FILE A NOTICE OF COMPLETION FOR STREET RECONSTRUCTION/
SUBJECT: REHABILITATION ON MAIN STREET FROM PROSPECT AVENUE TO NEWPORT
AVENUE STPL-5271 (001)
RECOMMENDATION
It is recommended that the City Council, at their meeting of
September 20, 1993, adopt the attached resolution accepting said
work and authorizing the recordation of the notice of completion.

Assuming no claims or stop payment notices are filed, it is further
recommended that 35 days after the date of recordation of the
notice of completion, the Council authorize payment of the final
10% retention amount of $27,543.67. This amount, together with
previous payments of $247,893.08 represents 100% of the final
contract amount.
FISCAL IMPACT
This project has been approved for funding up to a maximum of
$318,265 under the Federal Intermodal Surface Transportation
Efficiency Act (ISTEA) Program. The program provides for 88.53%
funding of eligible items of construction and construction
engineering. Adequate funding has been included in the 1992-93
Capital Improvement budget to cover the.City's matching share of
11.47% and non-eligible program items. Final construction cost to
the City is estimated to be less than $50,000.00 at this time and
will be subject to Caltrans' approval of the final project report.
BACKGROUND
This project encompassed removal and reconstruction of the existing
asphalt concrete pavement, portions of concrete curb and gutters,
sidewalk and wheelchair ramps, installation of traffic striping and
markings, traffic loop detectors, and adjustment of manholes and
water valve boxes to finished grades.
The work on this project has been completed by Camino Viejo
Paving, Inc. to the satisfaction of the Engineering Division. The
final contract amount is $275,436.75 which represents an increase
of 25.6 percent over the original contract amount of $219,369.60.
This increase is primarily due to extra work added to the project
as a result of removal of unsuitable subgrade materials encountered
during construction, and replacement with asphalt concrete pavement
as recomnended by the Orange County Materials Lab.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTINt
CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
STREET RECONSTRUCTION/REHABILITATION ON MAIN STREET FROM
PROSPECT AVENUE TO NEWPORT AVENUE A FEDERALLY FUNDED
PROJECT (DISADVANTAGED BUSINESS ENTERPRISE PARTICIPATION
- 15%), FAU No. M099, JOB NO. STPL-5271(001) (PROJECT
NO. 700122)
WHEREAS, Camino Viejo Paving, Inc. having a contract with the
City of Tustin to construct the hereinafter described public work
and improvement; and
WHEREAS, the Ci{y Engineer has duly certified to the
conszruction and completion of said public improvements
hereinafter mentioned in a manner satisfactory to the City Council
of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has
completed said public improvement more particularly described in
accordance with the provisions of the contract documents and the
Notice of Completion and acceptance of said public work and
improvement shall be filed and. payment of the balance due of said
contract authorized in accordance with the contract documents;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Tustin that said public work and improvement be, and the
same is hereby accepted. Said public work and improvement is more
particularly described as follows:
Street Reconstruction/Rehabilitation on Main Street from
Prospect Avenue to Newport Avenue a Federally Funded
Project (Disadvantaged Business Enterprise Participation
- 15%), FAU NO. M099, JOB NO. STPL-5271(001) (Project
No. 700122)
AND, BE IT FURTHER RESOLVED the City Engineer of the City of
Tustin be and is hereby authorized to execute and file a Notice of
Completion and acceptance of said public work and improvement
described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council
of tke City of Tustin held on the 20th day of September, 1993
