FISCAL IMPACT:
The 1994-95 Capital Improvement budget request includes a request for
$2,400 for updated park rules signs. -
BACKGROUND:
The Tustin City Code regarding parks requires closure of parks and
playgrounds between the hours of 10:00 p.m. and 6:00 a.m. The Code
requires City Council resolution or minute order to designate other
hours.
On April 21, 1994, the Parks and Recreation Commission conducted a
workshop concerning neighborhood park operating hours (Attachment A-2).
At this meeting, the Police Department and Community Services Department
made presentations regarding concerns with the hours these parks are
open. This workshop determined that the cUrrent hours of 6:00 a.m. to
10:00 p.m. seem to work well for most parks. However, in the late
1970's, the City Council changed park hours at Tustin Centennial Park to
"6:00 a.m. to dusk." This alteration has helped with vandalism and
noise ~omplaints during evening hours in that particular park.
The P0~ice Department expressed concerns with Frontier Park. These
concerns deal primarily with security problems within the park,
surrounding neighborhood and commercial areas· These difficulties are
created by a group of transient individuals who frequent the park. To
cope with these problems, the City has increased the lighting in the
area around the restroom building in the park. The Police Department
has also tried various options to mitigate these problems such as
locking the restrooms in the park from 10:00 p.m. to 6:00 a.m. The
Police Department and the Field Services Division cooperate in
accomplishing this measure.
These measures have had sporadic success. The Police Department has
recommended park closure from sunset to 6:00 a.m. as the next step in
mitigating these problems.
DISCUSSION=
At the May 26, 1994 Parks and Recreation Commission meetinq, the
Commission voted to recommend tot he City Council adoption of ResOlution
No. 94-62 which closes Frontier from sunset to 6:00 a.m. At this
meeting the Commission received inpUt from the Police Department~
To receive public input, staff notified neighbOrs surrounding the park
of the Commission's consideration of these issues. The notice invited
community attendance and participation att he May 26, 1994 meeting. Two
neighbors spoke in favor of the .hours. Staff has also received phone
calls from two other park neighbors who also expressed support for the
new hours.
The only facility in Frontier Park which these new hours would affect
would be the handball courts. This facility is currently lighted until
10:00 p.m. when a timer automatically turns out the light. To continue
to leave this light on after sunset might attract use after dark. The
Police Department reports that the light is not necessary for park
security and that after dark, handball activity is very minimal.
The Commission has suggested using the term "sunset" as opposed to
"dusk." There was concern that the term sunset is more definitive. The
park hours'signs at Tustin Centennial Park currently say that the park
closes at sunset. So that there is consistency among parks with special
closing hours, staff recommends changing both theTustin Centennial Park
and Frontier Park signs to read sunset. Bill Robbins, the property
manager representing the Tustin Meadows Community Association, has
suggested that he does not see this change as a problem.
The 1994-95 Community Development Block Grant program has funded a
grounds and building renovation project at Frontier Park. This project
will relocate and reconstruct the restroom building, regrade park
contours and bring park amenities into compliance with Americans with
Disabilities Act accessibility standards. The redesign and relocation
of the building and park contours will include considerations to improve
park security.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
ESTABLISHING HOURS AT FRONTIER PARK.
W~iEREAS, Tustin City Code, Section 7111 establishes park and
playground closing hours as 10:00 p.m. and 6:00 a.m. in the City of
Tustin; and
WHEREAS, Tustin City Code, Section 7111 allows the City
Council to alter these hours by resolution; and
WHEREAS, the Police Department, Community Services Department
and Parks and Recreation Commission have determined that security
problems exist in Frontier Park which could be improved by closing
the Park. to public use between sunset and 6:00 a.m.; and
WqiF~REAS, the Parks and Recreation. Commission has held a
neighborhood park closing .workshop on April 21, 1994 and discussed
park closing hours at Frontier Park at the May 26, 1994 at which
neighbors of the park were invited to attend and provide input.
NOW, THEREFORE,. BE IT RESOLVED, by the City Council of the
city of Tustin that, effective July, 1, 1994 and accordin~ Tustin
City Code Section 7111, Frontier Park closing shall be sunset to
6:00 a.m.

Recently, the Community Services Department and Police Department
discussed the best closing times for the City's neighborhood parks.
When considering park closing times, consideration should be given
to park security, impacts to the surrounding neighborhood, the
types of programs conducted in the parks and -the types of
facilities.in.the parks.
DISCUSSION:
To help decide the best hours of operation for'each neighborhood
park,-a listing.of activities and facilities which park hours
impact is provided below,

~ The City Council set these revised hours in the late 70,s in
response to residents, and Police Department concerns for vandalism
and loud and boisterous activities in the park after dark.
In developing, a recommendation regarding these issues,
Commission may want to consider the following alternatives:

7110 NORTH TUSTIN PARKETTE - RESTRICTIONS
It shall be un/awN for any person to be in North Tustin Parkette,
known as Santa Clara Parkette located at Santa Clara Avenue, east of the Newport
Freeway, except the follow'lng:
(a) Persoas under the age of thirteen (13) years
(b) Any adult accompanying a member of his family under the age of (13)
years.
(c) Authorized City public safety, mintenance, Park and Recreation
De~t and other City personnel.

7111 CLOSING OF DESIGNATED PARKS
a Closing of Parks and Playgrounds
It shall be unlawful for any person to go on, be in, loiter or remain in, on,
within or upon any park, or playground of .the City of Tustin between the hours
of 10:00 P.M. and 6:00 A.M. or during any period Of time-which shall have been
designated by res01u,~'on or minute order of the City Council as a period when
such' facility shall be .closed; Provided, however, that special pezmits to
occupy and use particular parks and' playgrounds during such hours may be issued
by the City Administrator pursuant to the procedures and standards prescribed in
Section 7113b of the Tustin City Code. (Ord. No. 666, Sec. 1)

PROHIB~ ACTIVITIES IN PARKS

The following activities, sports and uses are hereby prohibited at any park or
playground: '
(a) Sale, possession or use of fireworks.
(b) Sale, pos. session or use of narcotics.
(c) Sale, possession or use of alcoholic beverages except upon written
permit duly issued by the Director of Community Services as provided
in Section 6310.
(d) Gambling.
(e) Sale, possession or use of firearms or weapons of any kind, inciuding,
but not limited to, air rifles, slings, knives or clubs.
(f) Lfttering, defacing or damaging of property.
(g) Giving private lessons for commercial purposes.
