Re: MCAS -Tustin Property - Legacy Project — 10 -Acre Site No. 1 Proposed I/M Agreement
Dear Ms. Binsack:
Thank you for your assistance in regard to the School Facilities Project relating to the
participating properties in the Legacy Project. In regard to the request relating to the preparation
of an amendment to the Tustin Legacy Specific Plan ("T/LSP") (formerly called the MCAS
Tustin Specific Plan) and on-going planning and land use matters, the City of Tustin ("City") has
requested a letter from the Tustin Unified School District ("TUSD") on behalf of the Board of
Education of TUSD ("Board") pertaining to the future need for the 10 -acre "Site No. 1," as
related to the school facility needs for the T/LSP. As noted, in the proposed School Facilities
Implementation, Funding and Mitigation Agreement between TUSD, the City of Tustin and
others ("I/M Agreement") the need for the described Site No. I is addressed. Subject to the
concurrent execution and performance by the District and the City of the I/M Agreement, the
Joint Community Facilities Agreement by and among Tustin Unified School District,
Community Facilities District No. 2014-1 of the City of Tustin and Standard Pacific Corp.
("TUSD/JCFA"), and formation of proposed CFD No. 15-1 of Tustin Unified School District
("CFD No. 15-1 "), please be advised as follows with regard to the pending update of the T/LSP.
Based on the proposed amendment to the T/LSP and the related land use designations,
including additional development within the area of T/LSP as relating to school facility needs
and as described to TUSD, an estimated maximum total of 5,751 dwelling units is being
contemplated to be built on the former MCAS property consisting of 4,993 dwelling units within
the participating CFD projects (TUSD/CFD, CFD No. 2014-1 of the City, CFD No. 06-1) and
758 dwelling units from other nonparticipating projects.
TUSD believes that based on the performance of the I/M Agreement and the
TUSD/JCFA by the parties thereto, TUSD will be able to meet the needs of the former MCAS
property developments present and future K-12 students generated to the extent of the proposed
amendment of the T/LSP future expansion thereby as deferred by TUSD by means of the
Heritage School (current capacity of 600 students) and possible expansion thereof, the proposed
6-12 school (with a capacity of 1,200 students) as described in the I/M Agreement and other
TUSD schools without the need of the 10 Acre site (Site No. I described in the I/M Agreement).

In summary, based on the City's proposed amendment to the T/LP and related Land Use
Designations and the concurrent execution of the I/M Agreement between the City and TUSD,
and the TUSD/JCFA, Site No. 1 is determined not to be needed by the District to meet the
expected growth within the appropriate portion of the T/LSP. However, per our conversation on
April 1, 2015, if the noted agreements are not approved and signed, such would not be the case
as to Site No. 1, and the present existing needs and development assumptions would be
applicable to the grade K-12 needs of TUSD.
We look forward to execution of the I/M Agreement, TUSD/JCFA and formation of
proposed CID No. 15-1 of TUSD in the near future, prior to the approval by the City of its
updated General Plan described herein in the later part of this year.
