Absent: Councilmen: None Others Present: Dan Blankenship, City Administrator Brian Chase, Community Development Director James G. Rourke, City Attorney Ruth C. Poe, City Clerk Mr. Blankenship stated that he had sent a memo to Council regarding calls from commercial establishments requesting a pro-rating of their bills for trash collection during the recent strike. Mr. George Lazaruk representing the disposal company stated they did not feel there should be pro-rating when they had made extra trips and had cleaned up the commercial and apartment areas. They would reimburse customers who presented them with bills for truck or trailer costs when they carted their own trash to the dumps. Mr. Blankenship stated that the City is pro-rating the residential pick-up and that Mr. Blackman of disposal company did not agree and would be in to see him this coming week. Mr. Blankenship requested Council opinion on this matter. Moved by Saltarelli, seconded by Schuster that City should pay only for whatever service received such as dumpsters and commercial customers should pay .for any service received. If they canshow receipt for interim costs they should receive costs not to exceed regular monthly bill. Motion carried, Mayor Welsh voting No. III. PUBLIC CONCERNS None IV. CONSENT CALENDAR 1. Adoption as recommended by City Engineer. 6. FINAL ACCEPTANCE - TUSTIN MAINTENANCE FACILITY Acceptance of facility and authorization for filing notice of completion all as recommended by the City Engineer. 7. RESOLUTION NO. 78-64 A Resolution of the City Council of the City of Tustin, California, APPROVING PLANS AND SPECIFICATIONS FOR BRYAN AVE. AHFP PROJECT NO. 906 and 907 AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. Adoption as recommended by Engineering Dept. 8. RESOLUTION NO. 78-65 A Resolution of the C.ity Council of the City of Tustin, California APPROVING TENTATIVE PARCEL MAp 78-117. (Property bounded by "B" St., "C" St. and Main St.) Adoption as recommended by Community Development Dept. 9. RESOLUTION NO. 78-66 A Resolution of the City Council of the City of Tustin, California, APPROVING TENTATIVE TRACT NO. 10401. (S/W corner of Myford & Walnut in Tustin-Irvine Industrial Complex) Adoption as recommended by Community Development Dept. 10. RESOLUTION NO. 78-67 A Resolution of the City Council of the City of Tustin, California, APPROVING FINAL PARCEL MAP NO. 78-118 (Old City Hall site) Adoption as recommended by Community Development Dept. 11. RESOLUTION NO. 78-69 A Resolution of the City Council of the City of Tustin, DESIGNATING THE ORANGE COUNTY FIRE DEPARTMENT AS THE ISSUING AUTHORITY FOR PERMITS FOR EXPLOSIVES WITHIN THE CITY OF TUSTIN. Adoption as recommended. 12. RECOMMENDATION REGARDING SURPLUS SCHOOL PROPERTY Staff does not recommend acquisition at appraisal price. Moved by Sharp, seconded by Saltarelli that all items of Consent Calendar be appr~ved as recommended. Carried unanimously. V. ORDINANCES FOR INTRODUCTION 1. ORDINANCE NO. 773 An Ordinance of the City of Tustin, AMENDING CHAPTER 3 OF ARTICLE 9 OF THE TUSTIN CITY CODE PERTAINING TO SUBDIVISIONS. Mr. Blankenship requested continuance of this Ordinance for further staff study. ORDINANCE NO. 774 An Ordinance of the City Council of the City of Tustin, California, AMENDING TUSTIN CITY CODE TO PROVIDE FOR PARKING FOR HANDICAPPED PERSONS. Report presented byMr. Blankenship~. . ' Council discussed standards and percentage of handicapped parking required and requested that Mr. Chase look into this matter. Moved by Sharp, seconded by Saltarelli that first reading of Ordinance 774 be continued. Carried. 3. ORDINANCE NO. 775 An Ordinance AMENDING THE TUSTIN CITY CODE BY ADDING CHAPTER 7 ARTICLE 2 ENTITLED "UNIFORM TRANSIENT OCCUPANCY TAX." Moved by Sharp, seconded by Kennedy that Ordinance 775 have first reading by title only. Carried unanimously. Moved by Sharp, seconded by Schuster that Ordinance No. 775 be introduced. Carried. Moved by Sharp, seconded by LKennedy .that Ordinance No. 775 have second reading by title. Carried unanimously. Moved by Sharp, seconded by Schuster that Ordinance No. 775 be passed and adopted as an urgency ordinance. Carried by roll call. Ayes: Welsh, Schuster, Sharp, Saltarelli, Kennedy. Noes: None. Absent: None. VZ ORDINANCES FOR ADOPTION None VIZ~' OLD BUSINESS 1. CONSIDERATION OF APPOINTMENT TO H.E.R.E. BOARD OF DIRECTORS. Moved by Kennedy, seconded by Welsh that Janet La Page be appointed to Board of Directors of H.E.R.E. for one (1) year term with directive to report to Council at intervals during term. Carried. Councilman Saltarelli voting No. 2. VISION ZONES - NEWPORT AVE. NORTHERLY OF IRVINE BLVD. Report presented by Mr. Ledendecker. Moved by Saltarelli, seconded by Kennedy that Council author- ize the painting curbs on Newport, northerly of irvine adjacent to driveways as recommended by City Engineer. Carried. VIII. NEW BUSINESS 1. AWARD OF BID - YORBA ST. AHFP #929 AND 930 STREET WIDENING PROJECT. OTHER BUSINESS 1. Councilman Sharp requested that when any and all bids are sent to Council that the address of businesses be included~: Bidders in City shou~ld be given ~ome consideration. ~x. III. PUBLIC HEARINGS I. CONSIDERATION OF FRANCHISE - TUSTIN WATER WORKS Hearing opened at 7:32 p.m. There was no one present with Comments. Moved by Sharp, seconded by Schuster that hearing be continued to next regular meeting, Carried. 2. PZ 78-4 - Nisson and "B" Street - Changing Orange County R-4 to City of Tustin R-3-2000. Hearing opened at 7:34 p.m. There being no one present with comments or objections it was Moved by Sharp, seconded by Schuster that the hearing be closed and City Attorney directed to draft Ordinance approving PZ 78-4. Councilwoman Kennedy stated she would vote no on the grounds that R~4 is more restrictive. Councilman Welsh stated he would abstain due to fact that his son is buying in this area and this could be construed as a conflict of interest. Motion carried. Noes: Kennedy. Abstained: Welsh. 3. PZ 78-5 - Mobile Home Park at 15601 "B" St. - Changing from County R-4 to City MHP. Report presented by Mr. Chase. Hearing opened at 7:41 p.m. There being no one present with comments or objections it was moved by Sharp, seconded by Schuster that the hearing be Closed and the~City~Atto~ney be d~rected to prepare the necessar~erdinance approving PZ-78-i~./Carried. 6. PZ 78-15 - Apartment Complex at corner of Walnut & Red Hill Changing from County R-4 to City of Tustin R-3-3000. Report presented by Mr. Chase. Hearing opened at 7:42 p. m. There being ~no one present Vi~h comments or objections it was moved by Sharp, seconded by Schuster that hearing be closed and the City Attorney directed to prepare the necessary ordinance of approval for Pre-zone 78-15. Carried. 7. PZ 78-16 - Sycamore Garden Apartments at Newport & Sycamore from County R-4 to City of Tustin R-3-3500. Hearing opened at 7:43 p.m. There being no one present with c~mments or objections it was moved by Saltarelli, seconded by Kennedy that hearing be closed and the City Attorney directed to prepare the necessary ordinance of approval for PZ 78.16. Carried. 8. SAN JUAN BIKE TRAIL EIR 78-1 -SOuth side of San Juan From Orange Ave. to Utt Dr. Report presented by Dr. Fleagle. Hearing opened at 7:45 p.m. There being no one present with comments or objections it was moved by Saltarelli, seconded by Kennedy that hearing be closed and EIR be approved by adoption of Resolution No. 78-68. Carried. Mayor Welsh abstained. 9. RESOLUTION NO. 78-63 A Resolution of the City Council, City of Tustin, California, FINDING AND DETERMINING THAT PUBLIC INTEREST AND NECESSITY REQUIRE, AND ORDERING, THE ACQUISITION BY CONDENMATION OF CERTAIN PROPERTY FOR PUBLIC PURPOSES. (Resolution of necessity - AHFP Project #906-7 - west side of Newport north of Laguna Rd). Report presented by Mr. Ledendecker. Hearing opened at 7:49 p.m. There being no one p~esent with comments or objections it was moved by Sharp, seconded by Kennedy that hearing be closed and Resolution No. 78-63 be passed and adopted. Carried. Moved by Sharp, seconded by Saltarelli that Council adjourn to meeting of the Redevelopment Agency. REDEVELOPMENT AGENCY May 15, 1978 7:50 P.M. 1. Call to order. 2. Roll call - All members present. 3. Moved by Saltarelli, seconded by Sharp that minutes of May 1, 1978 be approved. Carried. 4. Moved by Sharp, seconded by Saltarelli that meeting be adjourned to regular meeting of the City Council. Carried. S~tary COUNCIL MEETING RECONVENED 7:55 P.M. IV. PUBLIC CONCERNS 1. Mr. Richard Edgar commended the Council, Agency and staff accomplishments of the Redevelopment Agency and the challenges for commitments ahead to above ground accomplishments. 2. Mr. Larry Bradley, business man, 12932 Newport Ave. asked if any information was available as to parking lot lighting standards. Mr. Chase stated that the new security ordinance does set forth standards but this center was an existing use and was developed in the County. Councilman Sharp suggested that the tenents fall back on Cal- OSHA to cause owner to keep parking lot in safe condition. V. COUNCIL CONCERNS 1. SANTA ANA RIVER FLOOD CONTROL AGENCY ALTERNATE Mayor Welsh offered to be alternate to Mrs. Kennedy on this agency. 2. LEGISLATION BULLETIN Mayor to submit letters opposing following bills. SB 1874 (Smith), AB 2757 (Ingalls), AB 2744 (Berman), AB 3553 (Craven). 3. WITNESS TO FITNESS Mr. Schuster reported on the success of Witness to Fitness Week and expressed his appreciation for staff help from Parks & Recreation Department. 4. PLANNING AGENCY/COUNCIL HEARINGS In answer to Councilwoman Kennedy, Mr. Chase stated that hearings to be heard by both agencies are usually scheduled at 2 week intervals although could be heard the same day if properly noti~d~, -7- Council Minutes May 15, 1978, page eight 5. TOWING AND STORAGE OF VEHICLES Chief Thayer stated tha~ only time vehicles are stored is at ownera expense. 6. ANNEXATIONS Councilman Sal~areiii congratulated staff for quick and efficient work on annexations. 7. CA TRANSPORTATION HEARINGS Council concurred that a letter should be sent to the Governor asking since when the chairman of a commission can waive the right of public hearing to citizens of California and stating that Council deplores the action of the Chairman of ~l~f0rnia Transportation Commission. VI. ADJOURN- MENT Moved by Sharp, seconded by Saltaretli that meeting be adjourned to May 16 and 17 Budget Workshops at 3:00 p.m. in Conference Room and thence to next regular meeting of June 6, 1978.
