HUSTON, CITY MANAGER FROM: ADMINISTRATIVE SERVICES SUBJECT: ADA COMPLIANCE JOB ANALYSIS RECOMMENDATION: That the City Council approve contracting with Creative Management Solutions to perform job analyses required to update our job descriptions to comply with the requirements of Americans with Disabilities Act. BACKGROUND: The Americans With Disabilities Act (ADA) was passed in 1990 and became fully effective on July 26, 1992. To date, the City has not established physical standards for all classifications to be able to substantiate whether applicants or employees are qualified to perform the essential functions of a given job. Moreover, the City does not have consistent physical standards to determine whether an employee is able to return to duty following an industrial illness or injury. Given the size of this project, the small size of professional personnel staff, and the need to develop thorough and objective standards in a timely manner, the City needs to contract the services of an independent consulting firm that specializes in this area. Three proposals were received and reviewed ranging from $2400 to $18,135. Creative Management Solutions' proposal most closely fits our needs in that it is more thorough, provides more of a basis that we can expand upon to complete the physical standards for those positions not included in this proposal, and will ultimately be more defensible should the City be challenged in court. The proposal at the lowest cost did not allow sufficient time to this project to give staff confidence that City would receive a defensible product. Even for a claim that has no merit, the cost of defending can be substantial and bad law can be made if you lose because of insufficient documentation. Creative Management Solutions has also completed similar projects for the Cities of Fullerton, Garden Grove, Huntington Beach, Irvine, Newport Beach, Orange, San Clemente, Westminster, and Yorba Linda.
