RECOMMENDATION
It is recommended that the City Council approve Amendment to
Vesting Tentative Tract Map 14669 modifying a condition to relocate
a pedestrian paseo by adopting Resolution No. 94-110 as submitted
or revised.
FISCAL IMPACT
There are no fiscal impacts associated with this project as this is
an applicant initiated project. The applicant has paid application
fees to recover the cost of processing this application.
BACKGROUND
On September 14, 1992, the Planning Commission adopted Resolution
No. 3078 recommending to the City Council approval of Vesting
Tentative Tract Map 14669 for the construction of 69 detached
single-family homes on property located at the southwest corner of
Rawlings Way and Tustin Ranch Road. The City Council subsequently
adopted Resolution No. 92-116 on October 5, 1992 approving Vesting
Tentative Tract Map 14669.
Condition No. 2.2 of Planning Commission Resolution No. 3078
required the applicant to provide a 10 foot wide paseo link at the
terminus of Lewis Drive to Tustin Ranch Road. Since that time, the
adjacent Tract, 14168, (also owned by California Pacific Homes) was
approved as a continuation of Tract 14669, with the same floor
plans, common recreation center and common Homeowners Association.
As a condition of approving Tract 14168, a paseo link connecting
the two tracts was created as well as a paseo from Township Drive
to Tustin Ranch Road (See Attachment A). The applicant is now
requesting to modify the original condition 2.2 of Planning
Commission Resolution No. 3078 to eliminate the paseo at Lewis
Drive. The Planning Commission reviewed this request on August 8,
1994 and adopted Resolution No. 3297 recommending City Council
approval of the amendment to Tract 14669.

The subject site is located in Sector 8 of the East Tustin Specific
Plan (ETSP) and is surrounded by Rawlings Way on the north, Lot 28
of Tract 12870 on the south, Tustin Ranch Road on the east and
Township Drive on the west. The subject property is legally
described as Lots 8, "MM", "N", "HHH, "III" and "JJJ" of Tract
12870 as shown on a map recorded in book 647, Pages 1 through 7
inclusive of Miscellaneous Maps, Records of Orange County.
A public hearing notice identifying the time, date and location of
the public hearing on this project was published in the Tustin
News. Property owners within 300 feet of the site were notified of
the hearing by mail and notices were posted on the site, at City
Hall and at the Tustin Police Department. The applicant was
informed of the availability of a staff report on this project.
DISCUSSION
Condition No. 2.2 was included to satisfy the goals and policies of
the ETSP by providing for pedestrian circulation and providing
direct access to transit corridors. Condition 2.2 reads as
follows:
"The subdivider shall provide a paseo link for the tract
over the 10' sewer easement located at the terminus of Lewis
Drive (Lot G) networking the tract pedestrian circulation to
the sidewalks adjacent to Tustin Ranch Road."
At the time of approval of Tract 14669, the adjoining tract to the
south was planned to be completely separate, and to be developed
with attached homes. For that reason, the pedestrian link from the
subject project to Tustin Ranch Road was needed from Lewis Drive.
The applicant is proposing to modify Condition No. 2.2 to read as
follows:
"The subdivider shall provide a paseo link for the tract over
Lot "S" of Tract 14669 combined with Lot "E" of Tract 14168
networking the tract pedestrian circulation between Tract
14669 and 14168 and to the sidewalks adjacent to Township
Drive and Tustin Ranch Road."

Since 1992 when Tract 14669 was approved, the adjacent Tract No.
14168 has been approved as a continuation of Tract 14669 and two
paseos have been installed as part of that approval; one connecting
Tract 14669 to Tract 14168 and one connecting Township Drive to
Tustin Ranch Road. These paseos adequately provide the necessary
pedestrian circulation and meet the original goals of the ETSP.
The proposed modified language would also more accurately reflect
the pedestrian connections provided as part of Tract 14168.
CONCLUSION
Based upon the above analysis, it is recommended that the City
Council approve the proposed Amendment to Vesting Tentative Tract
14669 by adopting Resolution No. 94-110, as submitted or revised.

The Planning Commission of the City of Tustin does hereby
resolve as follows:
The Planning Commission finds and determines as follows:
A. That Amendment to Vesting Tentative Tract Map 14669
was submitted to the Planning commission by
California Pacific Homes for consideration to
modify Condition No. 2.2 of Planning Commission
Resolution No. 3078 related to the location of the
paseo.
B. That a public hearing was duly called, noticed and
held for said amendment on August 8, 1994, by the
Planning Commission.
C. That the proposed subdivision is in conformance
with the Tustin Area General Plan, adopted East
Tustin Specific Plan, Development Agreement and
Subdivision Map Act as it pertains to the
development of single family detached dwellings.
D. The 0.7038 acres of parkland required for this
development was previously dedicated with
recordation of Tract 12870.

That the city has reviewed the status of the School
Facilities Agreements between the Irvine Company
and the Tustin Unified School District. The East
Tustin Specific Plan, EIR 85-2 with subsequently
adopted supplements and addenda, the impact of
Vesting Tentative Tract 14669 on School District
facilities, and reviewed changes in State law, and
finds and determines that the impacts on School

F. That the site is physically suitable for the type
of development proposed.

The Planning Commission hereby recommends to the City
Council approval of Amendment to Vesting Tentative Tract
Map 14669 to modify Condition 2.2 of Planning Commission
Resolution 3078 to read as follows:

"E" of Tract 14168 networking-the tract pedestrian

effect.
