BACKGROUND.
Dospite various efforts by cities to regulate the number of
persons who can occupy residentlal units, the courts, starting with
a decision against the City of Santa Aha, have completely knocked
down the power of =i=ies to enforce occupan~F rsgulat£on~.
The City. of Tustin joined an amici curiae brief on behalf of
the City of Santa Aha and ha~ en4eavored to be of help on this
issue of importance to all cities, including the City of Tustin.
Santa Aha is now asking for Tustin's support of Senate Bill
1477 (Bergeson).
Enclosed is a copy of a letter from the Santa Aha City
Attorney, Edward Cooper, and a copy of Senate Bill 1477.

Dear Jim:
As a result of Briseno v. City of Santa Aha (1992) 6
Cal .App. 4th 1378, 8 Ca1. Rptr. 2d 4 86, which held that local
residential occupancy levels are preempted by state law, we have
~e~n making an effort to ~upport legi~lation that will return local
control over this important issue.
Marian Bergeson has introduced the above re£erenced Bill, a
copy of which is attached. We believe this Bill will essentially
over-turn Briseno and permit local government to approach the
problem from a rationale perspective. There can be no question
that this is a health and safety issue for all communities.
Again, we thank you for your assistance in supporting us in
the Briseno case. Now, we are requesting support for SB-1477.
