PUBLIC HEARING ( ITEMS I THROUGH 3 ) CITY BUDGET AND WATER ENTERPRISE BUDGET ADOPTION FOR THE FISCAL YEAR 1994-95 The draft 1994-95 City budget was presented to the City Council in July and they have conducted three budget workshops to review the budget and all capital improvements. Recommendation: Adopt the following Resolution No. 94-106 appropriating the City's Governmental Funds of $26,822,935.00; Special Revenue Funds, $4,376,204.00; Capital Projects Fund, $11,580,223.00; and the City's Water Enterprise Budget of $14,978,618.00 as recommended by the Finance Department: RESOLUTION NO. 94-106 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUST~N, CALIFORNIA, ADOPTING THE CITY BUDGET AND APPROPRIATING FROM THE ANTICIPATED REVENUES OF THE CITY FOR THE FISCAL YEAR 1994-95 2. APPROPRIATIONS LIMIT FOR FISCAL YEAR 1994-95 Article XtlIB of the State Constitution requires cities to annually adopt a limit on appropriations for governmental funds, Council Agenda 1 September 6, 1994 Recommendation: appropriations limi' Department: ~dopt the following Resolut; ' .' fiscal year 1994-95 as ~ No. 94-107 setting the ,~mended by the Finance RESOLUTION NO. 94-107 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING AND ADOPTING AN APPROPRIATIONS LIMIT FOR THE FISCAL YEAR 1994-1995 IN ACCORDANCE WITH ARTICLE XlIIB OF THE CONSTITUTION OF THE STATE OF CALIFORNIA AND SECTION 7910 OF THE GOVERNMENT CODE AMENDMENT TO VESTING TENTATIVE TRACT MAP 14669 (CALIFORNIA PACIFIC HOMES) The applicant is requesting to modify the original condition 2.2 of Planning Commission Resolution No. 3078 to eliminate the paseo at Lewis Drive. Recommendation: Approve Amendment to Vesting Tentative Tract Map 14669 modifying a condition to relocate a pedestrian paseo by adopting the following Resolution No. 94-110 as submitted or revised as recommended by the Community Development Department: RESOLUTION NO. 94-110 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AMENDMENT TO VESTING TENTATIVE TRACT MAP 14669 TO MODIFY CONDITION NO. 2.2 OF PLANNING COMMISSION RESOLUTION NO. 3078 RELATED TO THE LOCATION OF THE PASEO CONSENT CALENDAR ( ITEMS 4 THROUGH 17 ) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. o APPROVAL OF MINUTES - AUGUST 15, 1994 REGULAR MEETING Recommendation: Approve the City Council Minutes of August 15, 1994. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,752,249.16 and ratify Payroll in the amount of $622,601.52. 1994-95 FUNDING REQUEST AND AGREEMENT FOR SENIOR TRANSPORTATION SERVICES, ORANGE COUNTY TRANSPORTATION AUTHORITY Recommendation: Authorize staff to execute subject agreement with the Orange County Transportation Authority. for senior citizen transportation services as recommended by the Community Services Department. PLANNING COMMISSION ACTION AGENDA - AUGUST 22, 1994 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of August 22, 1994. Council Agenda 2 September 6, 1994 MICRO CENTER Mc;POSITION AND DEVELOPME~-~ AGREEMENT Recommendatio 1 ) Approve the Environment,, ,~termination for the project by adopting the following Resolution No. 94-109 aha {2) Approve the Disposition and Development Agreement by and among Micro Electronics, Inc. (Micro Center), Catellus Development Corporation, the City and the Redevelopment Agency to provide Micro Electronics, Inc. with financial assistance for the improvement of the property at 11 O0 Edinger Avenue as recommended by the Community Development Department: RESOLUTION NO. 94-109 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE PACIFIC CENTER EAST SPECIFIC PLAN (FINAL EIR 90-1) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR THE APPROVAL OF THE DISPOSITION AND DEVELOPMENT AGREEMENT BY AND AMONG THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY, THE CITY OF TUSTIN, CATELLUS DEVELOPMENT CORPORATION AND MICRO ELECTRONICS, INC., AND THAT ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT ENCROACHMENT AGREEMENT - 100 WEST MAIN STREET Recommendation: Approve the Encroachment Agreement pertaining to the property at 1 O0 West Main Street and authorize the Mayor to execute said agreement subject to final approval of the City Attorney as recommended by the Public Works Department/Engineering Division. 10. RESOLUTION NO. 94-112 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OFTUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR ANNUAL SIDEWALK AND CURB AND GUTTER REPAIR PROJECT, 1994-95 FY Recommendation: Adopt Resolution No. 94-112 approving plans and specifications for subject project and directing the City Clerk to advertise for bids as recommended by the Public Works Department/Engineering Division. 11. AMENDMENT TO AGREEMENT FOR IMPROVEMENT OF JAMBOREE ROAD BETWEEN IRVINE BOULEVARD AND EXISTING CHAPMAN AVENUE Recommendation: Approve the second amendment to the July 7, 1988 Agreement for Improvement of Jamboree Road between Irvine Boulevard and existing Chapman Avenue and authorize the Mayor to execute said amendment subject to final approval of the City Attorney's office as recommended by the Public Works Department/Engineering Division. 12. RESOLUTION NO. 94-105 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING SUPPORT FOR PROPOSITION 187 Recommendation: Adopt Resolution No. 94-105 declaring support for Proposition 187 regarding the enforcement of immigration laws. 13. MEMORANDUM OF UNDERSTANDING WITH TRANSPORTATION CORRIDOR AGENCIES AND CITY OF IRVlNE FOR JAMBOREE ROAD IMPROVEMENTS ASSOCIATED WITH THE EASTERN TRANSPORTATION CORRIDOR (WEST LEG TRANSITION AREA) Recommendation: Approve a Memorandum of Understanding with the Transportation Corridor Agencies and the City of Irvine regarding Jamboree Road Council Agenda 3 September 6, 1994 14. 15. 16. Improvements soutl the terminus of the West Let the Eastern Transportation Corridor, and authorizu the Mayor and City Clerk to execute the document on behalf of the City as recommended by the Public Works Department/Engineering Division. AGREEMENT REGARDING RIDES AND CONCESSIONS AT TUSTIN TILLER DAYS Recommendation: Approve subject agreement with Hassett & Davis to operate a carnival at Tustin Tiller'Days, October 7-9, 1994, as recommended by the Community Services Department. PETERS CANYON REGIONAL RIDING AND HIKING TRAIL Recommendation: Receive and file subject report as Community Development Department. recommended by the AWARD OF CONTRACT FOR GRAFFITI REMOVAL Recommendation: Award the annual contract for the removal of graffiti from private property to Graffiti Control Systems as recommended by the Community Development Department. 17. (Item No. 17 was removed from the agenda). REGULAR BUSINESS ( ITEMS 18 THROUGH 25 ) 18. Council Agenda ORDINANCE NO. 1140, SLEEPING IN PARKED VEHICLES Ordinance No. 1140 had first reading by title only and introduction at the August 15, 1994 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1140 (roll call vote): ORDINANCE NO. 1140 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PROHIBITING SLEEPING IN PARKED VEHICLES 19. REQUEST APPLICATIONS FOR TUSTIN COMMUNITY FOUNDATION BOARD OF DIRECTORS On October 12, 1994, terms for two members of the Foundation Board of Directors will expire. Recommendation: Pleasure of the City Council. 20. REQUEST FOR TREE REMOVAL AT 14631 KIMBERLY CIRCLE The property owner at 14631 Kimberly Circle has requested that the Tristania Street Tree in front of his residence be removed. Recommendation: Pleasure of the City Council. 21. REQUEST FOR TREE REMOVAL AT 2221 SILK TREE DRIVE The property owner at 2221 Silk Tree Drive has requested that the Carrotwood 4 September 6, 1994 Street Tree in fro ~f his residence be removed. Recommendation: Pleasure of the City Council. 22. YORBA STREET FICUS TREE REMOVALS The property owner at 14381 Rosewood has spoken in opposition to .the removal of ficus trees on Yorba Street and in particular the two trees located adjacent to the backyard of his residence. Recommendation: Approve Alternate I which would authorize the removal of five (5) ficus trees at the current time with the remaining five (5) trees being removed after a period of eighteen months; the replacement trees would remain as the 24" box Podocarpus (Fern Pine) tree as recommended by the Public Works Department/ Engineering Division. 23. ORDINANCE NO. 1138, ZONE CHANGE 94-003 (14882-14942 NEWPORT AVENUE) Ordinance No. 1138 had first reading by title only and introduction at the August 15, 1994 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1138 (roll call vote): ORDINANCE NO. 1138 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 94-003 TO CHANGE THE ZONING FROM R-3 (MULTIPLE-FAMILY RESIDENTIAL) TO PC (PLANNED COMMUNITY-RESIDENTIAL) INCLUDING RELATED PLANNED COMMUNITY DISTRICT REGULATIONS ON THE PROPERTY LOCATED AT 14882-14942 NEWPORT AVENUE AND DESCRIBED AS ASSESSOR'S PARCEL NO. 432-011-21 24. LEGAL EXPENSES 25. Councilmember Doyle has requested that a discussion regarding legal expenses be placed on the agenda. Recommendation: Pleasure of the City Council. APPEAL OF SIGN CODE EXCEPTION 94-003 (APPLICANT: MR. WILLIAM TAYLOR- TAYLOR'S RESTAURANT) The request from the applicant is to permit an exception from Tustin City Code Section 9403hd, which requires supplemental signage to be subordinate to business identification and limits supplemental signage to 25 percent of the allowable sign area.
