HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT ORDINANCE NO. 1110 RELATING TO PLACARDS USED TO DENOTE CONDITIONS RELATING TO CONTINUED OCCUPANCY OF BUILDINGS AFTER A DISASTER RECOMMENDATION It is recommended that the City Council take the following actions: 1. Hold first reading of Ordinance No. 1110, .by title only. 2. Introduce Ordinance No. 1110. FISCAL IMPACT 'The adoption of Ordinance No. 1110 does not have fiscal impact upon the City. BACKGROUND The Governor's office of Emergency Services (O.E.S.), in conjunction with the Federal Emergency Management Agency (F.E.M.A.), has developed standardized placards for posting the occupancy status of buildings following a disaster. During recent disaster preparedness training with O.E.S., it was recommended that local jurisdictions create and print placards with the local jurisdiction's address and phone number in the appropriate locations. Additionally, it was recommended that prior to a disaster, the jurisdiction adopt a placard ordinance establishing authority to post the occupancy status of buildings following a disaster. Ordinance No. 1110 - Placards Page two An ordinance has been drafted in accordance with the recommended language provided by O.E.S. A supply of various placards is being printed for placement in the Emergency Operations Center (E.O.C.) and for the inspector's vehicles. Examples of the placards are included in Attachment "A". The City Council of the City of Tustin does hereby ordain as follows: Section 1. Section 8'802 of Article 8 of the Tustin City Code is hereby added to read as follows: "8802 Standard placards to denote conditions related to building occupancy after a disaster. ae This section establishes standard placards to be used to indicate the condition of a structure for continued occupancy after any natural or manmade disaster. This section further authorizes the Community Development Department and the Public Works Department, as well as authorized representatives of those departments to post the appropriate placard at each entry point to a building or structure upon completion of a post- disaster safety assessment. 0 The provisions of this section are applicable, following each natural or manmade disaster, to all buildings and structures of all occupancies regulated by the City of Tustin. The City Council may extend the provisions as necessary. Ce Safety assessment is a visual, non-destructive examination of a building or structure for the purpose of determining the condition for continued occupancy following a natural or manmade disaster. de The following are verbal descriptions of the official City of Tustin placards to be used to designate the condition for continued occupancy of structures or buildings. Copies of actual placards are on file with Community Development Department. 1) "Inspected - Lawful Occupancy Permitted" is to posted on any building or structure wherein n~. apparent structural hazard has been found. This placard is not intended to mean that there is no.' damage to the building or structure. Placard color is green. 6 7 8 9 10 11 12 13 14 15 16 17 18 19~ 2O 21 22 23 24 25 26 27 28 Ordinance No. 1110 Page 2 2) "Restricted Use" is to be posted on each building or structure that has been damaged wherein the damage has resulted in some forms of restriction to the continued occupancy. The individual who posts this placard will note- ~in general terms the type of damage encountered and will clearly and concisely note the restrictions on continued occupancy. Placard color is yellow. 3) "Unsafe - Do no Enter or Occupy" is to be posted on each building or structure that has been damaged such that continued occupancy poses a threat to life safety. Building or structures posted with this placard shall not be entered under any circumstance except as authorized in writing by the department that posted the building. Safety assessment teams shall be authorized to enter those buildings at any time. This placard is not to be used or considered as a demolition order. The individual who posts the placard will note in general terms the type of damage encountered. Placard color is red. Se Once it has been attached to a building or structure, a placard is not to be removed, altered or covered until removed by an authorized representative of each department or upon written notification from the inspecting City department."
