CALL TO ORDER/PLEDGE OF ALLEGIANCE/INVOCATION
The meeting was called to order by Mayor Potts at 7:00 p.m. at the Council
Chambers, 300 Centennial Way, Tustin, California. The Pledge of
Allegiance was led by Mayor Pro Tem Saltarelli. The Invocation was given
by Councilmember Puckett.

BUS SHELTERS
Richard Wannenmacher, Gannett Transit representative, requested to
comment on Consent Calendar Item No. 15, Approval of Request for
Proposals for Advertising Bus Shelters.
CONSENT C~T.RNDAR (ITEMS I THROUGH 17)
Items No. 6 and 15 were removed from the Consent Calendar by Councilmember
Thomas. It was moved by Puckett, seconded by Pontious, to approve the
remainder of the Consent Calendar as recommended by staff. Motion carried
5-0.

APPROVAL OF MINUTES - MARCH 21, 1994 REGULAR MEETING
Recommendation: Approve the City Council Minutes of March 21,
1994.

APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $2,529,961.52
and ratify Payroll in the amount of $309,765.31.

RESOLUTION NO. 94-36 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING THE APPLICATION FOR BICYCLE
AND/OR PEDESTRIAN FACILITY FUNDS UNDER SB 821
Recommendation: Adopt Resolution No. 94-36 approving the
application for Bicycle and/or Pedestrian Facility Funds under SB
821 as recommended by the Public Works Department/Engineering
Division.
APPROVAL OF REQUEST FOR SERVICES FOR RECONNAISSANCE SURVEY OF
STORM DRAIN SYSTEM
Recommendation: Approve subject Request for Services' for the
reconnaissance surveying of the pipes thirty-nine inches (39") or
larger in the City's storm drain system as recommended by the
Public Works Department/Engineering Division.
RESOLUTION NO. 94-35 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING AN APPLICATION FOR GRANT
FUNDS FROM 'THE CALIFORNIA USED OIL RECYCLING OPPORTUNITY GRANT
PROGRAM TO DEVELOP AND MAINTAIN A USED OIL RECYCLING PROGRAM
Recommendation: (1) Adopt Resolution No. 94-35 authorizing the
application for State grant funds to establish and maintain a used
oil recycling program and (2) Direct the City Attorney to prepare
and authorize the Mayor to execute an agreement with ORICOM to
develop and manage a used oil program at no cost to the City as
recommended by the Public Works Department/Engineering Division.
STATUS REPORT REGARDING SENATE BILL 1296 AS IT AFFECTS NEWSRACKS
WITHIN THE CITY OF TUSTIN
Recommendation: Receive and file subject report as recommended by
the Public Works Department/Engineering Division.
RESOLUTION NO. 94-38 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR WATER MAIN
REPLACEMENT ON NEWPORT AVENUE BETWEEN WALNUT AVENUE AND KENYON
DRIVE
Recommendation: Adopt Resolution No. 94-38 accepting the work of
improvements and authorizing the recordation of the Notice of
Completion for the subject project as recommended by the Public
Works Department/Engineering Division.
DECLARATION OF SURPLUS FURNITURE
Recommendation: Declare specified furniture/equipment surplus and
not required for public use and authorize the City's purchasing
agent to dispose of the items in accordance with Ordinance No. 871
as recommended by the Public Works Department/Engineering
Division.
REJECTION OF CLAIM NO. 94-10 - CLAIMANT, HILDA KRAMER; DATE OF
LOSS, 2/10/94; DATE FILED WITH CITY, 3/4/94
Recommendation: Reject subject claim for personal injury damages
of an undetermined amount as recommended by the City Attorney.
DECLARATION OF SURPLUS VEHICLES AND WORK EQUIPMENT
Recommendation: Declare specified equipment surplus and not
required for public use and authorize the Public Works Department

to dispose of the equipment in accordance with Ordinance No. 871
as recommended by the Public Works Department/Field Services
Division.

RESOLUTION NO. 94-39 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, URGING THE DISTRICT ATTORNEY'S OFFICE
AND THE COURTS TO ADOPT A "ZERO TOLERANCE POLICY" FOR PERSONS
FOUND GUILTY OF ILLEGAL GUN POSSESSION
Recommendation: Adopt Resolution No. 94-39 supporting a "zero
tolerance policy" for persons found guilty of illegal gun
possession as recommended by the Police Department.

RESOLUTION NO. 94-37 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR
THE JAMBOREE ROAD WIDENING BETWEEN EL CAMINO REAL AND THE I-5
FREEWAY NORTHBOUND ON-RAMP, AND AUTHORIZING THE ADVERTISEMENT FOR
BIDS
Recommendation: Adopt Resolution No. 94-37 approving the plans
and specifications for subject project and directing the City
Clerk to advertise for bids as recommended by the Public Works
Department/Engineering Division.

AMENDMENT TO COOPERATIVE AGREEMENT NO. D93-131 FOR THE WIDENING OF
THE APPROACHES TO THE SEVENTEENTH STREET OVERCROSSING OF THE SR-55'
FREEWAY
Recommendation: Approve subject amendment and authorize the Mayor
and City Clerk to execute the Amendment to Cooperative Agreement
No. D93-131 as recommended by the Public Works
Department/Engineering Division.

PLANNING COMMISSION ACTION AGENDA - MARCH 28, 1994
Ail actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of
March 28, 1994.

INVESTMENT REPORT AS OF FEBRUARY 28, 1994
Recommendation: Receive and file subject report as recommended by
the Finance Department.
CONSENT CALENDAR ITEM NO. 6 - PROFESSIONAL SERVICES AGREEMENT FOR
CONSULTING ENGINEERING SERVICES ON THE NEWPORT AVENUE/SR-55 INTERCHANGE
RECONFIGURATION PROJECT
Councilmember Thomas requested clarification regarding a prior agreement
between the City and Caltrans referenced in the staff report.
Christine Shingleton, Assistant City Manager, responded that the previous
agreement was between the City and Catellus which set up the project
framework. She explained that during meetings with staff, Caltrans raised
concern over several issues in the scope of work which subsequently had
been satisfactorily modified. In addition, she noted that Dokken
Engineering would report directly to the City Engineer providing city
control over the project scope of work.

It was moved by Thomas, seconded by Puckett, to authorize the Mayor and
City Clerk to execute a Professional Services Agreement with the firm of
Dokken Engineering to prepare and process a Project Study Report for
approval by Caltrans for the Newport Avenue/SR-55 Interchange Northbound
Ramp Reconfiguration Project in the amount of $173,000.00.
Motion carried 5-0.
CONSENT CALENDAR ITEM NO. 15 - APPROVAL OF REQUEST FOR PROPOSALS FOR
ADVERTISING BUS SHELTERS
The following member of the audience noted several concerns regarding the
Bus Shelter Request for Proposal (RFP):
Richard Wannenmacher, Gannett Transit representative (submitted
bus shelter RFP comments)·
Mayor Potts and Councilmember Thomas requested staff conduct additional
study on this issue and present the information at a future Council
meeting.
William Huston, City Manager, recommended continuing this item to the May
2, 1994 Council meeting which would allow staff time to prepare a report
addressing the speaker's concerns.
It was moved by Thomas, seconded by Pontious, to continue this item to the
May 2, 1994 Council meeting.
Motion carried 5-0.
PUBLIC INPUT - None
OTHER BUSINESS
APRIL 12, 1994 MUNICIPAL ELECTION
Councilmember Thomas wished all candidates good luck in the April
12, 1994-election.
Councilmember Puckett encouraged everyone to vote on April 12,
1994.
RESERVE POLICE OFFICERS ASSOCIATION GOLF TOURNAMENT
Mayor Potts announced that a Reserve Police Officers Association
Golf Tournament would be held on May 9, 1994.
CITIZEN COMMENDATION - POLICE OFFICER FREI
Mayor Potts announced he had received a letter from a citizen
commending Officer Frei for administering CPR while attempting to
save the life of the citizen's father.

SERGEANT MICHAEL SHANAHAN
Councilmember Puckett noted an article in the Advocate newsletter
regarding Sergeant Shanahan's recent life-saving efforts.
CLOSED SESSION - None
ADJOURNMENT
Mayor Potts adjourned the meeting at 7:15 p.m. The next regular meeting
of the City Council was scheduled for Tuesday, April 19, 1994, 7:00 p.m.,
at the Council Chambers, 300 Centennial Way.
