HUSTON, CITY MA~NAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION AMENDMENT TO AGREEMENT FOR IMPROVEMENT OF JAMBOREE BETWEEN IRVINE BOULEVARD AND EXISTING C~DMAN AVENUE ROAD RECOMMENDATION That the Tustin City Council approve the second amendment to the July 7, 1988 Agreement for Improvement of Jamboree Road between Irvine Boulevard and existing Chapman Avenue and authorize the Mayor to execute said amendment subject to the final approval of the City Attorney,s office. FISCAL IMPACT No impact to City general fund. Project cost will be borne by Assessment District No. 86-2 funding. The assessments within the City of Orange territory are collected by the County of Orange assessor,s office and forwarded to the City of Tustin along with the City's other property tax payments. BACKGROUND The City of Orange, The Irvine Company and the City of Tustin entered into an agreement July 7, 1988 to provide for financing and construction of Jamboree Road between Irvine Boulevard and existing Chapman Avenue. On January 3, 1989 the above mentioned three agencies executed the first amendment to the original agreement which provided for the City of Orange to administer the work for that portion of the project consisting of Jamboree Road street and drainage improvements between Chapman Avenue realigned and the Irvine Park entrance. This first amendment enabled the City of Orange to coordinate the proposed Jamboree Road improvements with other on-going roadway improvements within that mmedlate area. i DISCUSSION This proposed second amendment will include all of the remaining landscape and irrigation work to be completed along Jamboree Road between the Orange-Tustin City boundary and the realigned Santiago Canyon Road and will enable the City of Orange to administer the construction/installation work within their own jurisdiction. This Assessment District No. 86-2 will still be responsible for funding this work and will reimburse the City of Orange for said work after total review by the Tustin City Engineer or his designee. The proposed second amendment to the July 7, 1994 agreement is currently being executed by the City of Orange and The Irvine Company and is under review by the Tustin City Attorney,s office. RECITALS WHEREAS, ORANGE and TUSTIN have agreed that the hereinafter worded Amendment to the Agreement of July 7, 1988 (originally amended January 3, 1989), will contribute to the effective and expeditious installation of that improvement known as landscape and improvements for Jamboree Road being developed pursuant to this Agreement; and WHEREAS, it would expedite the improvement work under the agreement if Orange provided a portion of the improvements shown as "Project Area" on the attached Exhibit "A", attached hereto and made a part hereof. WHt~REAS, all parties are in Agreement as to the desirability of the hereinafter worded Amendment to the Agreement for improvement of Jamboree Road between Ir'vine Boulevard and existing Chapman Avenue, NOW, THEREFORE, IN CONSIDERATION OF THE MLrrUAL COVENANTS AND AGREEMENTS HEREINAF li:R SET FORTH, THE PARTIES AGREE AS FOLLOWS: Section 1 Public A~;ency Responslbilltle~ shall be amended by adding subsection (d) to read as follows: (d) Grange shall administer the work for thai portion of the Project consisting of all of Jamboree P. oad in the City of Orange, all as shown as ';Project .affea' on Exhibit "A°'. The specific improvements to be done by Orange shall be all sidewalk and landscape improvements as agreed between the City Engineers of Orange and Tustin. Section 2: Payments from Assessment District funds shall be made by TUSTIN to ORANGE within thirty (30) days after presentation of invoices by Orange for the work done under this Amendment.
