TENTATIVE TRACT MAP' 14800 (THE IRVINE COMPANY) The applicant, Hunsaker & Associates, on behalf of The Irvine Company, is requesting authorization to subdivide a 30.9 acre parcel to create four (4) lots for commercial and hotel purposes. Recommendation by the Community Development Department: ae Approve the Environmental Determination for the project by adopting the following Resolution No. 93-131: RESOLUTION NO. 93-131 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR TENTATIVE TRACT MAP NO. 14800 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT b. Approve Tentative Tract Map 14800 by adopting the following Resolution No. 93-132, as submitted or revised: RESOLUTION NO. 93-132- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING TENTATIVE TRACT MAP 14800 Council Agenda 1 December 6, 1993 . U.S. DEPARTME, ~: OF HOUSING AND 'URBA,. DEVELOPMENT (HUD): COMPREHENSIVE HOUSING AFFORDABILITY STRATEGY (CHAS) The Comprehensive Housing Affordability Strategy (CHAS) lays out the City's goals to address the issue of affordable housing, specifically where Federal dollars are involved. The CHAS is a Federal requirement of entitlement to describe the use of all resources, Federal, local and private, that are targeted for use in providing affordable housing. Recommendation: Approve the City's Comprehensive Housing Affordability Strategy (CHAS) by minute action authorizing its submittal to the U.S. Department of Housing and Urban Development (HUD) for review and approval as recommended by the CommOnity Development Department. 3. RED HILL AVENUE UNDERGROUND UTILITY DISTRICT NO. 14 . Public hearing to consider the designation and adoption of an underground utility district requiring the removal of poles, overhead wires and associated structures withir~-the area of the City located on Red Hill Avenue between Copperfield Drive and Nisson Road. Recommendation: Conduct the Public Hearing. If the City Council ascertains that the public necessity, health, safety or welfare, require the removal of poles, overhead wires and associated overhead structures and the establishment of the Red Hill Avenue Underground Utility District No. 14, the Introduction of Ordinance No. 1119 will be required as recommended by the Public Works Department/Engineering Division. APPEAL OF DESIGN REVIEW 93-023 AND CONDITIONAL USE PERMIT 93-030 (CITY OF TUSTIN -TUSTIN SPORTS PARK) On October 4, 1993, the City Council appealed the Planning Commission's action in order to consider expanding the scope of the project to include additional sport field lighting for the two soccer fields and two basketball courts. RESOLUTION NO. 93-134 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE EXECUTION AND DELIVERY OF THE TRI-PARTY AGREEMENT, THE GUARANTEE AGREEMENT, THE FOURTH SUPPLEMENTAL INDENTURE OF TRUST AND THE AMENDMENT T.O THE REMARKETING AGREEMENT RELATING TO ASSESSMENT DISTRICT NO. 85-1 AND AUTHORIZING CERTAIN RELATED MATTERS Recommendation: Adopt Resolution No. 93-134 and related matters contained in Exhibits A through D as recommended by the Finance Department and Assessment District Bond Counsel. m RESOLUTION NO. 93-130 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE EXECUTION AND DELIVERY OF THE GUARANTEE AGREEMENT RELATING TO ASSESSMENT DISTRICT NO. 86-2 AND AUTHORIZING CERTAIN RELATED MATTERS --~..ecommendation: Adopt Resolution No. 93-130 executing a Guarantee Agreement between the City, Citibank, and State Street Bank regarding Trustee services for Assessment District No. 86-2 as recommended by the Finance Department and the Assessment District Bond Counsel. REQUEST TO UNDERGROUND OVERHEAD UTILITIES - WALNUT AVENUE Recommendation: Add the Walnut Avenue underground project to the project list, but not prioritize it at this time arid request staff establish a City-wide needs list for undergrounding utilities on arterial highways to establish a supplemental long-term priority list as recommended by the Public Works Department/Engineering Division. ORDINANCES FOR INTRODUCTION- None ORDINANCES FOR ADOPTION - None OLD BUSINESS 1. APPROVAL OF NOVEMBER 1, 1993 CITY COUNCIL MINUTES The Minutes of the November 1, 1993 meeting of the City Council contained the description of the action taken by the Council in the Closed Session on November 1, 1993. The Mayor and other Councilmembers have expressed opinions that those Minutes inaccurately reflect the Council's action. Recommendation: Council has several options regarding approval of the November 1, 1993 Minutes: · Approve the Minutes of the November 1, 1993 Council meeting which in regard to the Closed Session reads: "Following Closed Session, it was moved and seconded to approve the Agreement for Extension of Term of Employment for the City Manager. Motion carried 5-0." Council Agenda 4 December 6, 1993 . Revise the Ivl~nutes to accurately (or more acCUrately) reflect the Council's perception of the action taken in Closed Session, by a motion, a second and a majority vote to revise the Minutes as follows: Motion: That the Minutes of the November 1, 1993 meeting submitted by the City Clerk be revised to read in reference to the Closed Session of November 1, 1993 as set forth below and the Minutes approved as so revised' "The Council approved the terms of the extension of the contract of the City Manager and directed the City Attorney to integrate the original Agreement of November 21, 1989, the Extension Agreement of October 7, 1991, and the draft Extension of Term of Employment Agreement presented at the meeting into one document. Approved, (four in favor, Mayor Potts opposed)." . Revise the Minutes by any other form of motion deemed appropriate by the City Council to accurately reflect the intended action of the City Council "in the Closed Session of November 1, 1993. Xl. NEW BUSINESS 1. CITIZEN CONCERN - "C" STREET ROADWAY IMPROVEMENTS At the November 15, 1993 City Council meeting, Mr. Chris.Johnson raised a concern about the condition of the improvements along "C" Street northerly of Mitchell Avenue. Recommendation: Direct staff to include the reconstruction of "C" Street, between Mitchell Avenue and its northerly terminus, within the 1994-95 Capital Improvement Program subject to availability of funding sources for the project as recommended by the Public Works Department/Engineering Division. 2. STREET SWEEPING ON THE WEST SIDE OF NEWPORT AVENUE SOUTH OF SYCAMORE DRIVE The Engineering Division is currently investigating the need for the posting of "No Parking For Street Sweeping" signs at the remaining unposted properties on Newport Avenue south of Sycamore Avenue. Recommendation- Pleasure of the City Council. 3. GRAFFITI REMOVAL AGREEMENT (COUNTY OF ORANGE) The City has received correspondence from the County of Orange transmitting information regarding action taken by the Board of Supervisors to expand the County's Graffiti Abatement Program. Recommendation- Authorize the Mayor to execute the Graffiti Removal Agreement authorizing the County to remove graffiti in and adjacent to the flood control channels at no cost to the City as recommended by the Community Council Agenda 5 December 6, 1993 Development Dep,..,, tment. 4. COMPENSATION FOR COMMISSIONERS At the City Council meeting on November 15, 1993, Mayor Potts requested staff investigate compensation received by Planning and Parks and Recreation Commissioners in other cities. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA- NOVEMBER 22, 1993 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. .Recommendation: Ratify the Planning Commission Action Agenda of November 2-2, 1,993. 2. TUSTIN PRIDE COMMITTEE PROGRAM UPDATE Informational report regarding Grocery Shopping Cart Retrieval Program. Recommendation: Rece.ive and file subject report as recommended by the Community Development Department. 3. TRAFFIC STUDY AT THE INTERSECTION OF EL CAMINO REAL AND ORANGE STREET At the November 15, 1993 City Council meeting, Mayor Potts expressed concern regarding school children crossing El Camino Real at Orange Street. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 4. TUSTIN SPORTS PARK DESIGN UPDATE The City Council has requested updates on the progress of the preparation of the Master Plan, working drawings, and bid specifications for the Tustin Sports Park. Recommendation: Receive .and file subject report as recommended by the Community Services Department. 5. INVESTMENT SCHEDULE AS OF SEPTEMBER 30, 1993 Investment schedule with maturities, 12 months or less. Recommendation: Receive and file subject report as recommended by the Finance Department.
