D93-131 FOR THE SUBJEC~ WIDENING OF THE APPROACHES TO THE SEVENTEENTH STREET OVERCROSSING OF THE SR-55 FREEWAY ~ECOMMENDATION ~ It is recommended that the City Council, at their meeting of April 4, 1994, approve the subject ~mendment and authorize the Mayor and the City Clerk to execute the Amendment to Cooperative Agreement No. D93-131. FISCAL IMPACT Funding for the City of Santa Ana's administrative expenses are available in the Tustin/Santa Aha Transportation System Improvement Authority (TSIA) account. ~ACKGROUND On October 19, 1993, the City Council approved Cooperative Agreement No. D93-131. This agreement identifies the funding for preliminary engineering, right-of-way maps, legal descriptions and cost estimates for the widening of 17th Street overcrossing approaches. However, this agreement does not provide for administrative costs for Santa Aha as the lead agency. DISCUSSION By mutual agreement, Cooperative Agreement No. D93-131 shall be amended such that Santa Aha, as lead agency, may charge up to 20% of the consultant fee for administrative expenses incurred in conjunction with the responsibilities as lead agency. This project is fully funded by the TSIA, and Santa Ana's administrative expenses are capped at the 20% level noted above. Robert S. W-I-T-N-E-S-S-E-T_H Recitals: _ -- A. SANTA ANA, TUSTIN and COUNTY entered into Agreement No. D93-131 on August 31, 1993 which provides funding for preliminary engineering, right-of-way maps, legal descriptions and Cost estimates for the widening of 17th Street overcrossing approaches to SR 55 but does not provide administrative costs for the lead agency. B. SANTA ANA, TUSTIN and COUNTY desire to amend the agreement to provide for administrative, costs for the lead agency. · NOV, THEREFORE, it is mutually understood and agreed by SANTA ANA,' TUSTIN, and COUNTY as follows: 1 2 3 4 5 6 7 8 9 10 11 12 __ 14 15 16 17 18 19 21 1. SECTION 2 of Agreement No.~ D93-131 shall.-be~amend.ed to read as follows: .. 2. SANTA ANA shall maintain a special account for the receipt of the contributions to pay for the costs of the work to be performed pursuant to Section 1 of this Agreement and for the payment of such. costs (the "Project Account"). SANTA ANA and TUSTIN shall Jointly contribute $90,000 from TSIA funds to the Project Account. COUNTY shall contribute $45,000 to the Project · account; such amount shall be COUNTY's maximum required contribution to the Work Product. Such contributions shall be made by September 30, 1993. Ail moneys in the Project Account shall be expended only on preparation of the Work Product. SANTA ANA, as lead agency, may charge up to 20% of the consultant fee for administrative expenses incurred in conjunction vith the responsibilities as lead agency. Pending such expenditure, moneys in the Project Account may be invested in the same manner as other SANTA ANA funds and any return on such investment shall accrue to the Project Account. in the event that upon completion of the Work Product any surplus exists in the Project Account,. it shall be returned to COUNTY and the TSIA on a pro rata basis.
