This project is categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. . .......... That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 15-006 approving Conditional Use Permit (CUP) 2015-06 to amend CUP 88-8 to revise the parking standards for the retail portion of Oak Tree Plaza to utilize the standards within the City of Tustin Parking Ordinance and also amend outdated conditions of approval related to the shopping center located at 17582-17612 17 th Street. The Zoning Administrator called the meeting to order. 3 I�ii 111 1 fMQ 14�1 The public hearing was opened at 9:01 a.m. Zoning Administrator Agenda July 14, 2015 Page 2 Ryan Swiontek, Senior Planner, shared an email received from John Clement, Venture Point Inc. to Mr. Swiontek, which generally included Mr. Clement's request to continue the item to a later date to allow time to review the impact on the subject property and if required, he will appeal if the item is approved. The following representatives were present: Leasing broker, on behalf of th ownership group for the center, Matthew Hammond, Coreland Companies; th applicant, Zaid Noman; and the architect, Niall Saunders. I The Zoning Administrator stated she had reviewed the staff report and the amended conditions of approval and had no concerns at this time. Her comments generally included: The Zoning Administrator asked the applicant and representatives if they had any concerns with the ZAA, which they did not; she stated that the adjacent property is "tied together" with the subject property (i.e. parking, ingress/egress); and that the adjacent property indicated they may appeal the item if action was taken at today's meeting. Mr. Saunders comments generally included that the project would benefit the adjacent property and that any appeal made by the adjacent property would not be related to the application. The Zoning Administrator asked the representatives and applicant if they would like to request a continuance or have an action today based on the information provided. The representatives did not request a continuance. Mr. Swiontek stated, in general, that the proposed resolution would not change the ,ievelopment standards, in terms of parking or permitted uses; for the adjacen� *ffice building (17592 17 th Street) located within Oak Tree Plaza and that the ZAA is specifically changing the standards and allowable uses for the retail portion of Oak Tree Plaza. Per the Zoning Administrator, the adjacent property would not be able to take advantage of the relaxed standards currently allowed within the Tustin City Code and that they would be advised of the 10 calendar day appeal period. If in the future they choose to amend the Conditions of Approval related to their property, an amendment would be necessary. Should there not be an appeal, the decision is rin;pfl. The Zoning Administrator approved ZAA No. 15-006 thereby approving CUP 2015-06M The date of the next meeting of the Zoning Administrator will be scheduled wher items are set for hearing.
