PUBLIC HEARINGS (ITEMS I THROUGH 4 1, VESTING TENTATIVE TRAC~i' MAP 14168 (CALIFORNIA PACIFIC HOMES) The applicant' proposes to subdivide a 10.582 gross acre site into 69. numbered lots to accommodate 69 detached single family dwelling units at the northwest corner of Tustin Ranch Road and Township Drive. Recommendation by the Community Development Department: a. Approve the environmental determination for the project by adopting the following Resolution No. 94-47: b. RESOLUTION NO. 94-47 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING 'THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85- 2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) iS· ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE TRACT MAP NO. 14168, AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT Approve Vesting Tentative Tract Map No. 14168 by adopting the following Resolution No. 94-48, as submitted or revised: Council Agenda I May 2, 1994 . e . RESOLUTIOI~ ~. 94-48 - A RESOLUTION OF ~ CITY COUNCIL OF THE CITY OF TUS~IN, CALIFORNIA, APPROVING V=o~'ING TENTATIVE TRACT MAP NO. 14168 APPEAL OF LICENSE AND PERMIT BOARD DECISION REGARDING CANDICE TOWING The City has received an appeal of a License and Permit Board decision related to the operation of a.tow truck service. The License and Permit .Board acts as an appeals board on administrative decisions made concerning the-granting, denial, suspension or revocation of permits related to City business licensing. ~ Recommendation: Uphold the March 7, 1994 City of Tustin License and Permit Board decision regarding Candice Towing Service and deny the appeal filed by the business owner as recommended by the Community Development Department. CODE AMENDMENT 94-1, OFFICE OF THE ZONING ADMINISTRATOR A zoning Administrator is a staff member within the City who would have the designated authority to administer portions of the Zoning Ordinance and to iSsue certain discretionary permits (i.e. variances, conditional use permits, etc.). Recommendation by the Community Development Department: a. Approve the Environmental Determination for the project by adopting the following Resolution No. 94-46: ' ~ be RESOLUTION NO. 94-46 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY' OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE-~' DECLARATION AS ADEQUATE FOR CODE AMENDMENT 94-1' INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT " Have first reading by title only and introduction of the following Ordinance No. 1116 approving Code Amendment 94-1, as submitted or revised: ORDINANCE NO. 1116 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 9299, A PORTION OF CHAPTER 2 OF ARTICLE 9 OF THE TUSTIN CITY CODE RELATED TO THE OFFICE OF THE ZONING ADMINISTRATOR REDUCED DISCRETIONARY APPUCATION FEES . Resolution No. 94-42 with the Revised Services Charge and Planning Fee Schedule represents the corrected fee categories from previously adopted Resolution No. 94- 29. Recommendation: Adopt the following Resolution No. 94-42 modifying certain 'service charges and planning fees as recommended by the Community Development Department: Council Agenda 2 May 2, 1994 RESOLUTION NO. ~__/~2 - A RESOLUTION OF THE CITI,.. ~UNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING A REVISED SCHEDULE FOR PLANNING FEES AND SERVICE CHARGES WITHIN THE PLANNING DIVISION OF THE COMMUNITY DEVELOPMENT DEPARTMENT CONSENT CALENDAR ( ITEMS 5 THROUGH 18 ) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. Be APPROVAL OF MINUTES - APRIL 19, 1994 REGULAR MEETING Recommendation: Approve the City Council Minutes of April 19, 1994. Se APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,540,329.67 and ratify Payroll in the amount of $305,270.80. RESOLUTION NO. 94-45 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ORDERING THE PREPARATION OF AN ENGINEER'S REPORT FOR THE LEVY OF ANNUAL ASSESSMENTS FOR THE 1994-95 FISCAL YEAR FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT Recommendation- Adopt Resolution No: 94-45 ordering the preparation of an Engineer's Report for the levy of annual assessments for the 1994-95 fiscal year for the Tustin Landscape and Lighting District as recommended by the Public Works Department/Engineering Division. Se . RESOLUTION NO. 94-44 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY-OF TUSTIN, CALIFORNIA, APPROVING PARCEL MAP NO. 93-177 ..... Recommendation: Adopt Resolution No. 94-~.~. approving Final Parcel Map No. 93- 177 as recommended by the Community Development. Department. REJECTION OF CLAIM NO. 94-16 - CLAIMANT, ROBERT BULOT; DATE OF LOSS, 10/21/93; DATE FILED WITH CITY, 4/11/94 Recommendation: Reject subject claim for property and general damages in the amount of $12,800.00 as recommended by the City Attorney. 10. RESOLUTION NO. 94-43 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING AN ADDENDUM TO APPLICATION BY THE CITY OF TUSTIN TO THE U.S. DEPARTMENT OF THE INTERIOR FOR THE PUBLIC BENEFIT TRANSFER OF SURPLUS FEDERAL REAL PROPERTY FOR PARKS/ RECREATIONAL USE Recommendation: Adopt Resolution No. 94-43 approving an addendum to the City's previous application to the U.S. Department of the Interior for the public benefit transfer of surplus Federal real property (MCAS, Tustin) for parks/recreational use by the City as recommended by the Community Development Department. 11. RESOLUTION NO. 94-50 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR WATER MAIN REPLACEMENT PROJECTS (CITY PROJECT NO. 600121 ) AND AUTHORIZING ADVERTISEMENT FOR BIDS Council Agenda 3 May 2, 1994 Recommendation: Opt Resolution No. 94-50 appr¢, ~1 plans and specifications and authorizing advertisement for bids for subject project as recommended by the Public Works Department/Water Division. 12. RESOLUTION NO. 94-53 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR VANDENBERG WELLHEAD FACILITIES (CITY PROJECT NO. 600065) AND AUTHORIZING ADVERTISEMENT FOR BIDS Recommendation: Adopt Resolution No. 94-53 approving plans and specifications and authorizing advertisement for bids for subje _ct project; and authorize the use of certificate of participation proceeds for completion of the unreimbursed portion of the project as recommended by the Public Works Department/Water Division. 13. RESOLUTION NO. 94-51 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING THE LOCATION OF CERTAIN ALL-WAY STOP CONTROL INTERSECTIONS Recommendation: Adopt Resolution No. 94-51 authorizing the installation of all-way stop sign controls at the intersection of Sixth Street and Pacific Street per Figure 1 of the subject Traffic Study as recommended by the Public Works Department/ Engineering Division. 14. 15. RESOLUTION NO. 94-52 - A RESOLUTION OF THE CITY COUNCIL OF -THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING THE LOCATION OF CERTAIN ALL-WAY STOP CONTROL INTERSECTIONS Recommendation: Adopt Resolution No. 94-52 authorizing the installation of all-way stop sign controls at the easterly Auto Center Drive intersection near El Camino Real per Figure 1 of the subject Traffic Study as recommended by the Public Works Department/Engineering Division. TUSTIN TENNIS CLUB AGREEMENT Recommendation: Authorize the City Manager to execute subject agreement between the City and the Tustin Tennis Club for use of the Magnolia Tree Park tennis courts as recommended by the Community Services Department. 16. PLANNING COMMISSION ACTION AGENDA - APRIL 25, 1994 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of April 25, 1994. 17. TUSTIN SPORTS PARK- TRANSFER OF EXCESS SOILS AGREEMENT BETWEEN THE TUSTIN UNIFIED SCHOOL DISTRICT AND THE CITY OF TUSTIN Recommendation: Authorize the City Manager to execute subject agreement to transfer excess soils from the Tustin Sports Park si~e to the Tustin Ranch Elementary School site as recommended by the Community Services Department. 18. RESOLUTION NO. 94-49 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR WATER MAIN REPLACEMENT FOR 17TH STREET AND BRENAN WAY (CITY PROJECT NO. 600116) AND AUTHORIZING ADVERTISEMENT FOR BIDS Recommendation: Adopt Resolution No. 94-49 approving plans and specifications and authorizing advertisement for bids for subjec[ project as recommended by the Council Agenda 4 May 2, 1994 Public Works Dep~ ~nt/Water Division. REGULAR BUSINESS ( ITEMS 19 THROUGH 24 ) 19. AUDIT COMMITTEE VACANCY Mayor Pro Tem Pot"ts has requested the City Council discuss the vacancy on the Audit Committee created by the resignation of Jerry VVeil. Recommendation: Pleasure of the City Council. 20. CITY PARKS - PARKING REQUIREMENTS Councilmember Worley has requested the City Council discuss the City's policies regarding on and off-street parking at City parks. Recommendation- Pleasure of the City Council. 21 TERM LIMITS Mayor Pro Tem Potts has requested the City Council discuss the drafting of an ordinance which would impose term limits for members of the City Council; and he requested the City Council receive a copy of the City of Orange resolution requesting the State Legislature enact legislation enabling general-law cities to impose term limits. ' Recommendation: Pleasure of the City Council. ., 22. GIFT BAN ORDINANCE Councilmember Doyle has requested the City Council discuss the County's gift ban ordinance and the City's current conflict of interest code. Recommendation: Pleasure of the City Council. 23. COMMITTEE APPOINTMENTS Mayor Saltarelli has requested that this item be placed on the agenda in order that he can make appointments to the Committees on which members of the City Council .- . serve. · . Recommendation: Pleasure of the Mayor. 24. ASSET FORFEITURE FUND The current communications systems within the Police Department are antiquated, subject to continual breakdowns, and not sufficient to meet the demands of service within the City of Tustin. Recommendation: (1) Authorize $1,135,193.00 from the Asset Forfeiture Fund to the Capital Improvements Fund for the new police communications system, and (2) Council Agenda 5 May 2,'1994 Authorize the ap[ riation of $155,794.00 of Pro tion 172 Funds for three additional police c~f]munications officer positions as ~ecommended by the Police Department. OTHER BUSINESS - City Manager, City Attorney, City Council CLOSED SESSION- During the course of conducting the business set forth on this agenda at a regular meeting of the City Council, the Council may convene in Closed Session to consider matters of pending or potential litigation, or personnel matters, pursuant to Government Code Sections 54956.9 or 54957.6. Reports relating to (a) purchase and sale of real property, (b) matters of pending or potential litigation, (c) employee compensation, or Which are exempt from public disclosure under the California Public Records Act, may be reviewed by the Council during a permitted Closed Session and are not .available for public inspection.
