HomeMy WebLinkAbout04 CLAIM #03-05 04-07-03AGENDA REPORT Agenda Item Reviewed: City Manager Finance Director 4 MEETING DATE: APRIL 7, 2003 TO: FROM: SUBJECT: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL CITY ATTORNEY CLAIM OF PACIFIC BELL; CLAIM NO. 03-05 SUMMARY: The City Council is being asked to consider a claim by Pacific Bell for alleged damages to one of their facilities. RECOMMENDATION: After investigation and review, it is recommended that the City Council deny the claim and send notice thereof to the claimant and the claimant's attorneys. FISCAL IMPACT: None. DISCUSSION: Pacific Bell alleges that some of their cable and a cable terminal were removed and damaged during the demolition of a City-owned building. The building in question is the old Main Street Water Facility. The alleged damage is for $915.60. So far, our investigation is not clear as to what the damage was, what it was caused by and by who. However, it appears that whatever damage was done, was done by a contractor and who would be responsible for paying the claim. This claim is being tendered to SSC, the contractor on the Main Street job.
