JOINT MEETING- At 5:30 p.m., the City Council will hold a joint meeting with the Audit Committee. This meeting will be held in the Community Center and is open to the public. CALL TO ORDER / PLEDGE OF ALLEGIANCE / INVOCATION ROLL CALL PUBLIC INPUT- At this time members of the public may address the City Council regarding any items not on the agenda and within the subject m~tter jurisdiction of the City Council (NO ACTION can-be taken on o.ff-agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the blue forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. PUBLIC HEARING ( ITEM 1 1. LEVY OF ANNUAL ASSESSMENTS FOR THE 1994-95 FISCAL YEAR FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT Interested persons may appear before the City Council and be heard concerning the annual levy of assessments to the district and the annexation of additional territory to an existing district. Recommendation: Pleasure of the City Council. CONSENT CALENDAR ( ITEMS 2 THROUGH 14 ) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1 APPROVAL OF MINUTES- JUNE 6, 1994 REGULAR MEETING Recommendation' Approve the City Council Minutes of June 6, 1994. 1 APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation' Approve Demands in the amount of $1,766,656.07 and ratify Payroll in the amount of $312,152.04. SALE OF SURPLUS FURNITURE Recommendation: Receive and file notice of sale of surplus recommended by the Public Works Department/Engineering Division. furniture as FIRE SERVICES CONTRACT , Recommendation: Authorize the Mayor to execute an agreement with the County of Orange which extends the City's agreement for fire suppression, prevention, inspection and paramedic services through June 30, 1995 as recommended by the City Manager. PROPERTY ACQUISITION - EL CAMINO REAL Recommendation: Approve the following three actions: (1) Confirm the acquisition of the property at 1921-1951 El Cam,no Real, (2) Authorize a supplemental budget appropriation to the 1993-94 Capital Improvement Program Budget (Project 700116) in the amount of $295,000.00 from the unappropriated reserve of the Measure "M" Turnback funds, and (3) Authorize staff to execute an agreement with Hinkson Property Management Services at the monthly rate of $200.00 as recommended by the Public Works DePartment/Engineering Division. . AUTHORIZATION TO CONTINUE OPERATION FOR FISCAL 1994-95 Recommendation: Authorize the City Manager to continue fiscal operations for 1994-95 at an appropriation level not to exceed that of 1993-94, until such time as the budget process can be completed as recommended by the Finance Department. 9. REQUEST FOR PERMIT PARKING ON ROSALIE PLACE AND QUENT DRIVE Recommendation: Approve the request for permit parking on Rosalie Place and Quent Drive, and direct staff to prepare the necessary documentation to amend City Code Section 5331 to designate these streets with on-street parking by permit only as recommended by the Public Works Department/Engineering Division. 10. PLANNING COMMISSION ACTION AGENDA- JUNE 13, 1994 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of June 13, 1994. 11. ORANGE COUNTY LIBRARY TASK FORCE STATUS REPORT Recommendation: Receive and file subject report as recommended by the City Manager. 12. AIRPORT STATUS REPORT Recommendation: Receive and file Community Development Department. subject report as recommended by the Council Agenda 2 June 20, 1994 13. RESOLUTION Nq -74 - A RESOLUTION OF THE Ct" ~OUNCIL OF THE CITY OF TUSTIN, CALIFO~,.~I~A, AUTHORIZING THE DESTR~,~,TION OF CERTAIN CITY RECORDS, DOCUMENTS, AND PAPERS IN THE POSSESSION OF THE POLICE DEPARTMENT OF THE CITY OF TUSTIN NO LONGER REQUIRED FOR THE CONDUCT OF CITY BUSINESS PURSUANT TO THE AUTHORITY GRANTED BY SECTIONS 34090, 34090.5 AND 34090.7 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA Recommendation: Adopt Resolution No. 94-74 that authorizes the destruction of police records as permitted by law as recommended by the Police Department. 14. (Item No. 14 was removed from the Agenda). REGULAR BUSINESS ( ITEMS 15 THROUGH 24 ) 15. ORDINANCE NO. 1127, ZONE CHANGE 93-5 (LAING HOMES) Ordinance No. 1'127 had first reading by title only and introduction at the June 6, 1994 City Council meeting.. Recommendation: -Have second reading by title only and adoption of the following Ordinance No. 1127 (roll call vote): ORDINANCE NO. 1127 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 93-005 TO AMEND SECTION 3.6.3.A2.4 OF THE EAST TUSTIN SPECIFIC~PLAN TO MODIFY THE BUILDING SETBACKS FOR MULTIPLE FAMILY AND CONDOMINIUM DWELLINGS IN THE EAST TUSTIN SPECIFIC PLAN 16. ORDINANCE NO. 1126, TERM LIMITS Ordinance No. 1126 was introduced at the June 6, 1994 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1126 (roll call vote): ORDINANCE NO. 1126 - AN ORDINANCE OF THE PEOPLE OF THE CITY OF TUSTIN, CALIFORNIA, LIMITING CONSECUTIVE TERMS OF MEMBERS OF THE CITY COUNCIL 17. APPROVAL OF REQUESTS FOR PROPOSALS FOR ADVERTISING BUS SHELTERS AND RESPONSE TO COMMENTS Section 9404 a(1)(b) of the Tustin City Code states that advertising display bus shelters may only be placed within the public right-of-way under a franchise agreement or other contractual agreement. Recommendation: Authorize staff to advertise and circulate the Request for Proposals (RFP) for bus shelters with advertising in the City of Tustin as recommended by the Public Works Department/Engineering Division. REVISION OF P CLOSING HOURS - FRONTIER, Tustin City Code requires closure of parks between the hours of 10:00 p.m. and 6:00 a.m. and City Council action is required to designate alternate hours. Recommendation: (1) Adopt the following Resolution No. 94-62 which closes Frontier Park from sunset to 6:00 a.m, and (2) Change wording of signs at Tustin Centennial Park to read "sunset" instead of "dusk" as recommended by the Community Services Department: RESOLUTION NO. 94-62 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING HOURS AT FRONTIER PARK CITY TREASURER Mayor Pro Tern Potts requested a report on how the City of Orange provides its treasury function. Recommendation: Pleasure of the City Council. DRAFT ORDINANCE - BIDDING OF SOLID WASTE COLLECTION CONTRACT Mayor Pro Tem Potts requested that an ordinance be drafted which requires the bidding of the City's solid waste disposal contract every five years. Recommendation: Pleasure of the City Council. SANTA ANA-TUSTIN TRANSPORTATION SYSTEM IMPROVEMENT AUTHORITY FEES Santa Ana-Tustin Transportation System Improvement Authority (TSlA) fees are required for any construction or improvement project which would result in a new building or structure' including multiple family residential units or an increase in floor area provided said improvements exceed $20,000.00 in value. Recommendation' Adopt the following Resolution No. 94-72 eliminating the second year graduated TSlA fee increase as recommended by the Community Development Department: RESOLUTION NO. 94-72 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING TRANSPORTATION SYSTEM IMPROVEMENT PROGRAM DEVELOPMENT FEES REQUEST BY HISTORIC SOCIETY FOR FINANCIAL ASSISTANCE The Historic Society has requested that the City provide financial assistance to the Society by paying its annual rent of $5,700.00. DATES , Each year the City Council holds a series of workshops in order to review each of the operating budgets and capital improvement budgets. Recommendation: Pleasure of the City Council. 24. MICRO CENTER DISPOSITION AND DEVELOPMENT AGREEMENT The Disposition and Development Agreement requires financial assistance by the Redevelopment Agency, and further information is included in the Agency's agenda. Recommendation by the Community Development Department: a. Approve the Environmental Determination for the project by adopting the following Resolution No. 94-73: RESOLUTION NO. 94-73 - A RESOLUTION OF THE CITY COUNCIL OF' THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE PACIFIC CENTER EAST SPECIFIC PLAN (FINAL EIR 90-1) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR THE APPROVAL OF THE DISPOSITION AND DEVELOPMENT AGREEMENT BY AND AMONG THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY, THE CITY OF TUSTIN, CATELLUS DEVELOPMENT CORPORATION AND MICRO ELECTRONICS, INC. AND THAT ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT bm Approve the Disposition and Development Agreement by and among Micro Electronics, Inc. (Micro Center), Catellus Development Corporation, the City and the Redevelopment Agency to provide Micro Electronics, Inc. with financial assistance for the improvement of the property at 1100 Edinger Avenue. OTHER BUSINESS--City Manager, City Attorney, City Council CLOSED SESSION - During the course of conducting the business set forth on this agenda at a regular meeting of the City Council, the Council may convene in Closed Session to consider matters of pending or potential litigation, or personnel matters, pursuant to Government Code Sections 54956.9 or 54957.6. Council Agenda 5 June 20, 1994 Reports relating to (a) ~ nase and sale of real property, (b,, [ters of pending or potential litigation, (c) empioyee~compensation, or which are exempt from public disclosure under the California Public Records Act, may be reviewed by the Council during a permitted Closed Session and are not available for public inspection.
