SUBJECT: CERTIFIED LOCAL GOVERNMENT 1994 GRANT APPLICATION
RECOMMENDATION
It is recommended that the City Council take the following actions:

Adopt Resolution No. ~4-41 authorizing the filing of an
application to the State Office of Historic Preservation for
a Certified Local Government grant to be used for:
the preparation of a seismic retrofit plan for the Utt
Juice Company Complex, and
attendance at the Sacramento CLG Workshop slated for
October, 1994, by members of the Cultural Resources
Advisory Committee and support staff.

Authorize the Assistant City Manager or her authorized
representative as the agent for the City for the scope of the
grant project(s).
3. Agree that all required local matching funds or in-kind
services be provided by the City for the proposed project.
FISCAL IMPACT
The submittal of the grant applications at this time does not
result in a direct fiscal impact to the City. Should both grant
proposals receive funding, the City would have to demonstrate the
use of matching funds during the administration of the project at
a minimum rate of 40% of the total project cost. The City's
matching fund share for the seismic retrofit plan is estimated to
be $11,844.96 and is estimated to be $1,087.00 for the workshop
attendance. One, both or neither of the proposals could receive
funding with a respective cost to the City.

BACKGROUND/DISCUSSION
Each year federal National Park Service funds are made available as
grants to local agencies for the purpose of fostering historic
preservation within their communities. A certain percentage of
these monies are earmarked for communities recognized for their
preservation efforts as Certified Local Governments (CLG). For the
1994 federal fiscal year approximately $125,000.00 in funds are
estimated to be made available to qualified CLGs. Tustin has been
recognized as a CLG since July 31, 1991, and is eligible to compete
for this year's grant awards. For the 1992 grant funding year,
Tustin was awarded $7,500 for the production of an educational
video focusing on the City's Old Town area which was recently
completed.
The State Office of Historic Preservation (OHP) administers the
program for the National Park Service. The State requires
applicants to provide a 40% "fair share" matching fund indicating
significant community support for the proposed project. Matching
funds can take the form of cash contributions or in-kind services
(e.g. staff, personnel time, overhead, telephone, supplies and
other costs associated with administration)
The City's 1994 application would propose the use of both in-kind
services and committed general funds in the form of training
expenses (a normal general fund expense included in the Community
Development Department budget). The City need not show any
allocation of general fund expenditures at this time to fulfill any
portion of the matching share requirement. However, the City must
agree to commit in the future to budget adoptions necessary to
ensure completion of any portion of the projects requested that are
approved by the State. Applications are required to be submitted
by April 29, 1994.
Project must provide evidence of benefit to the community and its
historic resources, receive City Council support and clearly
indicate the City's ability to provide administrative support for
the project. Grant funds may be used for a number of activities
including the preparation -of historic and cultural resource
surveys, nominations to the National Register of Historic Places,
training and education, and other projects. Projects ineligible
for funding include construction or property acquisition proposals,
actual restoration work, and interpretive displays. Projects that
address OHP's program objectives, which include focusing on
affordable housing, growth management and State regula5ions for

seismic compliance will be awarded extra points in the project
screening and rating period in this grant year.
Each CLG City is permitted to submit a maximum of two applications
based upon several different categories identified in the
instruct±ons for preparation of the CLG application. The following
summarizes the two project proposals that staff would recommend be
submitted for the 1994 CLG grant.
Seismic Retrofit Plan for the Utt Juice Company Complex - The
instructions for preparing the CLG grant application for the 1994
federal fiscal year list among the grant program objectives the
goal to "focus on unreinforced masonry buildings (UMBs), subject to
the State requirements of Chapter 20/1986 (Senate Bill 547)." The
City adopted Ordinance No. 1059 in conformance with this
legislation. This legislation set certain thresholds for ensuring
that UMBs were made "earthquake safe" by performing seismic
retrofit construction to stabilize them. In complying with the
State's requirements, seven of the eight identified UMBs within the
City of Tustin have either completed this work, have permits for
said work, or are in the City's Building Division plan check
process. However, there remains one UMB that has not had the
necessary seismic retrofit plan prepared within the required dates
included in Ordinance No. 1059. Therefore, the structure has had
to be declared an unsafe structure unsuitable for occupancy by the
City's Building Cfficial' This building is known locally as the
Utt Juice Company Building and is located at 191, 193 and 195 East
Main Street.
The current owners of the Utt Juice Company Complex have indicated
that they are unable to prepare the seismic retrofit plans because
they are too costly. Staff proposes that the City apply for CLG
monies to suppor5 the cost associated with the preparation and
processing or architectural/engineering plans and specifications
that are necessa~ to complete the seismic retrofit work on this
important historic building. This type of project is listed as an
activity that may be funded with CLG grant monies. Further, this
project will benefit the owners by helping to upgrade an historic
commercial structure in Old Town, enhancing the economic viability
of the area's unique buildings, and encouraging the retention of
existing businesses.
The 40% matching funds requirement would be intended to be met
through the provision of in-kind services by City staff, the waiver
of required builling permit and plan check fees and the use of
federal CDBG funds (if available). A summary of the project budget
is provided as Atsachment A.

Sacramento CLG Workshop - Since Tustin is now recognized as a CLG,
it is required to ensure that the members of the Cultural Resources
Advisory Committee receive continued education and training. The
instructions for the CLG grant application for the 1994 federal
fiscal year list among the types of activities to be considered for
funding the training and education of Committee members and
supporting staff. The costs associated with travel and
accommodations to one or more of the conferences or workshops
satisfying the CLGtraining requirements can and should be included
as a second grant application. The proposal would enable the five
members of the Cultural Resources Advisory committee and two
supporting staff persons to attend the Sacramento CLG Workshop
currently anticipated to be held in OCtober, 1994. OHP suggested
including a training/education request as one of our applications
since the city is still considered a relatively new CLG and the
contacts and information that can be attained by attending would be
important. OHP felt that the timing was especially appropriate
since, the current Committee members have terms that would be valid
for approximately three more years. A summary of the project
budget is provided as Attachment B. The 40% matching funds
requirement would be met through the proposed use of general fund
monies to be included in the 1994-95 City budget.
CONCLUSION
As a CLG, the City of Tustin is officially recognized as having a
local historic preservation program and is eligible to apply for
grants to assist in the development of the program. The use of
grant funds for the preparation of a seismic retrofit plan for an
historic building, and education and training in historic
preservation-related topics for staff and Cultural Resources
Advisory Committee members, would contribute to this program and
benefit the entire community. Staff recommends that. Council adopt
Resolution No. 94-41 authorizing both applications to be submitted
for this year's CLG grant.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
~JSTIN, CALIFORNIA, AUTHORIZING AN APPLICATION BY
THE CITY OF TUSTIN TO THE STATE OFFICE OF HISTORIC
PRESERVATION FOR A CERTIFIED LOCAL GOVERNMENT GRANT
The Cisy Council of the City of Tustin does hereby resolve as
follows:
~EREAS, the Congress under Public Law 89-665 has
authorized the establishment of a National Historic
Prese_~vaSion Grants-in-Aid Program providing matching funds to
the Snare of California and its eligible subdivisions for
historic preservation survey, registration, and planning; and
YJHEREAS, the State Department of Parks and Recreation is
responsible for the-administration of the program within the
State setting up necessary rules and procedures governing
application under the program; and
h~EREAS, said adopted procedures established bythe State
Department of Parks and Recreation require the applicant to
certify by resolution the approval of applications and the
availability of local matching funds prior to submission of
said applications to the State;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Tustin:
Approves the filing of an aPPlication for the National
Hisnoric Preservation Grants-in-Aid assistance for:
Preparation of a seismic retrofit plan for the Utt
Juice Company Complex project; and

Attendance at the Sacramento CLG Workshop in
