HUSTON, EXECUTIVE DIRECTOR FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: DESIGN REVIEW 93-004 It is recommended that the Redevelopment Agency approve Design Review 93-004 by adopting Resolution No. RDA 93-02, as submitted or revised. FISCAL IMPACT This project was initiated by the applicant and involves a facade remodel to an existing commercial building. Therefore, there are no fiscal impacts to the City associated with this project. BACKGROUND/DISCUSSION The applicant requests authorization to remove an existing bay window and portions of a patio wall to add a new entrance, four awnings, decorative block wall, and wrought iron railing to an existing commercial building located at 13041 Newport Avenue. The remodel is being proposed to accommodate a new bakery/cafe tenant. In July of 1992, the Redevelopment Agency authorized a 680 square foot addition to accommodate a potential restaurant tenant at the same location. However, lease negotiations with this tenant have been discontinued, and plans for the addition were dropped. Based upon previous approvals for this property and existing parking conditions, the subject restaurant space would be permitted a maximum of 89 seats. The actual floor plan for tenant improvements will be reviewed by staff at building plan check to verify the seating count. Any outdoor seating serving the subject tenant space is presently prohibited and would require approval of a Conditional Use Permit by the Planning Commission prior to its authorization. Redevelopment Agency Design Review,93-004 March 15, 1993 Page 2 The tenant space is part of the LaFayette Plaza shopping center located at the northwest corner of the intersection of Newport Avenue and Irvine Boulevard. The site is bounded by commercial development to the north, south, east and west. The subject tenant space is _immediately adjacent to "Nieuport 17" restaurant. The center is located within the Town Center Redevelopment Project Area requiring final design review approval of the proposed site improvements by the Redevelopment Agency. The subject site is located within the C-2 - Central Commercial District zoning designation. The project has been designed in accordance with the listed development standards for the district. The design review plans specify "new building construction to match existing building construction" and "awnings to match existing center awnings scheme and color." The submitted elevations for plan check will be required to indicate that the window types, door type, awnings, architectural elements and finish materials are proposed to be consistent with and will complement the existing architectural character of the center. CONCLUSION___ Based upon the above analysis and the submitted plans, it is recommended That the Redevelopment Agency adopt Resolution No. RDA 93-02 approving Design Review 93-004, subject to the conditions contained in Exhibit A attached thereto. RDA 93-02 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESIGN REVIEW 93-004 AUTHORIZING AN EXTERIOR REMODEL TO AN EXISTING COMMERCIAL BUILDING ON THE PROPERTY LOCATED AT 13041 NEWPORT AVENUE The Redevelopment Agency of the City of Tustin does hereby resolve as follows: I. The Redevelopment Agency finds and determines as follows: A. Pursuant to the adopted Town Center Redevelopment Plan, the Redevelopment Agency shall approve all site plans and architectural designs of any project proposed within the project area. B. That a proper application, Design Review 93-004, has been filed requesting authorization to remodel the exterior of an existing commercial building on the property located at 13041 Newport Avenue. C. Pursuant to Section 9272 of the Tustin Municipal Code, the Redevelopment Agency finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. Zn making such findings, the Redevelopment Agency has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. 5. Towers, roof structures, doors and windows. 6. Landscaping, parking area design and traffic circulation. 7. Location, height and standards of exterior illumination. 8. Relationship of proposed structures to existing adjacent uses. 9. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood. 10. Development guidelines and criteria as adopted by the City Council. D. The Redevelopment Agency hereby approves Design Review No. 93-004 authorizing the exterior remodel of an existing commercial building on the property located at 13041 Newport Avenue, subject to all conditions contained in Exhibit A attached hereto. RDA 93-02 MARCH 15t 1993 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped March 15, 1993, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project subject to review and approval by the Community Development Department. (1) 1.3 Design Review approval shall become null and void unless building permits are issued within eighteen (18) months of the date of this Exhibit. (1) 1.4 Any public improvements damaged by the applicant adjacent to this property shall be repaired and/or replaced as determined by the Engineering Division and shall include, but not be limited to, curb and gutter, street paving and drive apron. (1) 1.5 All construction shall be in accordance with the UBC and applicable City Codes. (1) 1.6 Approval of Design Review 93-004 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form, as established by the Director of Community Development. (1) 1.7 The applicant and property owner shall hold harmless and defend the City of Tustin for all claims and liabilities arising out of the City's approval of the entitlement process for this project. (1) 1.8 Upon approval of Design Review 93-004, Design Review 92- 036 shall become null and void. Requirements of the Uniform Building. Code shall be complied with as approved by the Building Official. No field changes shall be made without corrections submitted to and approved by the Community Development Department. (4) 2.2 Construction plans shall indicate that the window types, door type, awnings, architectural elements and finish materials are to be consistent with and will complement the existing architectural character of the center. USE RESTRICTIONS (5) 3.1 The restaurant seating shall at no time exceed 89 seats, unless additional parking becomes available and said change is submitted to the Community Development Department for review. This design review approval shall not authorize any additional seats to the center -wide total and shall conform to the requirements as approved for Variance 88-05. A seating plan shall be submitted at building plan check for review and approval by the Community Development Department. (5) 3.2 No outdoor seating shall be permitted unless specifically approved by a Conditional Use Permit by the Planning Commission. SITE CONDITIONS (4) 4.1 Awnings shall match in style and color the existing awnings on the subject building which presently face the intersection of Irvine Boulevard and Newport Avenue, subject to final approval of the Director of Community Development. FEES (1) 5.1 Prior to the issuance of any permits, the payment of the following fees are required: a.
