SUBJECT: COLUMBUS-TUSTIN GYMNASIUM - GAS MAIN EXTENSION
RECOMMENDATION:
That the Tustin city Council approve the contract for a gas mainline
extension along Beneta Way and authorize the Mayor to execute said

be authorized to be paid from the Columbus-Tustin Gymnasium Project
Contingency Fund.
FISCAL IMPACT:
The advance payment for the gas mainline extension to provide service to
the Columbus-Tustin Gymnasium has been calculated to be $2,197.66 by the
Southern California Gas Company. This cost will be charged against the
contingency budget for the gymnasium project and will require no
additional or supplemental budget appropriation.
BACKGROUND:
The Columbus-Tustin Gymnasium Project is currently under construction at.
the parksite lOcated-at Prospect Avenue and Beneta Way. The attached
contract provides for the gas main extension along Beneta Way, which
will ultimately provide' service to the gymnasium facility. This charge
in the amount of $2,197.66 covers the cost of installing 223 feet of gas
main in Beneta Way.
DISCUSSION:
The attached contract is a typical type document that has been prepared
by the Southern California Gas Company and has been executed and
approved previously by the City on many projects within the Tustin Ranch
development. The City Attorney's office has previously reviewed and
approved the format of this contract.
It is requested that the Tustin City Council approve the attached
contract and authorize the Mayor to execute said contract on behalf of
the City. Additionally, it is requested that the City Council authorize
the additional expenditure in the amount of $2,197.66 for this gas main
extension from the Columbus-Tustin Gymnasium Project Contingency Fund.

Contract default by the applicant(s) causing monies to become due and payable shall cause
.applicant(s) to be liable for additional federal and state tax (ITCCA) at the tax rate in
effect on the date the default is determined to be due and payable. Any refund of an advance
for construction shall include an ITCCA using a tax factor which reflects the tax benefit
actually realized by the utiiit¥ ~hrough tax deductibility in the year the refund occurs.
In any event, the tax refund shall not exceed the tax advanced.
