WORKSHOP - At 5:30 p.m., the City Council will conduct an Affordable Housing Strategy workshop. This workshop is open to the public. PUBLIC HEARING (ITEM 1) RESOLUTION NO. 94-86, PLACING ASSESSMENT FOR SOLID WASTE COLLECTION ON THE 1994-95 TAX ROLL Great Western Reclamation has requested an adjustment in the solid waste collection fees for 1994-95 as permitted by the franchise agreement. Recommendation: Conduct second public hearing of Resolution No. 94-86 which directs the Finance Director to place the charges for solid waste collection on the tax roll for fiscal year 1994-95 as recommended by the Finance Department. SMITH; DATE OF LOSS, 6/22/93; DATE FILED WITH CITY, 6/21/94 Recommendation: Reject subject application for permission to file late claim, as recommended by the City Attorney. RESOLUTION NO. 94-97 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, URGING CONGRESS TO ADDRESS THE ESCALATION OF ILLEGAL IMMIGRATION AS A TOP PRIORITY ISSUE Recommendation: Adopt Resolution No. 94-97 addressing the escalation of illegal immigration, as recommended by the City Manager. HAZARDOUS MATERIAL SPILL CLEAN-UP CONTRACT Recommendation: Participate as a co-op entity under the County of Orange contract with Disposal Control Service, Incorporated, for hazardous material spill clean-up services, and that the City Manager be authorized to execute a letter of agreement, as recommended by the Public Works Department/Engineering Division. RESOLUTION NO. 94-92- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING SUPPORT FOR THE LOS ANGELES RAMS REMAINING IN ANAHEIM AND THE COUNTY OF ORANGE Recommendation: Adopt Resolution No. 94-92 declaring support for the Rams remaining in Anaheim, as recommended by the Office of the City Clerk. 10. AWARD OF CONTRACT FOR WATER MAIN REPLACEMENT PROJECTS - PROJECT NO. 600121 Recommendation: Award the contract for the subject project to RLT Construction, Inc. of Anaheim, California, in the amount of $327,070.00, as recommended by the Public Works Department/Water Division. 11. RESOLUTION NO. 94-96 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND REPAIR AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR SIDEWALK, CURB AND GUTTER, AND INTERLOCKING PAVER REPAIR PROJECT, 1993-94 FY Recommendation: Adopt Resolution No. 94-96 accepting said work and authorizing recordation of the Notice of Completion, as recommended by the Public Works Department/Engineering Division. RESOLUTION NO, '~;95 - A RESOLUTION OF THF ;Y COUNCIL OF THE CITY OF TUSTIN, CALIFO~. ...~, ACCEPTING WORKS OF IM~-_.JVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT 1993-94 FY (PROJECT NO. 700001) Recommendation: Adopt Resolution No. 94-95 accepting said work and authorizing recordation of the Notice of Completion, as recommended by Public Works Department/Engineering Division. 13. RESOLUTION NO. 94-85 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE INCLUSION OF THE CITY INTO A COUNTY RECYCLING MARKET DEVELOPMENT ZONE PROGRAM Recommendation: Adopt Resolution No. 94-85 approving the inclusion of the City in a Countywide Recycling Market Development Zone Program, as recommended by the Public Works Department/Engineering Division. 14. RESOLUTION NO. 94-93 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION PLAN Recommendation: Adopt Resolution No. 94-93 amending the Classification Plan to include the non-management position of Project Manager-Housing, as recommended by Personnel Services. 15. AGREEMENT - HISTORICAL SOCIETY RENT Recommendation: Authorize payment for rent of $475.00 per month to the Tustin Area Historical Society effective July 1, 1994 and terminating June 30, 1995, as recommended by the City Manager. REGULAR BUSINESS (ITEMS 16 THROUGH 31) 16. THE MCKINNEY ACT STRATEGY AS IT APPLIES TO MCAS TUSTIN The Stewart B. McKinney Homeless Assistance Act of 1987 requires the Defense Department and other federal agencies to give homeless assistance uses top priority consideration over other uses for transfer of surplus federally owned buildings or land which are determined to be suitable and available and which are not needed by another federal agency. Recommendation: Concur with current McKinney Act compliance strategy and/or provide any additional direction on this matter as recommended by the Community Development Department. 17. BALLOON FESTIVAL Korff Enterprises representing Smith Food King and The Irvine Company submitted an application to the City related to a proposed Smith's Festival of Ballooning to be held in Tustin Ranch September 23-25, 1994. Recommendation: Pleasure of the City Council. Council Agenda 3 August 1, 1994 18. ROLLER HOCKEY, 'ENTIAL AT COLUMBUS TU,~ ~PARK At the July 5, 1994 Council meeting, Mayor Pro Tern Potts requested staff return with a report examining the possible addition of an "in-line skating" or "rollerblading" hockey rink at Columbus Tustin Park. Recommendation: PJeasure of the City Council. 19. AB 2196 - OPTIONS ON MUNICIPAL ELECTION DATES Councilmember Thomas requested staff examine a potential change in municipal election dates as authorized by AB 2196. Recommendation: Pleasure of the City Council. 20. ORDINANCE BANNING GIFTS OF $250 OR MORE Proposed Ordinance No. 1129 would ban the acceptance of gifts by City Officers and Designated Employees aggregating $250.00 or more Recommendation: Pleasure of the City Council. 21. ORDINANCE NO, 1134, SMOKING RESTRICTIONS Ordinance No. 1134 was introduced at the July 18, 1994 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1134 (roll call vote): ORDINANCE NO. 1134 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING PART 2 OF CHAPTER I OF ARTICLE 4 OF THE TUSTIN CITY CODE REGARDING SMOKING 22. ORDINANCE REQUIRING THAT PROPOSALS FOR THE ANNUAL INDEPENDENT AUDIT BE REQUESTED AT LEAST EVERY FIVE YEARS Mayor Pro Tern Potts requested an ordinance be drafted requiring that proposals for the annual independent audit be requested at least every five years. Recommendation: Pleasure of the City Council. 23. SOLICITATION OF OCCUPANTS OF MOTOR VEHICLES Mayor Pro Tem Potts requested an ordinance be drafted prohibiting the solicitation of occupants of motor vehicles while such vehicles are traveling in the public right-of- way. Recommendation: Pleasure of the City Council. Council Agenda 4 August 1, 1994 24. TERM LIMITS FO ':ANNING COMMISSIONERS' ~ PARKS COMMISSIONERS Mayor Pro Tem Ports requested an ordinance be drafted limiting the terms of Planning Commissioners and Parks and Recreation Commissioners to three (3) full consecutive terms. Recommendation: Pleasure of the City Council. 25. AUTHORIZATION TO INITIATE NEGOTIATIONS FOR A COMMUTER RAIL STATION 26. A potential commuter rail station site has been located in the City of Tustin on privately held property known as Jamboree Plaza. The site is bounded by the railroad right-of-way to the north, Jamboree Road on the east and Edinger Avenue on the south. The Orange County Transportation Authority (OCTA) has allocated $1.9 million of Proposition 116 funds toward the cost of design and construction for each of the new commuter rail stations proposed in Orange County. The OCTA will also allow the $1.9 million to be used solely for site acquisition if there is a funding plan for construction costs. Recommend__ation: Authorize the Assistant City Manager to initiate negotiations for purchase acquisition or long term lease for a commuter rail station site with Kemper Real Estate, the property owners of Jamboree Plaza, AIRPORT STATUS REPORT - DRAFT ENVIRONMENTAL IMPACT REPORT FOR AIR CARGO OPERATIONS At the July 5, 1994 meeting, Councilmember Thomas requested an update of the pending proposal to initiate air cargo operations at John Wayne Airport that will be considered by the County Board of Supervisors. _Recommend~ation: Receive and file, 27. APPLICATION FOR ALLOCATION OF MORTGAGE CREDIT CERTIFICATES The Federal Government allocates a set amount of mortgage authorization for each state. California, in turn, sub-allocates this authority to local jurisdictions. The application, which the County is filing, is to the California Debt Limit Advisory Committee, who has the authority in California to allocate this State's share of mortgage amounts to local agencies. In September 1993, the City of Tustin joined other cities and the County in receiving an allocation for this program. The allocation is almost depleted and the County is now preparing an application for a new allocation. Re ommendation: Adopt the following Resolution No. 94-94, adopting a Mortgage Credit Certificate Program as recommended by the Community Development Department: RESOLUTION NO. 94-94 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING A MORTGAGE CREDIT CERTIFICATE PROGRAM IN COOPERATION WITH THE COUNTY OF ORANGE Council Agenda 5 August 1, 1994 28. OLD TOWN ENTP' 'IGN At the July 18, 1994 Council meeting, Mr. Phil Cox Presented renderings of possible new entry signs for Old Town, along with the possible locations for their installation. Recommendation: Receive and file. 29. INITIATION OF ANNEXATION NO. 155 - 13331 FOOTHILL BOULEVARD The City of Tustin Water Division has been working on plans to improve and repair the existing Rawlings Reservoir located at 13333 Foothill Boulevard. Last year the City acquired the two parcels south of the reservoir site in order to provide adequate land area for the repair and maintenance of the facility. The reservoir site is located in City boundaries; however, the surrounding property is County unincorporated territory. Annexation of the adjacent parcels, located at 13331 Foothill Boulevard, would streamline the permit process. Recommendation by the Community Development Department: a. Initiate Annexation No. 155 by adoption of the following Resolution No. 94-90: RESOLUTION NO. 94-90 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, INITIATING APPLICATION FOR THE UNINHABITED ANNEXATION OF TERRITORY KNOWN AS ANNEXATION NO. 155 (13331 FOOTHILL BOULEVARD) b. Confirm the Master Property Tax Transfer Agreement by adoption of the following Resolution No. 94-91, as submitted or revised: RESOLUTION NO. 94-91 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CONFIRMING THE APPLICATION OF THE MASTER PROPERTY TAX TRANSFER AGREEMENT TO THE PROPOSED ANNEXATION NO. 155 ( 13331 FOOTHILL BOULEVARD) 30. COUNTY LIBRARY Mayor Pro Tern Potts and Councilmember Worley requested Council discuss options for extending the operating hours of the County library located on the Civic Center site. Recommendation: Pleasure of the City Council. 31. AWARD OF CONTRACTS - LANDSCAPE MAINTENANCE AND CUSTODIAL SERVICES Due to fiscal constraints and in order to reduce operating costs thereby generating additional income for capital projects, staff has been reviewing opportunities for contracting landscape maintenance and custodial services. Council Agenda 6 August 1, 1994 Recommendation ~prove an agreement with C[ nia Landscape Maintenance, Inc. for landscape r~,dintenance services and an agreu~nent with Pacific Building Care for custodial services. Both agreements are for a two-year period.
