HUSTON, CITY MANAGER AND EXECUTIVE DIRECTOR I::i:{OM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FINAL TRACT MAP 14748 RECOMMENDATION It is recommended that the City Council adoPt Resolution 93-120 approving Final Tract Map 14748. FISCAL IMPACT There are no fiscal impacts to the City associated with this project since the tract map was initiated by the applicant and no financial assistance has been requested. BACKGROUND On June 28, 1993, the Planning Commission'adopted Resolution No. 3147 recommending to the City Council approval of Vesting Tentative Tract Map 14748. The City Council approved Vesting Tentative Tract Map 14748 on July 19, 1993, by adopting Resolution No. 93-74. These approvals included numerous conditions to be met prior to approval of the final map, with which the applicant has complied. The Final Map is now ready for recordation with the Orange county Recorders office. Prior to recordation, the Final Map must be reviewed and approved by the Planning Commission and City Council. The Planning Commission reviewed this item and recommended approval of the final map at their October 25, 1993 meeting by adopting Resolution 3199. Final Map 14748 includes forty five numbered lots and 10 lettered lots, accommodating 45 patio home dwellings. Although this project creates only 12 new lots for residential development, 33 additional numbered lots from the original Tract 14381 were incorporated into this tract and renumbered to satisfy Subdivision Map Act requirements. Final Map 14748 is bordered by Patriot Way on the north, Jamboree Road to the east, Lot 4 of Tract 13627 to the south and Pioneer Road to the west. City Council Report Final Map 14748 November 1, 1993 Page 2 CONCLUSION The resolutions approving the tentative tract map for this project included numerous conditions which were required to be satisfied prior to recordation. All required conditions have been met. Staff has determined that the Final Map is in conformance with the Vesting Tentative Tract Map approvals, requirements of the East Tustin Specific Plan, Development Agreement, the City's Subdivision Code, the East Tustin EIR and the State Subdivision Map Act.· Based upon this conformance, it is recommended that the City Council approve Final Tract Map 14748 by adopting Resolution No. 93-120 as submitted or revised. ~ Sara .J_~ Pashalides Associate. The Planning Commission finds and determines as follows: ao That Final Tract Map 14748 has been submitted by California Pacific Homes. Bo That a public hearing was held by the Planning Commission on June 28, 1993. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 14748 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 14748 on July 19, 1993. Ce That following tentative map approval, applicant filed Final Tract Map 14748. the The Final Map is considered ministerially exempt pursuant to Section 15268(b) of the California Environmental Quality Act. Se That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, the Development Agreement and Subdivision Map ACt as it pertains to the development of residential units. Fe The .1224 acres of parkland required for the additional 12 units of this development was previously dedicated with recordation of Tract 13627. Ge That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 14748 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. He That the site is physically suitable for the type of development proposed. That the Final Map is in substantial conformance with the Vesting Tentative Tract Map. II. The Planning Commission hereby recommends to the City Council approval of Final Tract Map 14748 subject to final approval, by the City Engineer, and the posting of all required bonds and agreements pursuant to Condition 1.1 of Planning Commission Resolution No. 3199.
