HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: U.S. DEPARTMENT OF THE INTERIOR (DOI) ADDENDUM TO APPLICATION FOR PUBLIC BENEFIT TRANSFER OF SURPLUS FEDERAL REAL PROPERTY RECOMMENDATION It is recommended that the City Council adopt Resolution No. 94-43, approving an addendum to the City's previous application to the U.S. Department of the Interior (DoI) for the public benefit transfer of surplus Federal real property (MCAS, Tu~tin) for parks/recreational use by the City. FISCAL IMPACT Public benefit transfer of this additional property would allow the City to potentially obtain the land area at no or. below market cost. The addendum application requesting the transfer of surplus property from MCAS, TuStin for public benefit will not result in an immediate fiscal impact to the City of Tustin.- Between the time of application apprgval (estimated early 1995) to the time that formal property acquisition would occur (estimated in mid-1997), a complete fiscal analysis would be prepared for the Council's consideration and approval. BACKGROUND/DISCUSSION As Council is aware, Marine Corps Air Station .(MCAS), Tustin is scheduled to close by July 1997- In compliance with federal base closure law, the Navy has initiated the process of advertising the property for future conveyance to military branches, federal agencies, and state and local entities. On February 22, 1994, City Council authorized the submittal of an application to the federal Department of the Interior (DoI) to request the public benefit conveyance of approximately 25 acres of property located in the northwest portion of the base which currently serves as the recreation area for military personnel. Since the submittal of the City's original application, the Base Closure Task Force has identified additional land areas that could be transferred under the public benefit transfer regulations for park and recreational use. As a result, staff has prepared an addendum application to request the public benefit transfer of land area for two 4-acre neighborhood park sites, right-of-way for City Council Report DoI Addendum Application May 2, 1994 Page 2 bicycle/ equestrian and hiking trails adjacent to and through the site, and areas within the base for environmental remediation that must remain in open space with the possibility of their use for public environmental education programs. At their March 31st meeting, the Base Closure Task Force formally took action to recommend approval of this additional public benefit transfer on behalf of the City. Similar to the original DoI application request, an addendum to the application requires City Council authorization for submittal and designation of an individual to act on behalf of the City. Resolution No. 94-43 has been prepared in accordance with DoI requirements to indicate this support. CONCLUSION It is important for the City to participate in this phase of the Federal screening process to ensure that base properties with potential public parks/recreational re-use value are made available for potential acquisition. Since. submission of the addendum application request to the D°I does not obligate the City at this time but provides an opportunity for future public benefit conveyance at potentially no cost, it is recommended that the City Council adopt Resolution No. 94-43, as submitted..? Bo~ nne~ ~ Associate Planner : ab\CCREPORT\doiappad.aeb Attachments: Resolution No. 94-43 1 RESOLUTION NO. 94-43 10 11 12 13 14 16 17 18 19 20 21 22 23 24 25 26 28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING AN ADDENDUM TO APPLICATION BY THE CITY OF TUSTIN TO THE U.S. DEPARTMENT OF THE INTERIOR FOR THE.PUBLIC BENEFIT TRANSFER OF SURPLUS FEDERAL REAL PROPERTY FOR PARKS/RECREATIONAL USE The City Council of the City of Tustin does hereby resolve as follows: WHEREAS, certain real property owned by the United States of America, located in the City of Tustin, County of Orange, State of California, has been declared surplus and at the discretion of the General Services Administration, may be assigned to the Secretary of the Interior for disposal for public park or recreation purposes, under the provisions of Section 203(k) (2) of the Federal Property and Administrative Services Act of 1949 (63 Stat. 387), as amended, and rules and regulations promulgated pursuant thereto, more particularly described as follows: (1) Marine Air Corps Station (MCAS), Tustin (2) GSA Control Number: not assigned (3) The addendum to the City of Tustin's original application is to include the following conveyances: a · Any land area needed for additional right-of- way for bicycle/equestrian and hiking trails adjacent and through the site. b· Land area for development of approximately two 4-acre neighborhood parks as conceptually shown in Exhibit A attached hereto. C · Any areas within the base for environmental remediation that must remain in open space with the possibility of their use for public environmental education programs. WHEREAS, the City of Tustin, needs and will utilize said property in perpetuity for a public park or recreation area as set forth in its application and in accordance with the requirements of said Act and the rules and regulations promulgated thereunder; NOW, THEREFORE, BE IT RESOLVED, that the City of Tustin shall make application to the Secretary of the Interior for and secure the transfer to it of the above mentioned property for said use upon and subject to such exceptions, 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 94-26 Page 2 reservations, terms, covenants, agreements, conditions, and restrictions as the Secretary of the Interior, or his authorized representative, may require in connection with the disposal of said property under said Act and the rules and regulations issued pursuant thereto; and BE IT FURTHER RESOLVED, that the City of Tustin has legal authority, is willing and is in a position to assume immediate care and maintenance of the property, and that William A. Huston, City Manager, or his designee, is hereby authorized, for and on behalf of the City of Tustin to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution, including the preparing, making, and filing of plans, applications, reports, and other documents, the execution, acceptance, delivery, and recordation of agreements, deeds, and other instruments pertaining to the transfer of said property, including the filing of copies of the application and the conveyance documents in the records of the governing body, and the payment of any and all sums necessary on account of the purchase price thereof or fees or costs incurred in connection with the transfer of said property for survey, title searches, recordation or instruments, or other costs identified with the Federal surplus property acquisiti0n.
