HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION RED HILL AVENUE UNDERGROUND UTILITY DISTRICT NO. 14 RECOM~{ENDATIONS: That the Tustin City Council, at their meeting of November 1, 1993, pass and adopt the attached resolution, which sets the time and place of a public hearing to consider the designation and adoption of the Red Hill Avenue Underground Utility District No. 14. FISCAL IMPACT: The fiscal impact will be determined at the time of the public hearing and Will be identified in the City Engineers report. BACKGROUND: At the request of the Edison Company, the City Council, at their meeting of June 21, 1993, approved the acceleration of the Red Hill Avenue Undergrounding Project between Copperfield Drive and Nisson Road. A copy of the June 21, 1993 staff report and excerpt from the City Council minutes are attached for reference. The proposed Underground Utility District No. 14 provides for conversion of all overhead distribution utilities to underground utilities along Red Hill Avenue between Copperfield Drive and Nisson Road. Skyline Dr. Santa Ana, CA 92705 DISCUSSION: i City of Tustin Ordinance 411 (Tustin City Code, Section 7500) authorizes -the City Council from time to time to call public hearings to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires, etc. within certain designated areas of the City and to consider the underground installation of the above- mentioned appurtenances for supplying electric, communication and other similar.services. . Ordinance No. '411 also requires the City to notify ali affected property owners and all concerned utilities by mail of the time and place of said hearings at least ten (10) days prior to the date of said hearing to determine whether to form an underground utility district. The attached resolution sets the da~e of the public hearing for Underground Utility District No. 14 on.Monday, December 6, 1993 at 7:00 P.M. in the City Council Chambers, 300 Centennial Way. It is proposed to fund Underground Utility District No. 14 with Southern California Edison Company Rule 20A monies, except for the cost of any additional street lights which may be required. These street light costs would be borne by the City. A complete cost breakdown of this proposed project will be included within the City Engineer's report for said District No. 14 which will be available at least ten days prior to the public hearing date of December 6, 1993. It is anticipated that the project would take between 12 and 18 months to complete. We would attempt to accelerate this project as much as feasible, depending upon the worklcads of the affected utility companies. HUSTON, CITY MANAGER ~ · · PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: INITIATION OF UNDERGROUND UTILITY DISTRICT RECOMMENDATIONS: Approve the acceleration of the Red Hill Avenue undergrounding project between Copperfield Drive and the I-5 Freeway and direct staff to commence the proceedings to initiate an Underground Utility District· FISCAL IMPACT: No budgeted funds during fiscal year 1993-94. Staff time, which would be from costs in the proposed 1993-94 Public Works Operations Budget Project would require a Capital Improvement appropriation in fiscal year 1994-95 in the. amount of $23,000. · . . BACKGROUND: · . .~ In February, 1992 the City Council established a priority list of projects for the undergrounding of overhead utilities consisting of nine (9) projects. Since that time three (3) of the projects have either been completed or are in progress by. the appropriate agencies. The remaining projects are located as follows: le · · ~ · · Red Hill Avenue between ~opperfield Drive and the I-5 Freeway (1993-94)· Red Hill Avenue between I-5 Freeway and Bryan Avenue (1995- 96) · · Bryan Avenue/Main Street between Red Hill Avenue and Newport Avenue (1997-98)· Main Street between "C" Street and the SR-55 Freeway (1999- 2000) . E1 .Camino Rea] between Newport Avenue and Browning Avenue (2001-2004). Nisson Road between Pasadena Avenue and "B" Street (2005- 2007). Utility undergrounding is usually funded by the Public Utilities Commission (PUC) Rule 20A Regulations. Rule 20A provides for the total cost of undergrounding to be borne by the utility company, with the exception of the cost of priva%e property service conversions from overhead to underground. Under the Rule 20A allocation urocess Tustin receives approximately $162,900 annually each January and it is anticipated that the City will have a balance of $105,500 as of January 1994. DISCUSSION: The Edison Company has requested that the City accelerate a utility undergrounding project for calendar year 1994 and have indicated they would be willing to front any shortfall of funding from the City's 1995 allocation. The next prioritized project is the continuation~of the undergrounding of facilities along Red Hill Avenue between Copperfield Drive and the I- 5 Freeway at an estimated cost of $262,500 excluSive of the private property service conversions. .- In addition to the undergrounding, it will be necessary to install approximately fourteen additional street lights at an estimated cost of $23,000, which would not be covered by Rule 20A Funding. The cost of these additional street lights could be budgeted in the 1994-95 fiscal year as a City expense. Staff is requesting that the city Council approve the acceleration of the Red Hill Avenue project between Copperfield Drive and the I-5 Freeway and direct staff to commence the proceedings to initiate an underground utility district for the Red Hill project. CITY OF TUSTIN MEASURE M ANNUAL PROGRAM COMPLIANCE Recommendation: In order to maintain eligibility for the Measure M Programs, it is recommended that the City Council take the following actions in compliance with Measure M requirements as recommended by the Public Works Department/Engineering Division: RESOLUTION NO. 93-121 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SETTING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER THE DESIGNATION AND ADOPTION OF AN UNDERGROUND UTILITY DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE CITY OF TUSTIN LOCATED ON RED HILL AVENUE BETWEEN COPPERFIELD DRIVE AND NISSON ROAD, WHICH AREA IS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND ON THAT CERTAIN MAP ON FILE IN THE OFFICE OF THE CiTY CLERK AND CITY ENGINEER OF THE CITY OF TUSTIN. WHEREAS, Ordinance No. 411 of the City of Tustin authorizes the City Council from time to time to call public hearings to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures within certain designated areas of the City and to consider the underground installation of the aforementioned appurtenances for supplying electric, communication, or similar associated services to the residents of the.City of Tustin; and .. WHEREAs, ~by the aforementioned Ordinance No. 411, the City Clerk is required to notify all affected property owners, if any, as shown on the 'last equalized assessment roll and also to notify all concerned utilities by mail of the time and place of hearings to determine whether to form an underground utility district and of the availability of the City Engineer's report of the details of the district in the office of the City Clerk prior to said hearing; and WHEREAS, said notice is required to be given to the aforementioned property owners and concerned utilities at least ten (10) days prior'to the date of the public hearing; and WHEREAS, the City Engineer has advised that this report is on file in the office of the City Clerk; and WHEREAS, the City Council has determined that a public hearing should be set on December 6, 1993, at the hour of 7:00 P.M.' in the City Council Chambers at 300 Centennial Way in the City of Tustin. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said council hereby sets Monday, December 6, 1993, at 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin, California, as the time and place for a public hearing to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the establishment of an underground utility district within the area of the City of Tustin generally located on Red Hill Avenue between Copperfield Drive and Nisson Road as shown on a certain map on file in the office of the City Clerk and the city Engineer of the City of Tustin. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to notify all affected property owners, if any, as shown on the last equalized assessment roll and to also notify all utilities affected by this proposal by a notice through the United States mail of the time and place of said hearing, and of the availability of the City Engineer's report of the details of the district in the office of the City Clerk prior to said hearing, ten (10) days prior to the date thereof.
