SUBJECT: CONDITIONAL USE PERMIT 2015-06 CONTINUANCE REQUEST
BACKGROUND:
The proposed project is a request to amend Conditional Use Permit (CUP) 88-8 to revise
conditions of approval pertaining to the parking standards for the Oak Tree Plaza
shopping center and to utilize the standards within the City of Tustin Parking Ordinance
as well as amend outdated conditions of approval related to the shopping center located
at 17582-17612 17th Street. The project applicant is proposing to open a 2,922 square
foot urgent care facility which would split a tenant space located at 17612 17th Street.
The remaining 3,555 square feet of the tenant space is proposed to be occupied by a
Yoga studio. CUP 88-8 permits all uses allowed within the C-1 and C-2 zoning districts.
Both medical office use and yoga studios are permitted uses within the C-1 and C-2
zoning districts; however, due to the parking restrictions existing on the property,
additional medical office use would not be permissible. Therefore, the applicant is
requesting to amend CUP 88-8 to make the parking requirements within Oak Tree
Plaza consistent with those of the Tustin City Code (TCC). The parking ratios within the
TCC would allow the retail center to qualify as a large retail center and take advantage
of more flexible parking requirements to accommodate the request.
Oak Tree Plaza consists of a mixed-use commercial center with three (3) retail buildings
fronting 17t" Street and an office building at the rear of the property adjacent to
Vandenburg Lane. The applicant is representing the retail properties (17582, 17602,
and 17612 17t" Street) which lie on a separate parcel from the office building (17592
17tH Street) and are under separate ownership interests with non-exclusive access
easements for ingress and egress purposes. The proposed amendments to CUP 88-8
would impact the office building property located at 17592 17t" Street.
Conditional Use Permit 2015-06 was noticed for a June 16, 2015, public hearing before
the Zoning Administrator. However, City staff has received a request for continuance of
the item by the property owner of the office building (17592 17th Street) within Oak Tree
Plaza to allow for sufficient time to review the proposed application.

RECOMMENDATION:
Staff is recommending that the Zoning Administrator continue the item for Conditional Use
Permit 2015-06 in order to provide additional time for affected property owners to properly
review the proposed application.
