit A attached thereto. RDA 92-11 2 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESIGN REVIEW 3 92-036 AUTHORIZING THE CONSTRUCTION OF A 680-SQUARE FOOT ADDITION TO AN EXISTING COMMERCIAL BUILDING ON 4 THE PROPERTY LOCATED AT 13041 NEWPORT AVENUE 5 The Redevelopment Agency of the City of Tustin does hereby resolve as follows: 6 I,. The Redevelopment Agency finds and determines as follows: 7 A. Pursuant to the adopted Town Center Redevelopment 8 Plan, the Redevelopment Agency shall approve all site plans and architectural designs of any project 9 proposed within the project area. 10 B. That a proper application, Design Review 92-036, has been filed on behalf of Burnett-Ehline 11 requesting authorization to construct a 680-square foot addition to an existing commercial building on 12 the property located at 13041 Newport Avenue. 13 C. Pursuant to Section 9272 of the Tustin Municipal Code, the Redevelopment Agency finds that the 14 location size architectural features and general appearance of the proposed development will not 15 impair the orderly and harmonious development of the area, the present or future development 16 therein, or the occupancy as a whole. In making such findings, the Redevelopment Agency has 17 considered at least the following items: 18 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 19 3. Exterior materials and colors. 4. Type and pitch of roofs. 20 5. Towers, roof structures, doors and windows. 6. Landscaping, parking area design and traffic 21 circulation. 7. Location, height and standards of exterior 22 illumination. 8. Relationship of proposed structures to 23 existing adjacent uses. 9. Appearance and design relationship of proposed 24 structures to existing structures and possible future structures in the neighborhood. 25 10. Development guidelines and criteria as adopted 26 by the City Council. D. Wynn, City Clerk EXHIBIT A CONDITIONS OF APPROVAL RESOLUTION NO. RDA 92-11 JULY 201 1992 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped July 20, 1992, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the condition& contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project subject to review and approval by the Community Development Department. (1) 1.3 Design Review approval shall become null and void unless building permits are issued within eighteen (18) months of the date of this Exhibit. (1) 1.4 Any public improvements damaged by the applicant adjacent to this property shall be repaired and/or replaced as determined by the Engineering Division and shall include, but not be limited to, curb and gutter, street paving and drive apron. (1) 1.5 All construction shall be in accordance with the UBC and applicable City Codes. (1) 1.6 Approval of Design Review 92-036 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form, as established by the Director of Community Development. PLAN SUBMITTAL (1) 2.1 At plan check, submit three (3) sets of construction (3) plans and two (2) sets of calculations. Requirements of the Uniform Building Code shall be complied with as approved by the Building Official. No field changes shall be made without corrections submitted to and approved by the Community Development Department. This design review approval shall not authorize any additional seats to the center -wide total and shall conform to the requirements as approved for Variance 88-05. A seating plan shall be submitted at building plan check for review and approval by the Community Development Department. FEES (1) 4.1 Prior to the issuance of any permits, the payment of the following fees are required: a. Building plan check and permit fees shall be paid to the Community Development Department. b. School impact fees shall be paid to the Tustin Unified School District. C. New Development Tax shall be paid to the Community Development Department.
