HUSTON, CITY.MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: AWARD OF GRAFFITI REWARD RECOMMENDATION It is recommended that the City Council award a $250.00 reward out of non-departmental funds to an anonymous witness for his actions. leading to the prosecution of a juvenile graffiti Vandal. FISCAL IMPACT The reward requested would .appropriate $250.00 in non-departmental funds. BACKGROUND Article 5, Chapter 7 of the Tustin City Code' regulates the occurrence of graffiti within the City of Tustin. Section 5708 of that Code provides for the issuance of a reward to individuals providing information resulting in the arrest of the individuals responsible for the vandalism. On February 1, 1993, the Tustin City Council formally established a graffiti 'reward amount of $250.00 to encourage individuals to provide information to the police leading to the arrest of graffiti vandals in the City. On March 28, 1994, the eyewitness saw a juvenile offender spray painting graffiti on the wall of the flood channel at Red Hill Avenue. He reported the incident to the Tustin Police Department and requested that his identity remain confidential, city staff has respected his desire for anonymity. .The Orange County Sheriff's Department is coordinating with the Tustin Police on this and a second, related case involving the same juvenile. Petitions have been filed requesting that charges be brought against the youth. City Council Report Award of Graffiti Reward May 16, 1994 Page 2 CONCLUSION The eyewitness' report and willingness to assist the Tustin Police Department directly resulted in charges being filed against a graffiti vandal. Because this case involves the Prosecution of a minor, it is impractical to track it through the courts until confirmation of a conviction is obtained. Staff believes that requirements set forth in Tustin City Code Section 5708 have been fulfilled and recommends that Council award a $250.00 reward to the witness for his assistance in this matter.
