PUBLIC HEARING ( ITEM 1 ) ZONE CHANGE 94-003 AND VESTING TENTATIVE TRACT MAP 14934 (D&D DEVELOPMENT, INC.) The applicant proposes to subdivide an 11.25 gross acre site into 145 numbered lots and 33 lettered lots to accommodate 145 single-family detached dwelling units and resulting in the demolition of an existing 296 unit apartment complex located at the southerly terminus of Newport Avenue. JOINDER IN SUPREME COURT AMICUS BRIEF IN KNOTT V, STATE; PUBLIC ENTITIES SHOULD NOT BE HELD LIABLE FOR EMPLOYEES' CRIMINAL ACTS Recommendation by the City Attorney: Authorize the City Attorney to join in an amicus brief being filed on behalf of cities and counties in Knott v, State, This is in support of the principle that public entities should not be held vicariously liable for the criminal acts of their employees. This joinder does not require any expenditure of funds by the City. CITIZEN COMPLAINT REGARDING CONDITION OF BUS STOP(S) ALONG NlSSON ROAD BETWEEN NEWPORT AND RED HILL AVENUE Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. TUSTIN RANCH TRACT NO. 13627 Several residents in Tustin Ranch have approached the City Council concerning the construction schedule of a Community Park proposed to be located on Pioneer Way in East Tustin. COUNCIL MEETING CURFEW At the August 1, 1994 City Council meeting, CouncilmemberThomas requested that a City Council meeting curfew be agendized for discussion. Recommendation: Pleasure of the City Council, 18. OLD TOWN RESIDENTIAL DESIGN GUIDELINES The Residential Design Guidelines were created to develop the design criteria for the City's Cultural Resource District and create an illustrated guide to assist City staff, property owners, architects and contractors to make design decisions that enhance the character of the Cultural Resources District. Recommendation: Adopt the following Resolution No. 94-98 approving Residential Design Guidelines for Old Town Tustin as recommended by the Community Development Department: RESOLUTION NO. 94-98 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING RESIDENTIAL DESIGN GUIDELINES FORTHE CULTURAL RESOURCES DISTRICT 19. ORDINANCE NO. 1129, GIFT BAN Ordinance No. 1129 was introduced at the August 1, 1994 City Council meeting. Recommendation: Direct staff to proceed with the proposed Assessment Districts 85-1 and 86-1 bond refundings per the recommendations detailed in subject report by Bartle Wells Associates and authorize the City Manager to negotiate an agreement appointing Battle Wells Associates as Financial Advisor as recommended by the Finance Department. 23. ORDINANCE PROHIBITING SLEEPING IN PARKED VEHICLES Proposed Ordinance No. 1140 would prohibit sleeping in parked vehicles between 9:00 p.m. and 9:00 a.m. of the following day. ORDINANCE CHANGIN.. ~'HE DATE OF THE GENERAL ~, .,,IICIPAL ELECTION TO THE DATE OF THE STATEWIDE DIRECT PRIMARY ELECTION Proposed Ordinance No. 1139 would change the date of the City's General Municipal Election from the second Tuesday in April of even-numbered years to the date of the statewide direct primary election, which will be held on the fourth Tuesday in March of 1996.
