HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION ACCEPTANCE OF PUBLIC IMPROVEMENTS ANDAUTHORIZATION TO RECORD NOTICE OF COMPLETION FOR EL MODENA-IRVINE CHANNEL FACILITY NO. F0? FROM 110' SOUTHERLY OF MICHELLE DRIVE TO INTERSTATE ~PROJECT NO. 900031) RECOMMENDATIO_____~N It iS recommended that the City Council, at their meeting of November 7, 1994, adopt the attached resolution accepting said work and authorizing the recordation of the Notice of Completion. Assuming no stop notices are filed, it is further recommended that 35 days after the date of the recordation of the Notice of Completion, the City Council authorize payment of the final 10% retention amount of $98,165.52. FISCAL IMPACT The original contract price for the final construction cost was amount was $1,300,000.00. this construction was $811,344.00 and $1,200,112.97. The original budgeted BACKGROUND The additional construction costs were related to items that could not be anticipated and the following is a brief summary of these items: a) Increase in bid item quantities. b) Construction of cut-off walls as required by Orange County EMA. c) Relocate stream gaging station as required by Orange County EMA. d) Removal and bulkheading of unknown underground pipelines; demolition and removal of existing cut-off walls; salvage water testing facility. e) Cold plane and resurface Michelle Drive adjacent to the bridge as required by the City of Irvine. f) Additional work required for the protection of the Michelle Drive bridge foundation. The construction has been completed and accepted by the County of Orange, the City of Irvine, Caltrans and the City of Tustin Engineering Division. Staff and the contractor are still reviewing and processing a construction claim for said project which will be returned to the City Council for final action. In the interim, the intent of this action is to accept the works of improvement and authorize the recordation of the Notice of Completion for said work with the adoption of Resolution No. 94-121. This will allow the 35 day lien period to commence so that the retention monies and construction bonds for the project can be released. This project provided for the construction of 640 feet of reinforced concrete rectangular channel, two reinforced concrete transition structures, pipe inlets, a maintenance road and other appurtenances and will provide 100 year storm protection to the area northerly of the I-5 Freeway. F07 FROM ll0' SOUTHERLY OF MICHELLE DRIVE TO INTERSTATE 5 WHEREAS, Heritage Engineering Construction, Inc. having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and W~EREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due to said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: E1 Modena-Irvine Channel Facility No. F-07 from 110' southerly of Michelle Drive to Interstate 5 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 7th day of November, 1994.
