HUBTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT INITIATION OF ANNEXATION NO. 155 13331 FOOTHILL BOULEVARD RECOMMENDATION It is recommended that the City Council initiate Annexation 155 by adoption of Resolution 94-90 and confirm the Master Property Tax Transfer Agreement by adoption of Resolution 94-91 as submitted or revised. FISCAL IMPACT Other than the cost of staff time to prepare the necessary application, a LAFCO processing fee of $500 and a State filing fee of $200, there are no additional costs associated with this project. The LAFCO fee and the State filing fee will be paid by the City of Tustin Water Services Division. BACKGROUND The City of Tustin Water Division has been working on plans to improve and repair the existing Rawlings Reservoir located at 13333 Foothill Boulevard. Last year the City acquired the two parcels south of the reservoir site in order to provide adequate land area for the repair and maintenance of the facility. See the attached location map (Exhibit A). Although the reservoir site is surrounded by County unincorporated territory, the property is located within Tustin City boundaries. In order to streamline the permit processing and to eliminate the need to deal with two jurisdictions (the County of Orange and the City of Tustin) it is recommended that the adjacent parcels (13331 Foothill Boulevard) be annexed to the City of Tustin. DISCUSSION The property at 13331 Foothill Boulevard contains approximately .65 acres of land and contains one older residence located on the easterly one-half of the property. The City is currently leasing the property to the previous owner and it is anticipated that the tenant will be relocating within the next six months. The City is required to adopt a resolution to initiate this annexation. After that, LAFCO will hold a hearing on the proposal, and then the City City Council Report Initiation of Annexation No. Page 2 155 Council will formally approve the annexation. Since we have 100% of property owner consent and there are fewer than 12 registered voters on the site, LAFCO would consider this an uninhabited annexation. As such, the annexation process is slightly shorter and does not require a protest hearing. Attached is a City Council Resolution initiating the annexation, pursuant to Section 56800 of the Cortese-Knox Local Government Reorganization Act of 1985. As part of the application for annexation, the City Council is required to adopt a'resolution confirming the application of the Master Property Tax Transfer Agreement that provides for the division of property taxes between the County of Orange and the City of Tustin. This proposed annexation of a small parcel of land is for the repair and maintenance of an existing public water reservoir and therefore qualifies as Categorically Exempt (Class 19) pursuant to the provision of Section 15319 of the California Environmental Quality Act. At some time in the future, the City may wish to expand the reservoir facility which will require further environmental analysis and design review. CONCLUSION Based upon the above discussion, staff recommends the City Council initiate Annexation No. 155 and confirm the Master Property Tax Transfer Agreement. Christine A. ANNEXATION BOUNDARy 0.65 AC. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 94-90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, INITIATING APPLICATION FOR THE UNINHABITED ANNEXATION OF TERRITORY KNOWN AS ANNEXATION NO. 155 (13331 FOOTHILL BOULEVARD) Whereas, the City Council of the City of Tustin on its own motion has initiated preliminary proceeding for the annexation of certain uninhabited territory; and Whereas, the City of Tustin Water Division has a water reservoir located at 13333 Foothill Boulevard, adjacent to the subject property, and intends to repair and maintain the facility in order to better serve the customers; and Whereas, in order to simplify and streamline the design and permitting process, it would be of significant benefit for both 13331 and 13333 Foothill Boulevard to be located within the same jurisdiction; and Whereas, the City Council has determined that the proposed annexation of a small parcel of land is for the repair and maintenance of an existing public facility and therefore qualifies as a Categorical Exemption (Class 19) from the requirements of the California Environmental Quality Act. Now therefore be it resolved by the City Council of the City of Tustin California that: The proposal for Annexation No. 155 to the City of Tustin is made pursuant to Part 3, Chapters 1 and 4 of the Cortese-Knox Local Government Reorganization Act of 1985. The proposed change of organization consists of the annexation of approximately .65 acres of uninhabited territory as shown on Exhibit A, is surrounded by unincorporated territory of the County of Orange to the west, south and east and is bordered by incorporated limits of the City of Tustin on the north. The subject property is located on the north side of Foothill Boulevard at 13331. Foothill Boulevard. The Local Agency Formation Commission is hereby requested to undertake annexation proceedings pursuant to Part 3, Section 56837 of the Cortese- Knox Local Government Reorganization Act of 1985. Now therefore, be it resolved by the City Council of the City of Tustin, California that the Master Property Tax Transfer Agreement between the County of Orange and the City of Tustin to provide for property tax exchange in areas annexed by the City and to provide for the allocation of property tax revenues, as approved by the Board of Supervisors and the City Council and effective November 18, 1980, shall be applicable to the territory within the proposed Annexation No. 155 (13331 Foothill Boulevard).
