HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT ENVIRONMENTAL E1TH~NCEMENT AND MITIGATION PROGRAM GI~I~qT RECOMMENDATION It is recommended that the City Council adopt Resolution No. 94-122 authorizing Director of Public Works/City Engineer, Tim D. Serlet, to submit an application for State Resources Agency Environmental Enhancement and Mitigation Program Grant. FISCAL IMPACT None at this time. The proposed grant amount is for $64,000.00. BACKGROUND AND DISCUSSION The Environmental Enhancement and Mitigation Program was established by the enactment of the Transportation Blueprint Legislation of 1989. ~n~nually, $10,000,000 is allocated to the program and grants for up to $500,000 are awarded to local, State and Federal agencies and non-profit entities by the California Transportation Commission to fund various proposals evaluated and recommended by the Resources Agency. The grant program's purpose is to fund programs designed to mitigate the environmental impacts of modified or new public transportation facilities. The categories eligible for funding are specific and the Public Works Department is recommending the submittal of a grant proposal in the amount of $64,000.00 to install trees in the treewells on the north side of Nisson Road and on the north and south sides of E1 Camino Real between Red Hill Avenue and Newport Avenue adjacent to the I-5 Freeway. The project would also include the installation of groundcover and an irrigation system adjacent to the soundwalls on both E1 Camino Real and Nisson Road at the same locations. The total project cost breaks down as follows: Design/Specifications Construction Contingencies (10%) Inspection $ 7,500.00 $50,000.00 $ 5,000.00 $ 1,500.00 TOTAL $64f000.00 As part of the application package to be submitted, a Resolution of the City Council must be approved identifying the City representative who is authorized to submit grant documents and applications and enter into an agreement with the State to implement the program once the grant is/ approved.,, Tim D. S~rlet Katie Pitcher Director of Public Works/ Administrative Assistant II City Engineer 1 2 4 5 6 7 8 9 10 11 12 14 15 16 17 18 19 20 21 24 26 27 iRESOLUTION~NO. 94-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE ENVIRONMENTAL EITHANCEMENT AND MITIGATION PROGRAM UNDER SECTION 164.56 OF THE STREETS ANDHIGHWAYS CODE 1989 FOR THE LANDSCAPING OF NISSON ROAD AND EL CAMINO REAL BETWEEN RED HILL AVENUE AND NEWPORT AVENUE ~HEREAS, the Legislature of the State of California has enacted AB471, (Chapter 106 of the Statutes of 1989), which is intended to provide $10 million annually for a period of 10 years for grant funds to local, State and Federal agencies and non-profit entities for projects to enhance and mitigate the e ' nvlronmental impacts of modified or new public transportation facilities; and W~REAS, the Resources Agency has established the procedures and criteria for reviewing grant proposals and is required to submit to the California Transportation Commission a list of recommended projects from which the grant recipients will be selected; and WHEREAS, said procedures and criteria established by the Resources Agency require a resolution certifying the approval of application by the applicant's governing body before submission of said application to the State; and WaEREAS, the application contains assurances that the applicant must comply with; and WaEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the environmental enhancement and mitigation project; NOWt THEREFORE, BE IT RESOLVED by the City Council: SECTION 1. Approves the filing of an application for the E~vironmental Enhancement and Mitigation Program for grant assistance. SECTION 2. Certifies that said applicant will make adequate provisions for operation and maintenance of the project. ~ Appoints Tim D.
