A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, AUTHORIZING THE CITY
MANAGER TO EXECUTE ALL AGREEMENTS AND ANY
OTHER DOCUMENTS NECESSARY TO IMPLEMENT THE
AGREEMENTS CONSISTENT WITH THE CITY
COUNCIL'S APPROVALS TO TUSTIN UNIFIED SCHOOL
DISTRICT
WHEREAS, the City of Tustin and Tustin Unified School District desire to enter
into agreements, the primary purpose of which is to provide school facilities for students
generated by residential development within the MCAS Tustin Specific Plan, hereafter
referred to as the "School Facilities Project".
WHEREAS, the City Council has considered the following documents and
agreements with Tustin Unified School District and other applicable parties: (1) School
Facilities Implementation, Funding and Mitigation Agreement, (2) Site Conveyance
Agreement, (3) Joint Community Facilities Agreement and (4) the Grant Deed
conveying property to Tustin Unified School District upon which the School Facilities
Project will be constructed (Site No. 2). The listed agreements are hereafter collectively
referred to as the "Agreements".
' WHEREAS, pursuant to Resolution No. 4282 of the Planning Commission, the
Planning Commission has determined, among other things, that the proposed
disposition of Site No. 2 to Tustin Unified School District is consistent with the General
Plan pursuant to Government Code Section 65402(a) and the MCAS Tustin Specific
Plan.
WHEREAS, Site No. 2 has been identified and analyzed in the program Final
Environmental Impact Report/Environmental Impact Statements for the MCAS Tustin
Specific Plan for the purposes identified in the Agreements.
WHEREAS, pursuant to the California Environmental Quality Act, Tustin Unified
School District has adopted and approved a Mitigated Negative Declaration and an
Addendum to the Mitigated Negative Declaration for the School Facilities Project.
THE CITY COUNCIL OF THE CITY OF TUSTIN DOES HEREBY RESOLVE AS
FOLLOWS:
A. The Findings and Determinations Made by the Planning Commission by
Resolution No. 4282 are adopted and approved.
B. The School Facilities Implementation, Funding and Mitigation Agreement with
Tustin Unified School District is approved.

C. The Site Conveyance Agreement is approved.
D. The Joint Community Facilities Agreement is approved.
E. The Grant Deed conveying Site No. 2 to Tustin Unified School District is
approved.
F. The City Council authorizes the City Manager to execute all Agreements, the
Grant Deed and any other documents necessary to implement the Agreements,
including the approval of any non-substantive modifications to the Agreements
consistent with the City Council's approvals and subject to review and approval
of the City Attorney.
PASSED AND ADOPTED by the City Council of the City of Tustin, at a special
meeting on the 25th day of August, 2015.

was duly passed and adopted at a special meeting of the Tustin City Council, held on
