FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - FY 1992-93, SUBJ~C~ SIDEWALK, CURB AND GUTTER REPAIR PROJECT, PHASE ONE AND ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT, PHASE TWO RECOMMENDATIONS It is recommended that the City Council, at their meeting of July 6, 1993, adopt the attached resolution accepting said work and authorizing the recordation of the Notice of Completion. Assuming no claims or stop payment notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion, that. the Council authorize payment of the final 10% retention in the amount of $48,004.74. This amount together with previous payments of $432,04.2.63 represents 100% of the final contract amount. FISCAL IMPACT The final cost of construction is $480,047.37. The street rehabilitation/overlay is funded from the CIP Major Maintenance Program in the amount of $391,931.79. The sidewalk, curb and gutter repair is funded from the Annual Sidewalk, Curb and Gutter Repair Program in the · amount of $88,115.58. BACKGROUND This project encompassed rehabilitation and overlay of various streets .in the residential area easterly of Red Hill Avenue and southerly of Walnut Avenue; and repair of median islands, sidewalk, curb and gutter; and replacement of traffic signal loops, striping and legends. This work has been completed to the satisfaction of the Engineering Division. The final contract amount is $480,047.37. This represents an increase of 6.49 percent from the original contract amount of $448,899.47. The increase was due to additional quantities and additional work as detailed in Contract Change Order No. 1. Robert S. PHASE ONE AND ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT PHASE TWO WHEREAS, Ail American Asphalt, having a contract with the City of Tustin to construct the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public imprOvements, hereinafter mentioned in manner 'satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said improvements hereinafter more particularly described in.accordance with the provisions of the contract documents and the Notice of Completion, andacceptance of said public works and .improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: FY 1992-93 Sidewalk, Curb and Gutter Repair Project, Phase One and Asphalt Concrete Rehabilitation and Overlay Project Phase Two AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be, and is hereby authorized to execute and file a Notice of Completion and acceptance of said public works and improvement described herein as require by law.
