THE PROPOSED PROJECT WAS EVALUATED WITHIN THE PROGRAM EIR AND NO ADDITIONAL ENVIRONMENTAL ANALYSIS OR ACTION IS REQUIRED PRIOR TO CITY ACTION. Planning Commission Report MCAS Tustin Redevelopment Plan Report April 14, 2003 Page 2 RECOMMENDATION That the Planning Commission approve and forward Resolution No. 3868 providing its report and recommendations on the Proposed Redevelopment Plan for the MCAS- Tustin Redevelopment Project to the Tustin City Council. BACKGROUND Section 33346 of the California Redevelopment Law (the "CRL") requires that before the redevelopment plan of each project is submitted to the legislative body, the proposed plan shall be submitted to the Planning Commission for its report and recommendation concerning the redevelopment plan and its conformity to the adopted general plan. In accordance with Sections 33330 and 33346 of the CRL, on March 24, 2003, the Agency transmitted the proposed Redevelopment Plan for the MCAS-Tustin Redevelopment Project and the Preliminary Report to the Planning Commission for its consideration and consultation. Per Section 33347 of the CRL, the planning commission's report and recommendations are to be prepared within thirty (30) days after a redevelopment plan is submitted to it for consideration The Preliminary Plan for the MCAS Tustin Redevelopment Project ("Project") was considered and adopted by the Tustin Planning Commission by Resolution No. 3544 on September 8, 1997. The Tustin Community Redevelopment Agency (the "Agency") received the Preliminary Plan on September 15, 1997 and authorized transmittal of the project description to taxing agencies by of Resolution No. RDA 97-4. The Preliminary Plan was amended by the Tustin Planning Commission by Resolution No. 3856 on December 9, 2002, which amended the boundaries of the project area to delete territory on the former MCAS Tustin base that is within the City of Irvine and to delete approximately 48 acres of non-base territory that was previously included in the project area. The Tustin Community Redevelopment Agency (the "Agency") approved the Amended Preliminary Plan on December 18, 2002 by adoption of Resolution No. RDA 02-4. The Planning Commission approved the City of Tustin General Plan Amendment on November 28, 2000, by Resolution No. 3730 to reflect the MCAS Specific Plan designation for the former MCAS Tustin base. The General Plan Amendment was approved by the Tustin City Council on January 16, 2001 by Resolution 00-91. The MCAS Tustin Specific Plan was recommended for approval by the Planning Commission on October 28, 2002 by Resolution No. 3848. The Tustin City Council approved the First Reading of Ordinance 1257 on January 21, 2003 for the MCAS Tustin Specific Plan, and the Second Reading of Ordinance 1257 on February 3, 2003 adopting the MCAS Specific Plan. Planning Commission Report MCAS Tustin Redevelopment Plan Report April 14, 2003 Page 3 Resolution No. 3868 confirms the conformity of the proposed Redevelopment Plan to the City of Tustin General Plan and provides the Planning Commission Planning Commission's recommendation for adoption of the proposed Redevelopment Plan by City Council. A community information meeting will be held on Wednesday, April 16, 2003 to provide for public review of the proposed Redevelopment Plan prior to transmittal of the proposed Plan and the Planning Commission's Report to City Council on April 21, 2003. It is anticipated that the City Council and Redevelopment Agency will conduct a joint public hearing to consider the proposed Redevelopment Plan in June 2, 2003. Ch'ristine A. Shing~ Assistant City Manager Redevelopment Program Manager RDA\PCReport\format.doc RESOLUTION NO. 3868 A RESOLUTION OF THE TUSTIN PLANNING COMMISSION MAKING ITS REPORT AND RECOMMENDATION ON THE ADOPTION OF THE MCAS TUSTIN REDEVELOPMENT PLAN AND FINDING THAT THE MCAS TUSTIN REDEVELOPMENT PLAN CONFORMS WITH THE CITY'S GENERAL PLAN, INCLUDING THE HOUSING ELEMENT The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. Proceedings have been initiated by the City Tustin ("City") and the Tustin Community Redevelopment Agency ("Agency") for adoption of the MCAS Tustin Redevelopment Plan ("Redevelopment Plan" or "Plan"); and Bo That in accordance with Section 33346 of the Community Redevelopment Law, Health & Safety Code Section 33000 et seq. (the "CRL"), the Redevelopment Plan must be submitted to the Planning Commission for its report and recommendation concerning the Redevelopment Plan and its conformity to the City's General Plan; and C, That on January 16, 2001, the Tustin City Council adopted a General Plan Amendment by Resolution 00-91 to reflect the MCAS Specific Plan land use designation for the former MCAS Tustin base; and D, That on February 3, 2003, the Tustin City Council ("City Council") adopted the MCAS Tustin Specific Plan/Reuse Plan, which is intended to serve as both a policy-oriented and regulatory document containing the development and reuse regulations that constitute zoning for the Project Area upon conversion to civilian use; and Eo That as stated in Section 401 of the Redevelopment Plan, the "real property located within the Project Area shall be developed and used for uses that are consistent with the applicable provisions of the Specific Plan as it may be amended from time to time." NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF TUSTIN DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The proposed Redevelopment Plan is in full conformity with the General Plan of the City of Tustin. Resolution 3868 Page 2 Section 2. The Planning Commission of the City of Tustin hereby recommends adoption of the proposed Redevelopment Plan by the City Council. Section 3. The City Council and the Agency are hereby authorized to make minor or technical changes to the proposed Redevelopment Plan prior to its adoption without further Planning Commission review and such changes do not affect the findings and recommendations of the Planning Commission herein, provided that the changes do not significantly change the scope or purpose of the Redevelopment Plan or raise the potential for inconsistencies with the General Plan. Section4. The Secretary of the Planning Commission is hereby authorized and directed to transmit a copy of this Resolution to the Tustin City Council and to the Agency as prescribed in Section 33347 of the CRL.
