FISCAL IMPACT
There are no fiscal impacts associated with this project as this is
an applicant initiated project. No City financial assistance is
requested.
RECOMMENDATION
It is recommended that the City Council take the following actions:

Approve the environmental determination for the project by
adopting Resolution No. 93-73; and
APprove Vesting Tentative Tract 'Map 14748 by adopting'
Resolution No. 93-74, as submitted or revised.
BACKGROUND
In 1991, the Planning Commission and City Council approved
Tentative Tract 14381, a subdivision which created 155 lots for
single-family dwellings, a recreation facility and open space
corridors. This project is an expansion of the previously approved
Presidio Project (Tract 14381) to create 12 new residential lots on
Lot I, an area that had been reserved for the Eastern
Transportation Corridor. Since the Transportation Corridor Agency
no longer needs Lot I, the parcel can be developed and.incorporated
into the Presidio Project. In order to ensure that these twelve
(12) new lots are properly integrated into the Presidio site plan
and to cOmply with the technical requirements of the Subdivision
Map Act, this project incorporates thirty three (33) residential
lots that were previously established with approval of Tract 14381.
Some of these original lots have increased in size, and some of the
dwellings have been re-oriented. In addition, since the law
requires direct access to a public street for all tracts, this
subdivision extends to Pioneer Road. The applicant proposes to
utilize the same architectural plans currently under construction
in the first phases of Presidio.

Located in Sector 2 of the East Tustin Specific Plan (ETSP), the
project is bordered by Patriot Way on the north, Lot 4 of Tract
13627 (condominiums to the south, Jamboree Road~on the east and
Pioneer Road on the west). 'The expansion area is at the north
eastern edge of Tract 14381, adjacent to Jamboree Road and Patriot
Way. Anticipated development in the vicinity includes single-
family detached dwellings to the north and west.
Prior to development, the City Council must approve the proposed
Vesting Tentative Tract Map. At their regular meeting on June 28,
1993, the Planning Commission adopted Resolution No. 3147
recommending that the City Council approve Vesting Tentative Tract
Map 14748. In conjunction with this action, the Planning Commissin
also adopted Resolution No. 3145 approving Design Review 92-043 and
adopted Resolution No. 3146 approving Conditional Use Permit 93-001
authorizing use of the Cluster Development Standards for this
project pursuant to Section 3.6.3 (B) of the ETSP.
The primary intent of cluster development is.to utilize a portion
of each lot to create a cohesive, common, open space scheme that
served a viable purpose for the development. A development
utilizing the Cluster Development standards for a Medium-Low
Density Residential development allows for reductions in the
minimum lot area, lot width and setbacks while retaining the same
density standard of ten dwelling units per acre.
A public hearing notice identifying the time, date and location of
the public hearing on this project was published in the Tustin
News. Property owners within 300 feet of the site were notified of
the hearing by mail and notices were posted on the site, at City·
Hall and at the Tustin Police Department. The applicant was
informed of the availability of a staff report on this project.
DISCUSSION
The ETSP designates the project site as Medium-Low Density
Residential. The maximum allowable density for this land use
designation is 10 dwelling units per acre. The overall density of
the original Tentative Tract 14381 plus ~he expansion area is 7.38
dwelling units per acre, approximately 26 percent less than the
allowable density. The applicant is proposing a development which
is a cluster concept with motor court groupings of six to eleven
units off a main loop roadway.
Access to the expansion area is propose~ from Churchill Place and
Brand Drive which ~.ntersects Pioneer Rcad approximately 440 feet
south of Patriot Way. These streets are part of the backbone
private street system of Tract 14381 and are 36 feet wide,

accommodating parking on both sides of the street. The northern
portion of Presidi~ project maintains a "U-shaped" roadway with
nine intersecting secondary rOadways leading to ten motor court
clusters. The 12 additional units are located at the end of 4 of
these motor courts. Motor cOurt clusters propose 28-foot to 32-
foot wide private streets for access from the main tract roadway,
and 25-foot wide private drives internally providing access to
certain dwelling units. Certain modifications to the City's Street
Standards were necessary for the motor court concept.
The entire Presidio project will have a total of 114 guest parking
spaces where 84 spaces would be required, resulting in an overage
of approximately 26 percent. Four (4) additional guest parking
spaces were added as part of this expansion area. All resident
parking for the 12 new units is provided by 12 two-car attached
garages for a total of 24 garage spaces, consistent with the ETSP.
No parking would be permitted within travelways less than 32 feet
in width or in driveways less than 19 feet in height. A'condition
of approval has been included regarding the enforcement of parking
regulations to be included in the project's recorded CC&R's to
mitigate any potential illegal parking problems.
In conformance with Cluster Development standards, the applicant is
proposing to provide a centralized open space area for the
enjoyment of all the residents of the whole Presidio project in the
form of a recreation facility combined with a pedestrian trail
system linking the south and north portions of the project. The
recreation facility includes a pool, spa and restroom/equipment
building. Each of the clusters are also linked together via a
sidewalk system, combined with a landscaping theme, beginning
within each of the motor-courts and continuing towards the center
of the project. The slope area, just south of the expansion area,
will provide relatively flat pockets of passive open space and a
link to a proposed bus stop along Jamboree Road. The recreation
facility, to the west of the e>~ansion area, proVides an active
open space area while providing a vantage point for view
opportunities; both on-site (the slope grove planting) and off-site
(Peter's Canyon Ridgeline and the eucalyptus windrows). The
recreation facility and the centralized open space area are located
adjacent to and just south of tkis tract.
The site was previously graded as part of the grading for Tract
14381 (Presidio Project) and Tract 13627 (sector level map). A
majority of the tract is relatively flat with the exception of Lot
I of Tract 14381. Lot I inciude! a ten (10) foot high slope as a
transition between the Presid2o Project and Patriot Way and
Jamboree Road. In order to acccr~odate the additional twelve (12)
dwelling units, this slope is proposed to be regraded to create a
more level pad area that can be ~eveloped.

The architectural style of the expansion area will utilize the
plans previously approved for- the Presidio Project. The
architectural plans attached to this report are the same concept
plans that were reviewed and conditionally approved during the..
Planning Commission review of Presidio, almost two years ago. The
exterior design concept remains the same, however, the interior
floor plans have been modified during plan check as a result of
conditions of approval limiting the number of four bedroom units.
Since this project is being incorporated into the Presidio Project,
the applicant proposes to utilize the same floor plans and
architectural design that is presently under construction in the
first phases of Presidio.
The architecture is a contemporary interpretation of the Monterey
style. The structures will have "S" tile roofs, stucco walls and
wood trim. Some of the architectural details include multi-pane
windows, wrought iron balconies, wood trim, planter boxes and
various architectural recesses and pop-outs to provide a break in
the building mass of the long elevations. Please refer to
Attachment A for a statistical summary of the project.
The highlight of the Presidio Project combines the slope portion
with the recreation facility to provide cohesive open space,
including passive and active areas. The slope portion of the tract
will receive a grove planting treatment of Indian Laurel Fig and
the slope itself will be graded to provide pockets of relatively
flat, open space areas off of a pedestrian trail system that links
the south and north portion of the tract. This feature provides a
simulation of the historical agricultural use of the land while
providing an identifiable focal point to the development.
ENVIRONMENTAL ANALYSIS
Based upon review of Vesting Tentative Tract Map 14748, as well as
Environmental Impact Report 85-2 (as supplemented) it has been
determined that the environmental issues relating to this project
have previously been addressed. Also, appropriate mitigating
measures identified in EIR 85-2 are included as conditions of
approval for the project. With this information in mind, it is
recommended that the City Council make the finding that
requirements of the California Environmental Quality Act have been
met and that no further environmental review is required.

CONCLUSION
Given the anal.ysis conducted -by the Community Development
Department and in consideration of comments from other agencies and
the public, it is concluded that the proposed project meets the
requirements of the East Tustin Specific Plan, the Subdivision Map
Act, as adopted, and the California Environmental Quality Act.
With the inclusion of conditions of approval listed in Planning
Commission Resolution 3147, it is recommended that the City Council
approve the environmental determination for the project and approve
Vesting Tentative Tract Map 14748.

The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:
A. .That Vesting Tentative Tract Map No. 14748 was
submitted, to the Planning Commission by California
Pacific Homes for consideration; and

dedicated with recordation of.TraCt 13627.

Facilities Agreements~ between the Irvine Company
and the Tustin Unified School District. The East,
Tustin Specific Plan, EIR 85-2 with subsequently!
adopted supplements and addenda, the impact of
vesting Tentative Tract 14748 on School District
facilities, and reviewed changes in State law, and
finds and determines that the impacts on School
District facilities by approval of this map are
adequately addressed.

CONDITIONS OF APPROVAL
GENERAL -
(1) 1.1 Within 24 months from tentative map approval, the
Subdivider shall file with appropriate agencies, a final
map prepared in accordance with subdivision requirements
of the Tustin Municipal Code, the State Subdivision Map
Act, and applicable conditions contained herein unless an
extension is granted pursuant to Section 9335.08 of the
Tustin Municipal Code.
(1) 1.2 Prior to occupancy of units, the Subdivider shall record
a. final map in conformance with appropriate teutative
map.
(1) 1.3 Prior to final map approval.
A. Subdivider shall submit a current title report.

lots, paseos and easements adjacent to project

(1) 1.5 The cumulative number of residential units for which
(9) certificate of occupancy may be issued shall not exceed

Tustin Specific Plan Development Agreement.
*** 1.6 Prior to release of building permits, all conditions of
approval of Design Review 93-001 of the subject project
shall be complied with as shown on Exhibit A attached to
Resolution No. 3145 and incorporated herein by reference.
*** 1.? Ail conditions of approval for Vesting Tentative Tract

2938 shall apply to the expansion area, unless superseded
by conditions contained herein.
DEDICATIONS/RESERVATIONS/EASEMENTS
(1) 2.1 Lots 6, 7, 9, 10, and 11, encroach into the 42-foot-wide
storm drain easement. No permanent structures will be
permitted over this easement.
FIRE DEPARTMENT
(5) 3.1 Prior to the issuance of any building permits, all
underground piping for automatic fire extinguishing
systems shall be approved. Plans for an automatic fire
extinguishing system shall be approved by'the Fire Chief
prior to installation. Such systems shall be operational
prior to the issuance of a certificate of use and
occupancy. The following lots are subject to this
requirement: 6,7,8,16,17,27,28,43,44 and 45.
CC&R'S
(I) 4.1 Prior to approval of the final map, all organizational
(3) documents for the project including any deed
(8) restrictions, covenants, conditions, and restrictions
(9) shall be Submitted to and approved by the Community
Development Department and City Attorney's Office.
Costs for such review shall be borne by the subdivider.
A copy of the final documents shall be submitted to the

UTILIZE THE CLUSTER DEVELOPMENT STANDARDS FOR
THE DEVELOPMENT OF 12 ADDITIONAL DWELLINGS.
Recommendation - It is recommended that the Planning Commission
take the following actions: 1. Approve the Environmental
Determination for the project by adopting Resolution No. 3144; 2.
Approve Design Review 92-043 to amend Design Review 90-55 by
adopting Resolution No. 3145, as submitted or revised; 3. Approve
Conditional Use Permit 93-001 to amend Conditional Use Permit 91-17
for a cluster development by adopting Resolution No. 3146, as
submitted, or revised; and 4. Recommend approval to the City
Council of Vesting Tentative Tract Map 14748 which amends Tentative
Tract 14381 by adopting Resolution No. 3147, as submitted or
revised.

Commissioner Stracker asked if it were correct that Plan No. 2 was
changed from four to three bedrooms.
S~aff noted that in %he criginal plan submittal it was a four
bedroom unit and the Planning Commission .included a condition
requiring no more than 30% of the units were four bedroom. The
developer's solution at plan check submittal was to modify the
interior layout of plan 2 to eliminate the fourth bedroom to meet
the 30% requirement.
Commissioner Stracker asked if~_~]oor plans for plan 2 were
available.
Staff nozed that they %.:ere not included in %he staff report; the
floor plans are not 5, e~ through the plan check process. The
footprint did nc% change, it was just %he ups%airs floor ~ayout
zha~ was modi=ied.

The Public Hearing was opened at 7:25 p.m.
Jon W. Robertson,. 5 Civic Plaza, #100, Newport Beach, Ca.,
representing California Pacific Homes, distributed the marketing
product brochures for this project for the Commission's review and
gave a project summary. He stated that he was in concurrence with
the staff report as presented, with one minor exception having to
do with the mailbox issue and if there was any identified problem
he would try to solve it. .
Commissioner Kasalek asked Mr. Robertson to explain what he just
stated about the mailboxes, especially as to how it would affect
three of the homes as he stated.
Mr. Robertson stated that there are four mailboxes currently in
place on the 'project of the twelve that service that area. Three
of the four mailboxes are in yards that have been disclosed to
homeowners as being that location. If the mailboxes are moved, it
would affect three homeowners currently living in those residences.
The primary objection to moving the mailboxes is that they would
obstruct picture window views.
The Director asked if Mr. Robertson )[new which lot numbers these
were.
Mr. Robertson responded, Lots 58, 57, 45, 47 and 37. Those lots
now occupied are 58, 57 and 48
Commissioner Stracker noted that he had been at the site. He asked
if lot $ were not included since he noticed there had been a re-
orientation of lot $ from this map to the map of the old tract. ~He
asked if this also would constitute a change.
!,Ir. RobertsoD responded that the original tentative tract map
14381 was all 155 19ts. Subsequent to the approval of the original
tentative tract map they filed two final maps so that when they
filed the~ina~. map those lot numbers superseded the -~-ive
~ract map. The entire portion of the site to the left of the
recreation facility is Tract 14567 with numbered lots 1-~2.

through three approvals from the'U. S. Postal service prior to
coming up with the current solution.
commissioner Weil stated she felt that the Company has already been
put through enough and as far as the actual mailboxes in the ground
she feels they should be left where they are.
Commission Stracker asked where the mailboxes were currently
specifically located.
Mr. Robertson stated that they were on the corner of lot 5~ on the
curb return at the intersection of Gray and Kimball.
Commissioner Stra'cker asked if these homes were FHA approved.
Mr. Robertson answered no, that process has not taken place on this
project because of Pricing, but that.all construction standards
exceed FHA requirements.
Commissioner Stracker asked if they anticipate installing the air
conditioning units on the outside of the master bedrooms. He was
concerned about the noise they create.
Mr. Robertson stated that two phases of the project are currently
occupied and that there has not been a complaint from any of the
homeowners.
The Director noted that there is a field acoustical study required
prior %o a certificate of occupancy which requires a. maximum
interior noise level of 45 dBa. If that is exceeded the developer
~ould be required, pursuant to Title 25, to install additional
noise insulation.
Commissioner Stracker asked how the lots were drained.

scene and the third level of fencing is a wood neighbor fence which
is installed by California Pacific and painted for the homeowner.
Mr. Robertson showed the Commission an example of a section of this
actual, fence.
Commissioner Stracker asked.what the maintenance requirements were
for the fencing and who was responsible.
Mr. Robertson responded that the party wall fence would be the
responsibility of the homeowner and the stucco wall maintenance
would be the responsibility of the homeowner's association with
the exception of the interior surface which is the maintenance
responsibility of the homeowner, however, structural damage is to
be taken care of by the association.
Commissioner Stracker noted that the orientation of the side yards
look right into the rear yards, especially lot 40, 39, 38 and 41.
~Mr. Robertson no~ed that this was not the intent. Within the four
floor plans, as can be seen in the brochure, there are 17 different
elevations available to the project. Lot 41 is the dead wall and
there are no windows on that side, only glass block accents.
Commissioner Stracker noted that he was concerned about security in
the areas where the lots back up into the court areas.
Mr. Robertson responded that all the rear yards are completely
enclosed with a fence; where the rear yard does face a street a
stucco and stud wall fence would be provided.
The Director noted that each of the site plans have gone through
extensive security analysis and the City also uses an outside
security advisor to advise our Police Department. Both Mr.
.
Robertson and Mr. Moorhous will confirm that there was an extensive
list of corrections for security concerns that each of the Patio
Home projects has gone through in the initial stages of project
review. The Tustin Police Department has no outstanding security
issues at this time. To make a judgement concerning security
%;ithout the input of the Police.Department, here and now, is really
difficul~ and it would be hard to pose a redesign request at this
~ime to the applicant when the project has undergone an e>~%ensive
security analysis.
Commissioner Weil asked what the target pricing is and wha% might
be the price of the four bedroom.

Mr. Robertson responded that the current market pricing starts at
230 thousand with the four bedroom at 265 thousand.
Commissioner Butler asked that if the four homeowners involved
where the mailbox posts currently are would request to have them
moved to be in conformance with the rest of the development, would
California Pacific be willing to move the boxes.
Mr. Robertson responded that would not be a problem.
The Public Hearing closed at 7-45 p.m.

Commissioner Well would like to have the mailboxes that are
already installed in the ground remain and recommends only moving
the location of future boxes which have not as yet been installed.
Commissioner Butler agrees but would like the homeowners with
installed mailboxes to have the option of having theirs moved if
they wish it.
Commissioner Weil feels this particular type of gang mailbox is an
abomination and cannot understand why the post office vehicles
can't maneuver down the streets. She would like to pursue trying
to bring our residents more convenience and to accomplish getting
the mailboxes on the corner individually. She feels that having a
homeowner who lives at the end of the cul-de-sac have to walk all
the way up to the end and sometimes around a corner or park
illegally in order to pick up mail is setting up future residents
and doing them a disservice. She feels the Commision should try to
solve this problem.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, FINDING THAT FINAL ENVIRONMENTAL IMPACT
REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN
(FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY
ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO
SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE
TRACT MAP 14748 AND ALL FEASIBLE MITIGATION
MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT.
The City'Council of the city of Tustin does hereby resolve as
follows:
I. The City Council finds and determines as follows:
A. That a Vesting Tentative Tract Map 14748 and
respective development plans are considered
"projects" pursuant to the terms of the California
Environmental Quality Act; and
B. That the projects are covered by a previously
certified Final Environmental Impact Report for the
East Tustin Specific Plan which serves as a Progra~
EIR for the proposed projects.

II. The East Tustin Specific Plan Final Environmental Impaci
Report (85-2), previously certified on March 17, 1986 as
modified by subsequently adopted supplements and addenda,
was considered prior to approval of this project. ThE
City Council hereby finds: this project is within the
scope of the East Tustin. Specific Plan previousl5
approved; the effects of this project, relating
grading, drainage, circulation, public services an(
utilities, were examined in the Pro~ra~ EIR. Ali
feasible, mitigation measures and alternatives developed
in the program EIR are incorporated into this project.
The Fih'a}-EIR, is therefore determined to be adequate t¢
serve as a Program EIR for this project and satisfies al,
requirements of the California Environmental Quality Act.!
Further, the City council finds the project involves nc
potential for any adverse effect, either individually
cumulatively, on wildlife resources; and, therefore
makes a De Minimis Impact Finding related to AB 3158
Chapter 1706, Statutes of 1990.

Applicable mitigation measures identified in the Final
EIR have been incorporated into this project which
mitigates any potential significant environmental effects
thereof. The mitigation measures are identified as

Resolution No's. 3145,' and 3146, approving Design
