CALL TO ORDER / PLEDGE OF ALLEGIANCE / INVOCATION ROLL CALL PROCLAMATIONS- Graffiti Poster Contest Winners, Tiller Days Committees, and Smith's Balloon Festival. PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO ACTION can be taken on off-agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the blue forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. PUBLIC HEARING ( ITEM I ) 1. NON-DISPOSAL FACILITY ELEMENT In 1992, the State Legislature enacted Assembly Bill 3001 which required cities and counties to prepare and adopt a Non-Disposal Facility Element (NDFE) by December 31, 1994. The intent of the NDFE is to identify all new or any necessary expansions of existing non-disposal facilities which will be needed in the County through year 2000 with capacity levels adequate for the continual and successful implementation of the Source Reduction and Recycling Element. Recommendation: Hold a Public Hearing and following receipt of testimony from interested individuals, adopt the following Resolution No. 94-123 approving the City's Non-Disposal Facility Element as recommended by the Public Works Department: RESOLUTION NO. 94-123 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING A NON-DISPOSAL FACILITY ELEMENT PURSUANT TO THE REQUIREMENTS OF THE PUBLIC RESOURCES CODE CONSENT CALENDAR ( ITEMS 2 THROUGH 15 ) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. Council Agenda 1 November 7, 1994 o APPROVAL OF MINUTES - OCTOBER 17, 1994 REGUI~AR' MEETING Re~)mmendation: Approve the City Council Minutes of October 17, 1994. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $2,419,365.11 and ratify Payroll in the amount of $317,774.37. RESOLUTION NO. 94-121 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR EL MODENA- IRVINE CHANNEL FACILITY NO. F07 FROM 110' SOUTHERLY OF MICHELLE DRIVE TO INTERSTATE 5 Recommendation: Adopt Resolution No. 94-121 accepting said work and authorizing recordation of the Notice of Completion as recommended by the Public Works Department/Engineering Division. EXECUTION OF A QUITCLAIM DEED RELEASING A TEMPORARY CONSTRUCTION EASEMENT FOR THE FIRST PHASE OF THE REGIONAL RIDING AND HIKING TRAIL AND REGIONAL BICYCLE TRAIL Recommendation: Authorize the Mayor and City Clerk to execute subject Quitclaim Deed as recommended by the Public Works Department/Engineering Division. AUTHORIZATION TO EXECUTE AGREEMENT FOR RELOCATION SERVICES FOR 1921 AND 1951 EL CAMINO REAL DUE TO THE PROPOSED WIDENING OF EL CAMINO REAL Recommendation: (1) Authorize a supplemental bud get appropriation to the 1994-95 Capital Improvement Program Budget (Project No. 700116) in the amount of $25,000.00 from the unappropriated reserve of the Measure "M" Turnback funds for relocation services and (2) Authorize staff to execute an agreement with Pacific Relocation Consultants for relocation services subject to final approval of the City Attorney as recommended by the Public Works Department. REIMBURSEMENT AGREEMENT FOR THE BARRANCA PARKWAY REHABILITATION PROJECT (RED HILL AVENUE TO PETERS CANYON WASH) Recommendation: Approve subject agreement with the City of Irvine and authorize the Mayor and City Clerk to execute the document on behalf of the City of Tustin as recommended by the Public Works Department/Engineering Division. RESOLUTION NO. 94-122 - A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE ENVIRONMENTAL ENHANCEMENT AND MITIGATION PROGRAM UNDER SECTION 164.56 OF THE STREETS AND HIGHWAYS CODE 1989 FOR THE LANDSCAPING OF NISSON ROAD AND EL CAMINO REAL BETWEEN RED HILL AVENUE AND NEWPORT AVENUE Recommendation: Adopt Resolution No. 94-122 authorizing Director of Public Works/City Engineer, Tim D. Serlet, to submit an application for State Resources Agency Environmental Enhancement and Mitigation Program Grant as recommended by the Public Works Department. RESOLUTION NO. ~ 24 - A RESOLUTION OF THE ( COUNCIL OF THE CITY OF TUSTIN, CALIFC~.,dlA, APPROVING LOT LINE ADJL~,STMENT NO. 94-6 Recommendation: Adopt Resolution No. 94-124 approving Lot Line Adjustment No. 94-6 as recommended by the Public Works Department/Engineering Division. PLANNING COMMISSION ACTION AGENDA - OCTOBER 24, 1994 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommend~ti0n: Ratify the Planning Commission Action Agenda of October 24, 1994. RESOLUTION NO. 94-120 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESTRUCTION OF CERTAIN COMMUNITY DEVELOPMENT DEPARTMENT RECORDS Recommendation: Adopt Resolution No. 94-120 authorizing the destruction of certain Community Development Department records pursuant to California Government Code Sections 34090 and 34090.5 as recommended by the Community Development Department. REJECTION OF CLAIM NO. 94-35 - CLAIMANT, DAVID AND KATHLEEN RIZZOTTO; DATE OF LOSS, 2/28/94; DATE FILED WITH CITY, 8/29/94 Recommendation: Reject subject claim for property and general damages in the amount of $100,630.00 as recommended by the City Attorney. APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO ADVERTISE FOR BIDS FOR REMEDIAL GRADING FOR JAMBOREE ROAD DISPOSAL SITE NO. 2 Recommendation: Approve the plans and specifications for the Remedial Grading for the Jamboree Road Disposal Site No. 2 and authorize the advertisement of bids for subject project as recommended by the Public Works Department/Engineering Division. RESOLUTION NO. 94-125 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING THE LOCATION OF CERTAIN ALL-WAY STOP CONTROL INTERSECTIONS Recommendation: Adopt Resolution No. 94-125 authorizing the installation of all- way stop sign controls at the intersection of San Juan Street and Tustin East Drive per Figure 1 of subject Traffic Study as recommended by the Public Works Department/Engineering Division. AIRPORT STATUS REPORT ~ Recommendation: Receive and file subject Community Development Department. report as recommended by the REGULAR BUSINESS 16. Council Agenda (ITEMS 16 THROUGH 22) ORDINANCE NO. 1136, SOLICITATION IN THE PUBLIC RIGHT-OF-WAY Ordinance No. 1136 had first reading by title only and introduction at the October 17, 1994 City Council meeting. 3 November 7, 1994 Recommendation: i ; second reading by title only a. .,'doption of the following Ordinance No. 1136 (roll call vote): ORDINANCE NO. 1136 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO SOLICITATION IN THE PUBLIC RIGHT-OF-WAY AND PRIVATE COMMERCIAL PARKING AREAS 17. STATUS REPORT - ASSESSMENT DISTRICT REFUNDINGS 18. Report addresses selection of Bond Counsel and Underwriter for Assessment District Refundings. Recommendation: Confirm the selection of Jones, Hall, Hill and White as Bond Counsel and the selection of Paine Webber Incorporated as Underwriter; and direct staff to proceed with the formation of a Financing Authority consisting of the City and the Redevelopment Agency as recommended by the City's Financial Advisor and Underwriter. PROPOSED TRANSFER AND CHANGE OF CONTROL OF A CABLE TELEVISION SYSTEM FRANCHISE FROM DIMENSION/TIMES-MIRROR COMPANY TO COX CABLE COMMUNICATIONS, INCORPORATED Pursuant to Tustin City Code Section 7418 and the Federal Communications Commission Regulations, the cable operator must obtain City approval of a franchise transfer or change of control of the system. Recommendation: Adopt the following Resolution No. 94-127 approving the transfer and change of control of a cable television system franchise from the Times-Mirror Company (dba Dimension Cable Services) to Cox Cable Communications, Inc. as recommended by the Public Works Department: RESOLUTION NO. 94-127 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE TRANSFER AND CHANGE OF CONTROL OF A CABLE TELEVISION SYSTEM FRANCHISE FROM THE TIMES-MIRROR COMPANY TO COX CABLE COMMUNICATIONS, INC. 19. LEGAL SERVICES STUDY The City Council directed staff to prepare a report which compares the City's legal fees=.With other similar cities. Recommendation: Pleasure of the City Council. 20. YOUTH RECREATIONAL FACILITIES Mayor Pro Tern Ports requested that the City Council have a discussion regarding what options are available to provide additional recreational services for youth living in the southwest area of Tustin. Recommendation: Pleasure of the City Council. Council Agenda 4 November 7, 1994 21. REQUEST TO WA ,TRANSPORTATION SYSTEM ;~ROVEMENT PROGRAM (TSIP) FEES FOR T~_..,ATIVE TRACT 14914 (NEWPOR~ CAMINO PLAZA) Tentative Tract Map 14914 authorized an approximate 18,000 square foot retail center located at the northeast corner of Newport Avenue and El Camino Real. The required TSlP fee for the entire development required to be paid prior to issuance of a building permit totals approximately $101,635.00. The applicant is now requesting that the TSIP fee be waived. Recommendation: Deny the request to waive Transportation System Improvement Program fees for subject development as recommended by the Community Development Department. 22. ORDINANCE PLACING LIMITATIONS ON CAMPAIGN CONTRIBUTIONS Mayor Pro Tem Potts has requested that an ordinance placing limits on campaign contributions in municipal elections be considered by the City Council. Recommendation: Pleasure of the City Council.
