HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPAR~ SUBJECT: THOMPSON OWNER PARTICIPATION AGREEMENT RECOMMENDATION It is recommended the City Council: I · Adopt Resolution No. 94-70 certifying a Negative Declaration dealing with the adoption of the Owner Participation Agreement; · Adopt an Owner Participation Agreement providing $27,120 in financial assistance for the rehabilitation of the facade of the building at 100 West Main Street; and FINANCIAL IMPACT The Owner Participation Agreement requires an allocation of funds by the Redevelopment AgencY, which is fully discussed in the report found in the Agency Agenda~- ~While the~City is also a party to the agreement due to the project's previous allocation of federal CDB'G funds, there is no impact on city general funds resulting from this --Agreement. Shi~leton joev~Tment Program Manager Assistant City ~nager CAS: RZ~/kbc \ thmpopa, rz 5 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 94-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR THE ADOPTION OF AN OWNER PARTICIPATION AGREEMENT FOR THE IMPROVEMENT ON OF THE PROPERTY AT 100 WEST MAiN STREET INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: ae The proposed adoption of an owner participation agreement for the improvement of the property at 100 West Main Street is considered a "project" pursuant to the terms of the California Environmental Quality Act. Be Ce De A Negative Declaration has been prepared for this project and· has been distributed for public review. The City Council has considered evidence presented .'by the Community Development Director and other interested parties with respect to the subject Negative Declaration. The City Council has evaluated the prOposed final Negative Declaration and determined it to be adequate and complete. II. A Final Negative Declaration has been completed in compliance with CEQA and State guidelines. The City Council, having authority over the approval of the owner participation agreement for the improvement of the property at 100 West Main Street, has received and considered the information contained in the Negative Declaration, prior to approval of the proposed project, and found that it adequately discussed the environmental effects of the proposed project. The City Council has found that the project involves no potential for an adverse effect, either individually or cumulatively, on wildlife resources and makes a De Minimis Impact.Finding related to AB3158, Chapter 1206, Statutes of 1990.
