IN RE: LETTER OF OPPOSITION TO APPLICATION FOR PERMIT
Subject Property: 336 Flyers Lane, Tustin, CA 92782
Dear Commission:
I am writing on behalf of 8 Flyers Lane, a townhome built within the Tustin Field 1 Com-
munity, to preliminarily notify the Commission of our opposition to the application of 336
Flyers Lane to permit an unauthorized structure (the "Structure") to remain in the Tustin
Field 1 Community. Based on this office's communication with City Code Enforcement, this
Structure is unpermitted but the owner is seeking permits. These permits should be denied
for the reasons set forth herein.
As depicted in the enclosed photographs, this Structure presents a remarkable blight to the
City of Tustin and Tustin Field 1 Community. In addition, this Structure is an unauthorized
addition that has been erected in contravention of the Tustin Field 1 Board of Director's
wishes. In fact, this office is informed that the Tustin Field 1 Board of Directors are in the
process of pursuing civil remedies, including legal action, to ensure the Structure is demol-
ished and removed.
As one might expect, the permit being sought is essentially useless: such a permit cannot
override or replace the authority of the Tustin Field 1 Board of Directors. In fact, the entire
process of seeking a permit for the Structure is a waste of this Commission's time. That being
said however, this Commission has a unique opportunity to nip this matter in the bud,
thereby preventing further deterioration of community aesthetics. This can be achieved by
denying permit of the Structure on an obvious basis: community blight.
The City of Tustin is renowned for its historic origins and beautiful urban aesthetics. One
can espy this beauty through several key landmarks in our community: the former Tustin
MCAS base, and old -town downtown. The developers and planners of Tustin Field 1 at-
tempted to embrace this unique setting by assimilating with Tustin's former MCAS base and

downtown style. Such as style was subject to many a review, including countless meetings,
review, and modifications. While this process may have been tedious, the City of Tustin has
undoubtedly benefited from this rigorous deliberation. Recognizing this benefit, the devel-
opers of Tustin Field 1 enacted certain Covenants, Conditions, and Restrictions that disavow
attempts to improve or modify aesthetics of the community absent due process. Notwith-
standing, the owner of the Structure has sought to conceal his unauthorized edition from
both the City of Tustin and Tustin Field 1 Board of Directors alike. These actions should not
be supported.
Accordingly, this office strongly opposes the Structure's preliminary application. For the
reasons mentioned herein, along with reasons proffered verbally during the Commission's
public comment period, the application to permit the existence of the Structure should be
denied with prejudice.
