HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION RESOLUTION APPROVING ANAPPLICATION FOR STATE GRANT FUNDS AND AGREEMENT WITH ORICOM FOR DEVELOPMENT AND MANAGEMENT OF A HOUSEHOLD HAZARDOUS WASTE PROGRAM RECOMMENDATION 1. Adopt a resolution approving an application funds to design and implement a Household Program. for State grant Hazardous Waste 2. Authorize the Mayor and City Clerk to execute an agreement with ORICOM to develop and manage a household hazardous waste program at a cost not-to-exceed $120,000.00. FISCAL IMPAC~T There is no fiscal impact for the preparation of the grant application. Should the application be approved, ORICOM will be paid with grant funds to administer the program for the City. BACKGROUND AND DISCUSSION California Assembly Bill 1220 (AB1220) authorized the California Integrated Waste Management Board to expend funds from the Integrated Waste Management Account for the making of grants to cities for local programs to help prevent the illegal disposal of hazardous waste. The grant monies will allow the City to expand current public education efforts for the disposal of household hazardous waste and target specific populations within the community, resulting in decreased illegal disposal and dumping of hazardous waste and thereby helping the City to comply with AB939, as well as with the requirements of the National Pollutant Discharge Elimination System permit. Staff is recommending the services of ORICOM, a consulting firm located in Anaheim and Los Angeles, to develop and submit a grant application on behalf of the City. ORICOM has previously submitted two used oil recycling grant applications to the state which were successful. Development and submittal of this grant will be at no cost to the City. If the application is successful, ORICOM will be responsible for development and management of the City's Household Hazardous Waste Program. All program costs will be paid from grant funds. To proceed with the development of the grant application, the City Council needs to approve Resolution No. 94-113, authorizing the submittal of an application for State grant monies and an agreement with ORICOM for program development and ~anagement is required. Ledendecker Acting Director of Public Works/ City Engineer Ka~i~ Pitcher Administrative Assistant II 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 94-113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, AUTHORIZING HOUSEHOLD HAZARDOUS WASTE DISCRETIONARY GRANT APPLICATION AND APPROVAL OF AGREEMENT WITH ORICOM WHEREAS, the people of the State of California have enacted Assembly Bill 1220 {AB1220) that provides grants to local governments to establish and implement waste diversion and separation programs to prevent disposal of hazardous waste, including household hazardous waste, in solid waste landfills; and WHEREAS, the California Integrated Waste Management Board has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures governing application by cities and counties under the program; and WHEREAS, said procedures established by the California Integrated Waste Management Board require the applicant to certify by resolution the approval of application before submission of said application to the State; and WHEREAS, the applicant will enter into an agreement with the State of California for development of the project; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin does hereby resolve, declare, determine and order as follows: SECTION 1. Authorizes the submittal of an application to the California Integrated Waste Management Board for a Household Hazardous Waste Discretionary Grant. The Director of Public Works of the City of Tustin is hereby authorized and empowered to execute agreements and amendments hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application.
