JOINT MEETING- At 5:30 p.m., the City Council will hold a joint meeting with the Parks
and Recreation Commission. This meeting is open to the public.

PUBLIC INPUT - At this time members of the public may address the City Council
regarding any items not on the agenda and within the subject matter jurisdiction of the City
Council (NO ACTION can be taken on off-agenda items unless authorized by law). If you
wish to address the City Council on any matter, please fill out one of the blue forms located

PUBLIC HEARING ( ITEM I )
APPEAL OF LICENSE AND PERMIT BOARD DECISION DENYING NIGHT AND DAY
A PRIVATE PATROL OPERATOR PERMIT
The City has received an appeal of a License and Permit Board decision denying a
private patrol operator permit to Night and Day Security Patrol, a business owned
and operated by Mr. Raymond Flores.
Recommendation: Uphold the August 3, 1994 City of Tustin License and Permit
Board decision denying a private patrol operator permit for Night and Day Security
Patrol as recommended by the City Attorney and Community Development
Department.

All matters listed under Consent Calendar are considered routine and will be enacted by one
motion. There will be no separate discussion of these items prior to the time of the voting
on the motion unless members of the Council, staff or public request specific items be

Recommend~l;ion: Approve Demands in the amount of $3,113,837.51 and ratify
Payroll in the amount of $309,964.70.
REJECTION OF CLAIM NO. 94-35 - CLAIMANTS, DAVID AND KATHLEEN
RIZZOTTO; DATE OF LOSS, 2/28/94; DATE FILED WITH CITY, 9/6/94
Recommendation: Reject subject claim for property and general damages in the
amount of $100,630.00 as recommended by the City Attorney.

RESOLUTION NO. 94-115 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF THE NOTICE OF COMPLETION FOR
MODIFICATION OF TRAFFIC SIGNALS AT RED HILL AND IRVINE BOULEVARD
Recommendal;ion: Adopt Resolution No. 94-115 accepting said work and authorizing
the recordation of the Notice of Completion as recommended by the Public Works
Department/Engineering Division.
EXECUTION OF QUITCLAIM DEED OF A PORTION OF A NON-EXCLUSIVE
EASEMENT FOR INGRESS, EGRESS AND PUBLIC UTILITY PURPOSES WITHIN
TRACT NO. 14782
Recommendal;ion: Authorize the Mayor to execute subject quitclaim deed as
recommended by the Public Works Department/Engineering Division.
INVESTMENT REPORT AS OF JULY 31, 1994
Recommendation: Receive and file subject report as recommended by the Finance
Department.

STATUS UPDATE: TRAFFIC CONCERNS AT THE INTERSECTION OF BRYAN
AVENUE AND EPPING WAY
Recommendation: Receive and file subject report as recommended by the Public
Works Department/Engineering Division.
SB 1082 UNIFIED HAZARDOUS MATERIALS PROGRAM
Recommendation: Participate in a County of Orange administered Certified Unified
Program Agency with the Orange County Fire Department designated as the
administrator, subject to there not being any need for local funding participation as
recommended by the Community Development Department.

COMBINED TRANSPORTATION FUNDING PROGRAMS
Recommendation: Receive and file subject report as recommended by the Public
Works Department/Engineering Division.

PLANNING COMMISSION ACTION AGENDA - SEPTEMBER 26, 1994
All actions of the Planning Commission become final unless appealed by the City
Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of September 26,
1994.

Recommendation: ~inue this item to the November. 394 City Council meeting
as recommended by the City Manager.
AUTHORIZATION TO PURCHASE TWO REGENERATIVE AIR/VACUUM SWEEPERS
Recommendation: Authorize staff to purchase two (2) Elgin/Regenerative Air/
Vacuum street sweepers in the amount of $104,=113.00 per unit for a total cost of
$224,363.52 as recommended by the Public Works Department/Field Services
Division.
AGREEMENTS WITH MOTOROLA
Recommendation: Authorize City Manager to execute subject agreements as
recommended by the City Attorney.
AWARD OF CONTRACT FOR RAWLINGS RESERVOIR RETAINING WALL REPAIR
Recommendation: Award the contract for the subject project to Calex Engineering
Company of Newhall in the amount of $390,150.38 as recommended by the Public
Works Department/Engineering Division.
REGULAR BUSINESS (ITEMS 16 THROUGH 18 )
16. COMMUNITY SERVICES ADULT SOFTBALL PROGRAM
Parks and Recreation Commissioner Royal has ~equested that staff investigate the
possibility of contracting the adult softball program and, following discussion at their
September 15, 1994 meeting, the Commission recommended the matter be
discussed by the City Council.
Recommendation: Pleasure of the City Council.
17. ORDINANCE NO. 1139, CHANGING THE DATE OF THE CITY'S GENERAL
MUNICIPAL ELECTION
Proposed Ordinance No. 1139 would change the date of the City's General Municipal
Election to the March statewide primary in 1996; and that provision would be
automatically repealed in 1997 if the State fails to authorize a March statewide direct
primary in 1998.
Recommendation: Have first reading by title only and introduction of the following
Ordinance No. 1139:
ORDINANCE NO. 1139 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, REPEALING ORDINANCE NOS. 1032 AND 1048 AND
REQUIRING THAT BEGINNING IN 1996, THE GENERAL MUNICIPAL ELECTION BE
HELD IN MARCH, ON THE SAME DAY AS THE STATEWIDE DIRECT PRIMARY
ELECTION, AND PROVIDING THAT IF THE STATE LEGISLATURE FAILS TO PROVIDE
AUTHORIZATION FOR A STATEWIDE DIRECT PRIMARY IN MARCH OF 1998, THE
CITY'S GENERAL MUNICIPAL ELECTION, BEGINNING IN 1998, SHALL BE HELD ON
THE SECOND TUESDAY IN APRIL OF EVEN-NUMBERED YEARS

Ordinance No. 1136 had first reading by title only and introduction at the September
19, 1994 City Council meeting.
Recommendation: Have second reading by title only and adoption of the following
Ordin'ance No. 1136 (roll call'vote):
ORDINANCE NO. 1136 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, RELATING TO SOLICITATION IN THE PUBLIC RIGHT-OF-WAY
AND PRIVATE COMMERCIAL PARKING AREAS
