A RESOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE CITY OF TUSTIN, CALIFORNIA APPROVING AN
AGREEMENT BETWEEN THE CITY OF TUSTIN AND
IRVINE RANCH WATER DISTRICT FOR RELOCATION OF
WELLS, THE GRANTING OF EASEMENTS AND LICENSE
RELATED THERETO TO IRVINE RANCH WATER
DISTRICT AND THE ACCEPTANCE OF QUITCLAIM
DEEDS FROM IRVINE RANCH WATER DISTRICT
RELATED THERETO
The City Council of the City of Tustin finds:
WHEREAS, The City of Tustin ("City") and Irvine Ranch Water District ("IRWD")
entered into agreements in 1996 ("SAMP/Well Site Exchange Agreement") and 2011
("Wells 21 and 22 Agreement") relating to, among other things, the exchange of water
well sites, cost of relocating well sites and the use thereof on the former Marine Corp Air
Station, Tustin ("MCAS Tustin"); and
WHEREAS, the City and IRWD desire to amend and restate their respective
obligations with respect to the SAMP/Well Site Exchange Agreement and Wells 21 and
22 Agreement by entering into a new agreement entitled Agreement Between The City
of Tustin and Irvine Ranch Water District For Relocation Of Service Connection OC-58
And Mitigation Of Well 21 And 22 Impacts, And Amending And Restating Agreement
For Preparation Of SAMP And Exchange Of Tustin Legacy Well Sites (hereafter,
"Agreement"); and
WHEREAS, pursuant to the Agreement the City will be granting specified
easements and a license to IRWD for the construction, operation and maintenance of a
water well; and
WHEREAS, in exchange for the grant of such easements and license, IRWD will
be quitclaiming to the City certain property interests it has in well sites at other locations;
and
WHEREAS, the demolition of specified well sites pursuant to the Agreement has
already occurred as part of the Warner Avenue street improvement project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN DOES
HEREBY RESOLVE, ORDER AND DETERMINE AS FOLLOWS:
SECTION 1: That the Agreement be approved and the Mayor is authorized to
execute the Agreement on behalf of the City and the City Clerk to attest thereto.
SECTION 2: That the City Manager is authorized to execute on behalf of the
City the grant of easements to IRWD in substantially the form attached to the

Agreement as Exhibits A-2, B-3 and B-4, and the license in substantially the form

attached to the Agreement as Exhibit B-2.
SECTION 3: That the City Manager is authorized to accept on behalf of the City
the quitclaim deeds in substantially the form attached to the Agreement as Exhibits A-3
and A-4.
SECTION 4: That the City Manager is authorized to execute any other
documents that may be reasonably necessary to implement the Agreement and the City
Council's approval thereof.
SECTION 5: The Agreement is categorically exempt from CEQA pursuant to
Title 14, California Code of Regulations, § 15303 new construction of small structure, §
15302(c) replacement of existing utility facilities involving negligible or no expansion of
capacity, and § 15061, it can be seen with certainty that there is no possibility that the
Agreement may have a significant effect on the environment
SECTION 6: This Resolution shall be effective upon its adoption.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council held on
the 2nd day of June, 2015.

passed and adopted at a regular meeting of the Tustin City Council, held on the 2nd day of
June 2015 by the following vote:
