SUBJECT: FUNDS AND AGREEMENT WITH ORICOt4 FOR DEVELOPMENT AND MANAGEMENT
OF A USED OIL COLLECTION PROGRAM
RECOMMENDATION
It is recommended that the City Council take the folloWing actions:

Adopt Resolution No. 94-63 approving an application for State
of California grant funds to establish and maintain a used oil
recycling program.
2. .Authorize the Mayor and City Clerk to execute an agreement
with ORICOM to develop and manage a used oil collection
program at a cost not-to-exceed the State approved Block Grant
if awarded.
FISCAL IMPACT
There is no fiscal impact associated with this action. Ail fees for
program development and management payable under this agreement will be
paid from grant monies received.
BACKGROUND AND DISCUSSION
The California Recycling Enhancement Act of '1991 establishes and
provides grant funding for programs that increase the proper collection
and recycling of used motor oil. One of these programs is the
California Used Oil Recycling Block Grant Program for Local Governments.
The purpose of this program is t° provide funding to local governments
for establishing used oil collection programs and locally based used oil
collection centers. Applicants must demonstrate that they currently or
will have at least one certified used oil collection center for every
100,000 residents not serviced by curbside used oil collection.
At the present time, the City of Tustin does not have curbside
collection of used oil. Presently, residents are encouraged to take
their used oil to one of the County of Orange sponsored drop-off centers
or to one of a few non-certified collection centers that exist in the
City. If the City is successful in obtaining funding for such a grant,
the number of local collection centers for used oil will be increased.
In addition to the development of collection centers in Tustin, current
public education efforts will be expanded and focused on decreasing the
illegal dumping of used oil into the landfills, storm drains, and sewer
systems. Further, a used oil collection program and the associated
public education will assist the City in compliance with the National
Pollutant Discharge Elimination System (NPDES) and AB939.
Staff is recommending the services of ORICOM, a consulting firm located
in Anaheim, to develop and submit a grant application on behalf of the
City. Development and submittal of the grant will be at no cost to the
City. If the application is successful, ORICOM will be responsible for
development and management of the City's used oil recycling program.
All program costs will be paid from grant funds. ORICOM was selected to
provide this service because of their expertise in this area. The
application and program implementation requirements for the grant are
such that City staff resources are not adequate to meet the demands of
the State. ORICOM will submit the grant application on the City's
behalf at no charge. Once the funding is approved for Tustin, ORICOM
will implement the program and will be paid for with grant funds. At
this time, no other company has been identified with similar
qualifications.
~ONCLUSION
To proceed with the development of the grant application, it is
necessary for the City Council to adopt Resolution No. 94-63 approving
an application for State grant monies. Additionally, the agreement with
ORICOM for program development and management is required.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA APPROVING ANAPPLICATION FOR GRANT FUNDS FROM
THE CALIFORNIA USED OIL RECYCLING BLOCK GRANT PROGRAM TO
DEVELOP AND MAINTAIN A USED OIL RECYCLING PROGRAM
WHEREAS, the people of the State of California have
enacted the California Oil Recycling Enhancement Act that
provides funds to cities and counties for establishing and
maintaining local used oil collection programs that encourage
recycling or appropriate disposal of used oil; and
WHEREAS, the California Integrated Waste Management Board
(IWMB) has been delegated the responsibility for the
administration of the program within the state, setting up
necessary procedures governing application by cities and
counties under the program; and
WHEREAS, said procedures established by the California
Integrated Waste Management Board require the applicant to
certify by resolution the approval of application before
submission of said application 'to the state; and
WHEREAS, the applicant will enter into an agreement with
the State of California for development of the project.
NOW, THEREFORE, the City cOuncil of-the City of Tustin
determines and orders as follows:
Section 1. Approves the filing of an application for the
California Used Oil Recycling Block Grant Program under the
California Oil Recycling Enhancement Act for state grant
assistance for the project specified above: and
Section 2 Appoint the Director of Public Works as agent
of the City of TUSTIN to conduct all negotiations, execute and
submit all documents including, but not limited to,
applications, agreements, amendments, payment requests and so
on, which may be necessary for the completion of the
aforementioned project.
.Section 3. The City will retain the services of the
ORICOM Group of Anaheim, CA, to develop and implement a used
oil program as approved by the State of California, Integrated
Waste Management Board.

The State of Califomia has made available block grant funds based upon the population
of your city. The 1994/95 program provides $0.44 per person based upon a population
survey provided by the Integrated Waste Management Board.
PROPOSAL COMPLETION DATE
May 20, 1994, we must have your answer by May 10, 1994
FUNDS ARE AVAILABLE
After JUly 1, 1994 through June 30, 1995
PROPOSAL DEVELOPMENT
ORICOM will develop, implement and manage the program through June 30, 1995.
There is no charqe for preparation of the proposal since the city will agree to pay
ORICOM for services rendered to develop, implement and manage the program upon
acceptance by the Integrated Waste Management Board as proposed. The State of
California, Integrated Waste Management Board wilt provide 100% of funds. No funds
are required at any time from the City.
PROPOSAL
This proposal is designed to provide a substantial level of support for the recycling of
used oil in your community. The program is multi-faceted designed for different phases
to occur throughout the year.
The following are major points of the Program:
· Identify potential collection centers. ORICOM will continue to identify potential
collection centers throughout the area to supplement the Opport~ity Grants.
· Used oil containers. A very smalI portion of the funds will be used to provide a
discount for retailers who participate in the purchase of containers which will be made
available to the public at no charge for the purpose of transporting used 'oil.
· Outreach. A significent percentage ~of the budget will be used to support an outreach
program which includes signs, banners and other information notifying the public
where they can dispose of used oil. A multilingual media campaign will communicate
to the public that used oil should not be improperly disposed of. The greatest
expendature will be placed in this area.

$ Newsletter. A newsletter will communicate the program to collection centers,
nonprofit organizations, news organizations and to city departments. The newsletter
is produced in all ORICOM client cities (cost's are shared). Information obtained in
other cities will be included. The large circulation reduces cost and provides greater
sources of information.
· Training. Employees will receive adequate training on how to handle used oil
received from the public including the completion of paperwork.
· Quarterly reports. ORICOM will complete quarterly reports for certified centers to
ensure that they are accurately filled out and submitted on time.

· Non-profit organizations. Substantial use of non-profit organizations i.e. Girl Scouts,
Boy Scouts will be employed to pass out information to the public. A significant portion
of this will be door-to-door.
· School outreach. This is a program segment which includes furnishing equipment
to the schools for the collection of used oil by the auto shop and students who wish
to bring it to school. This segment includes an educational material portion including
a video tape(cost sharing with other ORICOM cities).
· Associate recycling centers. This concept is explained more thoroughly in another
section
EVALUATION
Postage paid response cards will be provided to the first 200 consumers who bring their
used oil back to the various centers. The cards, when completely filled out and mailed
back to ORICOM, will entitle the respondent to the next oil change at no charge. The
retailer will co-op this so that the cost is relatively insignificant, at no mom than $3.00
per person. This program is a suggestion only and actual implementation will vary from
this example.
CITY RISKS
There is no dsk to your city. The used oil collected becomes the responsibility of the
center upon receipt from the public. The center is under agreement with the State of
California. The city in no way accepts any responsibility for used oil. Further, our
training program will help to reduce spills and other problems.

an agreement with ORICOM to develop and manage a used oil collection program at a cost not-to-
exceed state approved Block Grant Proposal.
DISCUSSION
The California Recycling Enhancement Act of 1991 establishes and provides grant funding for programs that
increase the proper collection and recycling of used oil. One of these programs is the California Used Oil
