ZONING ORDINANCE AMENDMENT 93-01 (CITY OF TUSTIN) Assembly Bill 1327, the California Solid Waste Reuse and Recycling Access (Act) requires each local agency in California to adopt an ordinance by September 1, 1994 to ensure that adequate areas are available for collecting and loading recyclable materials in development projects. Recommendation by the Community Development Department: a. Certify the Negative Declaration as adequate for the project by adopting the following Resolution No. 93-88: RESOLUTION NO. 93-88 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR ZONING ORDINANCE AMENDMENT 93-01 INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT b. Have first reading by title only and introduCtion of the following Ordinance No. 1111 approving Zoning Ordinance Amendment 93-01: ORDINANCE NO. 1111 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING REGULATIONS AND GUIDELINES RELATING TO AREAS FOR COLLECTING AND LOADING RECYCLABLE MATERIALS IN DEVELOPMENT PROJECTS 2. VESTING TENTATIVE TRACT MAP 14784 (CALIFORNIA PACIFIC HOMES) The applicant proposes to subdivide an approximate 17.7 acre site into 24 numbered and 39 lettered lots for the purpose of developing 150 patio home dwelling units. The site is bordered by Jamboree Road on the east and the Tustin Ranch Golf Club on the north, south and west. Approve the Environmental Determination for the project by adopting the following Resolution No. 93-86: RESOLUTION NO. 93-86 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE TRACT MAP NO. 14784 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY'ACT b, Approve Vesting Tentative Tract Map 14784 by adopting the following Resolution No. 93-87: RESOLUTION NO. 93-87 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OFTUSTIN, CALIFORNIA, APPROVING VESTING TENTATIVE TRACT MAP NO. 14784 3. PUBLIC HEARING TO DISCUSS THE PROPOSED CITY OF TUSTIN BUDGET FOR THE FISCAL YEAR 1993-94 As of August 16, 1993, the City Council will have held five public budget workshops to review and discuss the City's Draft Budget for fiscal year 1993-94. I · 2, 1 APPROVAL OF MINUTES - AUGUST 2, 1993 REGULAR MEETING AND AUGUST 5, 1993 SPECIAL MEETING Recommendation: Approve the City Council Minutes of August 2, 1993 and August 5, 1993. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendetion: Approve Demands in the amount of $1,204,597.40 and ratify Payroll in the amount of $306,979.11. RESOLUTION NO, 93-93 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT ACTIVITIES PROGRAM UNDER THE INTERMODAL SURFACE TRANSPORTATION ACT OF 1991 FOR THE FOLLOWING PROJECTS: (A) NISSON ROAD AND EL CAMINO REAL LANDSCAPING ENHANCEMENT PROJECT, 1994-95 FY; AND (B) EDINGER AVENUE MEDIAN LANDSCAPING ENHANCEMENT PROJECT, 1995-96 FY Recommendation: Adopt Resolution No. 93-93 authorizing the City Engineer to submit an application for the Federal Transportation Enhancement Activities Program as recommended by the Public Works Department/Engineering Division· AMENDMENT TO FIRE STATION NO. 43 REIMBURSEMENT AND IMPLEMENTATION AGREEMENTS (THE IRVlNE COMPANY) Recommendation: Authorize the City Manager to (1) Execute the First Amendment to Fire Station Construction Implementation Agreement, subject to final approval of the City Attorney; and (2) Execute the First Amendment to Reimbursement Agreement for Dedication and Construction of a Fire Protection Facility and Purchase of a New Engine Pumper, subject to final approval of the City Attorney, as recommended by' the Community Development Department. Bi RESOLUTION NO. 93-90 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING AND ADOPTING AN APPROPRIATIONS LIMIT FOR THE FISCAL YEARS 1987-1994 IN ACCORDANCE WITH ARTICLE XIIIB OF THE CONSTITUTION OF THE STATE OF CALIFORNIA AND SECTION 7910 OF THE GOVERNMENT CODE Recommendation: Adopt Resolution No. 93-90 setting the appropriations limit for fiscal years 1987-1994 as recommended by the Finance Director· 6. RESOLUTION NO. 93-91 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE APPLICATION FOR FISCAL YEAR 1994-95 fl'RANSIT-CAPITAL IMPROVEMENT FUNDS Recommendation: Adopt Resolution No. 93-91 authorizing the City Engineer to submit an application to Caltrans for Transit Capital Improvement program funds as recommended by the Public Works Department/Engineering Division. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1114 (roll call vote)' ORDINANCE NO. 1114 - AN 'ORDINANCE OF THE CITY COUNCIL OF THE CITY OFTUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 93-003 CHANGING THE ZONING DESIGNATION OF THE PARCEL IDENTIFIED AS ASSESSOR PARCEL NO. 402-261-02 FROM MULTIPLE FAMILY RESIDENTIAL (R-3) TO PLANNED DEVELOPMENT (PD) IX. OLD BUSINESS 1. APPLICANTS FOR COMMISSION/COMMITTEE VACANCIES At the City Council meeting of July 19, 1993, staff was-directed to advertise for applicants to fill term expirations on the Planning Commission, Parks and Recreation Commission, Audit Committee and Cultural Resources Advisory Committee. Staff has received ten .applications for. Planning Commission; nine applications for Parks and Recreation Commission; four applications for the Audit Committee; and seven applications for the Cultural Resources Committee. Recommendation: Pleasure of the City Council. X. NEW BUSINESS 1. APPLICATION FOR ALLOCATION OF MORTGAGE CREDIT CERTIFICATES Under the Mortgage Credit Certificate, first-time homebuyers who qualify by income and by the price of the unit they purchase, receive a certificate authorizing them to receive a tax credit of 20% of their annual principal and interest payment. Recommendation by the Community Development Department: a. Authorize the Community Development Department to prepare and submit to the County an application to the California Debt Limit Advisory Committee. b. Adopt the following Resolution No. 93-92 adopting a Mortgage Credit Certificate Program in cooperation with the County of Orange: RESOLUTION NO. 93-92 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING A MORTGAGE CREDIT CERTIFICATE PROGRAM IN COOPERATION WITH THE COUNTY OF ORANGE Council Agenda 4 August 16, 1993 Ce de Authorize the execution of a cooperative agreement between the County of Orange and the City to undertake the Mortgage Credit Certificate Program (Exhibit to Resolution No. 93-92). Adopt the following Resolution No. 93-94 finding that the. Mortgage Credit Certificate Program will benefit both the Town Center and South Central Project Areas: RESOLUTION NO. 93-94 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT THE USE OF TAXES ALLOCATED FROM THE SOUTH CENTRAL PROJECT .AREA AND FROM THE TOWN CENTER PROJECT AREA FOR THE MORTGAGE CREDIT CERTIFICATE PROGRAM OUTSIDE THE PROJECT AREAS WILL BE OF BENEFIT TO BOTH PROJECT AREAS 2. TUSTIN COMMUNITY FOUNDATION The City's representative handling the approval process has recommended that the City Council proceed with naming the Foundation's Board of Directors. Recommendation: Pleasure of the City Council. Xl. REPORTS 1. PLANNING COMMISSION ACTION AGENDA- AUGUST 9, 1993 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of August 9, 1993. 2. REPORT ON U.S. POSTAL REGULATIONS ON MAILBOXES On July 1'9, 1993, during the City Council review of Vesting Tentative Tract 14748 (Presidio Expansion) questions were raised regarding mailbox design and location. Recommendation: Receive and file subject report as recommended by the Community Development Department. e STATUS REPORT: CITIZEN CONCERN REGARDING CHANNELIZATION OF RIGHT TURN ONLY MOVEMENTS ON RED HILL AVENUE, SOUTHERLY OF EDINGER AVENUE - At the July 19, 1993 City Council meeting, Ms. Jane Anderson expressed concern regarding the northbound Red Hill Avenue exclusive right turn movement onto Edinger Avenue. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. Council Agenda 5 August 16, 1993 XlI. Xlll. XlV. XV. 4. SPORTS PARK DESIGN UPDATE The City Council has requested updates on the' progress of the preparation of the Master Plan, working drawings, and bid specifications for the Sports Park. Recommendation: Receive and file subject report as recommended by the Community Services Department. 5. INVESTMENT SCHEDULE AS OF JUNE 30, 1993 · Investment schedule with maturities, 12 months or less. Recommendation: Receive and file subject report as recommended by the Finance Department. 6. CABLE TELEVISION REGULATION UPDATE The Federal government recently enacted the Cable Television Consumer Protection and Competition Act of 1992. The Act permits franchising authorities to regulate rates for basic cable service only. 'Recommendation: Direct staff to apply to the Federal Communications Commission for certification to regulate cable television rates after September 1, 1993. PUBLIC INPUT OTHER BUSINESS 1.
