FISCi~L IMPACTS There are no fiscal impacts to the City project as the parcel map was initiated by financial assistance is being requested. associated with this the applicant and no BACKGROUND On October 14, 1991, the Planning Commission adopted Resolution No. 2965 recommending to the City Council approval of Vesting Tentative Tract Map 14366 (Lots 5, 6 and J of Tract 13627). The city Council approved Vesting Tentative Tract Map 14366 (Lots.5, 6 and J of Tract 13627) on November 4, 1991, by adoPting Resolution No. 91- 148. This approval included numerous conditions to be met prior to approval of the Final Tract Map, with which the applicant has complied. As permitted by the Subdivision Map Act, the applicant is exercising the right to file multiple Final Tract Maps on the project. On August 24, 1992, the Planning Commission adopted Resolution No. 3075 recommending to the City Council approval of Final Tract Map 14576 (Lot 5 of Tract 13627). The City Council approved Final Tract Map 14576 (Lot 5 of Tract 13627) on November 4, 1991, by adopting Resolution No. 92-104. It is the applicant's intent to file the second of the two separate Final Maps on the original approved Vesting Tentative Tract Map 14366. On May 24, 1993, the Planning Commission adopted Resolution No. 3143, recommending approval of Final Tract Map 14366 to the city Council. The Final Tract Map is now ready for recordation with the Orange County Recorder's Office. Prior to recordation, the Final Tract Map must be reviewed and approved by the City Council. city Council Report Final Map 14366 June 7, 1993 Page 2 Final Tract Map 14366 includes 48 numbered lots and four (4) lettered lots, accommodating 48 single family dwelling units. Final Tract Map 14366 is bordered by Jamboree Road to the east, Pioneer Road and Lots 7 and 8 of Tract 13627 to the west, Final Tract Map 14576 (Lot 5 of Tract 13627) and Lot K of Tract 13627 to the north and Lot 19 of Tract 13627 to the south. CONCLUSION Staff has determined that the Final Tract Map is in conformance with the Vesting Tentative Map approval, requirements of the East Tustin Specific Plan, Development Agreement, the City's Subdivision Code, the East Tustin EIR and the State Subdivision Map Act. Based on this conformance, it is recommended that the City Council adopt Resolution No. 93-53 approving Final Tract Map 14366, subject to final approval of the City Engineer. Joann S. Attachment A Sht. 6 of 6 RESOLUTION NO. 93-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING FINAL TRACT MAP NO. 14366 The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: ae That Final Tract Map No. 14366 has been submitted by A-M/Greystone Homes Inc. That a public hearing was held bythe Planning Commission on October 14, 1991. At that hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 14366 (Lots 5, 6 and J of Tract 13627) to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 14366 (Lots 5, 6 and J of Tract 13627) on November 4, 1991. Tha~ following Vesting Tentative Tract Map ~pproval, the applicant filed Final Tract Map 14366 (Lot 6 and J of Tract 13627), which conforms with the approved Vesting Tentative Tract Map. The Planning Commission recommended approval of Final Tract Map 14366 to the City Council on May 24, 1993. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of residential units. The .9282 acres of parkland required for this development was previously dedicated with recordation of Tract 13627. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 14366 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. That the site is physically suitable for the type of development proposed. That the site is physically suitable for the proposed density of development. J. That the design of the subdivision or the proposed improvements are not likely to cause substantial Resolution No. 93-53 Page 2 environmental damage or substantially and avoidably injure fish or wildlife in their habitat. Ke That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. Me That the Final Tract Map is in substantial conformance with the Vesting Tentative Tract Map. N. That the project is considered Ministerially Exempt pursuant to Section 15268(B) of the California Environmental Quality Act. II. The city Council hereby approves Final Tract Map 14366 subject to final approval of the city Engineer.
