PROGRAM FUNDING APPLICATION SUBMITTAL AUTHORIZATION
RECOMMENDATION
It is recommended that the City Council, at their meeting of August
16, 1993, adopt the attached Resolution No. 93-93 authorizing the
City Engineer to submit an application for the Federal Transportation
Enhancement Activities (TEA) Program.
FISCAL IMPACT
The City's matching share for TEA projects is 12% of the estimated
cost of preliminary engineering and construction. If the Nisson
Road/E1 Camino Real project is approved, the City will have to budget
approximately $40,000 in matching funds for the project in 1994-95
FY. If the Edinger Avenue project is approved, the City will have to
budget approximately $1.02,000 in matching funds for the project in
1995-96 FY.
BACKGROUND AND DISCUSSION
In late 1991, the United States Congress drafted and the President
signed into law the Intermodal Surface Transportation Efficiency Act
(ISTEA). -"-Z-'component of ISTEA is the Transportation Enhancement
Activities Program (TEA), a 10 percent set aside from .the surface
transportation program funding category. Over the 6 year life of the
Act, over $200 million in transportation enhancement activities are
apportioned to California. In California, these monies can be
matched by as little as approximately 12% non-Federal dollars to 88%
Federal dollars. The reimbursable Federal-aids monies, are subject
to all the requirements of Title 23 of the United States Code and
related Federal and state laws and guidelines.
Last month, the Orange County Transportation Authority (OCTA) issued
a two-year (Fiscal Years 1994-95 and 1995-96) call for projects for
the Federal TEA program. Funding for this program is intended for
use on pedestrian and bicycle facilities, acquisition of scenic
easements and scenic or historic sites, scenic or historic highway
programs, landscaping and other scenic beautification, historic
preservation, rehabilitation and operation of historic transportation
buildings, structures or facilities (including historic railroad
facilities and canals), preservation of abandoned railway corridors
(including the conversion and use thereof for pedestrian or bicycle
trails), control and removal of outdoor advertising, archaeological
planning and research, and mitigation of water pollution due to
highway runoff.
The Engineering Division of the Public Works Department is
recommending two projects to be submitted as part of the application:
A. Nisson Road and E1 Camino Real Landscaping Enhancement
Project for Fiscal Year 1994-95 at an estimated cost of
$332,400. This will include planting vines, trees and/or
ground cover with drip irrigation system along the I-5
Freeway on E1 Camino Real between Browning Avenue and
Newport Avenue and on all segments of Nisson Road between
Browning Avenue and Pasadena Avenue.
B. Edinger Avenue Median Landscaping Enhancement Project for
Fiscal Year 1995-96 at an estimated ~ost of $851,000. This
will include construction of median curb and gutter and
irrigation system, and planting of trees and grass within
the median between Red Hill Avenue and Harvard Avenue to
match the existing median landscaping improvement adjacent
to Jamboree Plaza.
'As part of the application package which is being prepared by the
Engineering staff, a Resolution of the City Council must be approved
identifying the City representative who is authorized to submit the
required documents and applications and enter into an agreement with
the State to implement the program if the application is approved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING THE APPLICATION FOR FUNDS FOR THE
TRANSPORTATION ENHANCEMENT ACTIVITIES PROGRAM UNDER THE
INTERMODAL SURFACE TRANSPORTATION ACT OF 1991 FOR THE
FOLLOWING PROJECTS:

EDINGER AVENUE MEDIAN LANDSCAPING ENHANCEMENT
PROJECT, 1995-96 FY
WHEREAS, the United States Congress has enacted the
Intermodal Surface Transportation Efficiency Act of 1991, which is
to make available over $200 million in federal dollars over a 6
year period as funds to the California Department of
Transportation for transportation enhancement activities; and
WHEREAS, the Department of Transportation has established the
procedures and criteria for reviewing proposals and, along with
the Regional Transportation Agencies, will submit to the
California Transportation Commission a list of recommended
projects from which the recipients will be selected; and
WHEREAS, said procedures and criteria established by the
California Department of Transportation call for the approval of
an application by the applicants governing body before submission
of said application to the California Transportation Commission;
and
'WHEREAS, the application contains assurances that the
applicant must comply with; and
WHEREAS, the applicant, if selected, will enter into an
agreement with the State of California to carry out the
transportation enhancement activities project;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tustin:

Approves the filing of an application for the
Transportation Enhancement Activities Program for
consideration for funding.
Will provide in non-Federal funds approximately $40,000
for the Nisson Road and E1 Camino Real project, and
approximately $102,000 for the Edinger Avenue project.
Certifies that this body will make adequate provisions
for operation and maintenance of the project.

Appoints Robert S. Ledendecker, Director of Public
Works/City Engineer as agent of the City of Tustin to
conduct all negotiations, execute and submit all
documents, including .but not limited to application,
agreements, amendments, payment requests and so on,
which may be necessary for the completion of the
aforementioned projects.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin held on the 16th day of August, 1993.
