HUSTON, CITY MANAGER BETTIE CORREA, SENIOR PERSONNEL ANALYST RESOLUTION NO. 93-126 RECOMMENDATION: That the City Council adopt Resolution No. 93-126 relating to the general leave accumulation and health/welfare benefits package for Confidential Employees. FISCAL IMPACT: The City has four employees in ..positions that belong to the Confidential Group as.follows: Executive Coordinator Department Clerk, City Manager's Office Secretary, Personnel Services Office Coordinator Only one employee of the above group is eligible to retire within the next five years so the fiscal impact for the retiree health insurance benefit could be $1800 per year after the retirement date chosen. The fiscal impact of the new flexible benefits structure is too difficult to predict with any accuracy since it depends on what health plans the employee chooses. With only four positions included within this group, none to insignificant is expected. DISCUSSION: As Council is aware, memorandum of understandings for the Tustin Municipal Employees Association and Tustin Police Officers' Association were approved at the last meeting. Confidential employees are unrepresented but it has been the City's practice to retain consistency of the Benefits Package offered to employees. This resolution grants to Confidential Employees · the same options available to all other non-m.anage, ment employees. NOW, THEREFORE, the City Council of the City of Tustin, California, does hereby resolve as follows: Section 1. Flexible Benefits Plan: Effective on or before January 1, 1994 Confidential Employees will be permitted to participate in the flexible benefits plan established by the ~City in accordance with the following provisions: CONTRIBUTIONS PER MONTH PER ELIGIBLE EMPLOYEE Employee Only Employee +1' Dependent Employee +2 or more Dependents $267 $327 $478 Confidential employees who do not take medical insurance through the program offered by the City shall receive $120 per month in lieu of the flexible benefits contribution. As a condition of receiving such amount, the employee must provide evidence, satisfactory to the City, that he/she has medical insurance coverage comparable to coverage available through the City program. Ail other guidelines for the flexible benefits plan established by the City for non-management employees shall also be applicable for Confidential employees. Section 2. Section 125 Proqram: Confidential Employees may participate in the Section 125 plan to be established by the City on or before January 1, 1994. Section' 3. Retiree's H~alth Insurance: The city w~ll contribute $150 per month toward the payment of medical insurance premiums for Confidential employees who retire from the City of Tustin after October 1, 1993. Such contribution is supplemental to the $16.00 per month City 1 2 3 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 Resolution #93-126, Page 2 contribution to be made for eligible retirees under the Public Employees' Medical and Hospital Care Act Program and subject to the same conditions applicable to the PERS City contribution. Section 4. Long Term Disability: Confidential. employees shall participate in the long term disability insurance plan provided by the City. General provisions of the plan shall include a 30-day elimination period, coverage to age 65, and waiver of pre-existing conditions for current employees who are currently covered under the self-insured plan. The employee shall use 80 hours of their general leave to cover the first part of the elimination period and the City will fund the remainder to the thirtieth day at sixty percent of salary, which is the amount provided for long term disability benefits under the policy. The City shall no longer provide benefits under the current self-insured pl-an except for outstanding liabilities and the obligation to contribute a portion of general leave hours into the Employee Bank of hours will cease upon the effective- date of the purchased LTD insurance plan. Contributions to flexible benefits will continue for three (3) months of a disability leave and such time will be counted towards satisfying Federal FMLA requirements. Section 5. General Leave: The City shall provide General Leave Accrual rates for all Confidential employees according to the following formula: Years of Service General Leave Hours per Year 0-5 160 6-10 208 Over 10 248 PASSED AND ADOPTED by the City Council of the City of Tustin at a regular meeting held on the first day of November, 1993.
