PUBLIC HEARING ( ITEM I ) 1. RED HILL AVENUE UNDERGROUND UTILITY DISTRICT NO. 14 Public Hearing to consider the designation and adoption of an underground utility district requiring the removal of poles, overhead wires, and associated structures within the area of the City located on Red Hi'.I Avenue between Copperfield Drive and Nisson Road. Recommendation: That the designated public hearing, which was opened on December 6, 1993, and ultimately continued until February 22, 1994, be conducted by the City Council. After receipt of additional testimony on this matter and closure of the public hearing, if the City Council ascertains that public_necessity, health,_ safety or welfare require the removal of poles, overhead wires and associated structures, and the establishment of the Red Hill Avenue Underground Utility District No. 14, the first reading by title only and introduction of the following Ordinance No. 1119 will be required as recommended by the Public Works Department/Engineering Division: ORDINANCE NO. 1119 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 14, RED HILL AVENUE, AND DECLARING ITS INTENTION TO ORDER THE CONVERSION Council Agenda I February 22, 1994 CONSENT CALENDAR , ITEMS 2 THROUGH 20 , Ali matters listed under Consent Calendar are considered routine and will be enacted by one motion. APPROVAL OF MINUTES - FEBRUARY 7, 1994 REGULAR MEETING; AND FEBRUARY 9, 1994 ADJOURNED REGULAR MEETING Recommendation' Approve the City Council Minutes of February 7 and February 9, 1994. ,. 3. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation' Approve Demands in the amount of $1,703,040.28 and ratify Payroll in the amount of $366,168.16. 4e RESOLUTION NO. 94-23 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING VOTING PRECINCTS AND POLLING PLACES, APPOINTING PRECINCT BOARD MEMBERS AND FIXING COMPENSATION FOR THE GENERAL MUNICIPAL ELECTION ON TUESDAY, APRIL 12, 1994, CALLED BY RESOLUTION NO. 93-114 OF THE CITY COUNCIL Recommendation: Adopt Resolution No. 94-23 approving voting precincts, polling places, precinct board members, and precinct related compensation for the General Municipal Election to be held on Tuesday, April 12, 1994, as recommended by the Office of the City Clerk. Se REJECTION OF CLAIM NO. 93-16 - CLAIMANT, JEAN VALLANDIGHAM; DATE OF LOSS, 5/7/93; DATE FILED WITH CITY, 5/14/93 Recommendation' Reject subject claim for personal injury damages of an undetermined amount as recommended by the City Attorney. . RESOLUTION NO. 94-25 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 13733 Recommendation: Approve Final Tract Map 13733 by adopting Resolution No. 94- 25, as submitted or revised, as recommended by the Community Development Department. e LAMBERT SCHOOL LEASE EXTENSION Recommendation: Extend the current lease with the Tustin Unified School District for use of Lambert School for two months commencing on February 1, 1994, and ending March 31, 1994, and authorize the Mayor to execute subject extension as-- recommended by the Community Services Department. 8. RESOLUTION NO. 94-27 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND REPAIR AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR WATER MAIN REPLACEMENT ON MOUNTAIN VIEW DRIVE, "A" STREET, AND IRVlNE BOULEVARD Recommendation: Adopt Resolution No. 94-27 accepting the works of improvement and repair and authorizing the recordation of the Notice of Completion for subject project as recommended by the Public Works Department/Engineering Division. AWARD OF ~.,.,~TRACT FOR TRAFFIC SIGNAL MODIFICATION AT RED HILL AVENUE AND IRVINE BOULEVARD Recommendation: Award contract for subject project as recommended by the Public Works Department/Engineering Division. 10. AWARD OF CONTRACT FOR WATER MAIN REPLACEMENT FOR NEWPORT AND WARREN AVENUES Recommendation: Award contract for subject project to Riverside Pipeline, Inc., dba Horizontal Boring of Riverside, California, in the amount of $1,009,000.00 as recommended by the Public Works Department/Y~ater Division. 11. RESOLUTION NO. 94-30 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR INSTALLATION OF A TRAFFIC SIGNAL AND INTERCONNECT AT MCFADDEN AVENUE AND WALNUT AVENUE Recommendation: Adopt Resolution No. 94-30 approving the plans and specifications and authorizing the advertisemen; for bids for the installation of a traffic signal and interconnect at the intersection of McFadden Avenue and Walnut Avenue as recommended by the Public Works Department/Engineering Division. 12. AWARD OF CONTRACT FOR SIDEWALK AND ACCESS RAMPS, SB821 PROJECT Recommendation: Award subject contract to J & B Kovac Engineering, a Joint Venture, in the amount of $9,587.50 as recommended by the Public Works Department/Engineering Division. 13. SENIOR ADVISORY BOARD APPOINTMENT CONFIRMATION Recommendation: Confirm Lloyd Ebeland Myra Simon as members of the Senior Advisory Board as recommended by current Board Members and Senior Center staff. 14. STATUS UPDATE - SYCAMORE AVENUE PEDESTRIAN ACCESS BETWEEN PEPPERTREE AND TUSTIN MEADOWS RESIDENTIAL DEVELOPMENTS Recommendation: Receive and file subject repo.~ as recommended by the Public Works Department/Engineering Division. 15. 16. APPROVAL OF MEMORANDUM OF UNDERSTANDING WITH TUSTIN POLICE OFFICERS ASSOCIATION, NON-MANAGEMENT Recommendation: Authorize the City Manager to execute subject Memorandum of Understanding with the Tustin Police Officers Association, Non-Management as recommended by Personnel Services. COOPERATIVE AGREEMENT NO. 93-155 BETWEEN THE COUNTY OF ORANGE AND THE CITY OF TUSTIN FOR THE IMPROVEMENT ALONG JAMBOREE ROAD BETWEEN I-5 FREEWAY AND NORTHERLY OF IRVINE BOULEVARD Recommendation: Authorize the Mayor and City Cierk To execute subject agreement as recommended by the Public Works Departmen;/Engineering Division. 17. PLANNING COMMISSION ACTION AGENDA- FEBRUARY 14, 1994 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. RESOLUTION NO. 94-Z, A RESOLUTION OF THE CITY JNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO THE COMPENSATION OF CONFIDENTIAL EMPLOYEES Recommendation: Adopt Resolution No. 94-28 relating to compens~:ion of confidential employees as recommended by Personnel Services. 19. APPROVAL OF MEMORANDUM OF UNDERSTANDING WITH TUSTIN POLICE OFFICERS ASSOCIATION, MANAGEMENT UNIT Recommendation: Authorize the City Manager to execute Memorancum of Understanding with the Police Management Unit of the Tustin Police Officers Association as recommended by Personnel Services. 20. APPROVAL OF MEMORANDUM OF UNDERSTANDING WITH TUSTIN POLICE MUNICIPAL EMPLOYEES ASSOCIATION Recommendation: Authorize the City Manager to execute Memorandum of Understanding with the Tustin Municipal Employees Association as recommended by Personnel Services. REGULAR BUSINESS (ITEMS 21 THROUGH 30) 21. ORDINANCE NO. 1120 - BUSINESS LICENSE AMNESTY PROGRAM Ordinance No. 1120 had first reading by title only and introduction at the February 9, 1994 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1120 (roll call vote): ORDINANCE NO. 1120 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING A BUSINESS LICENSE AMNESTY PROGRAM DURING THE MONTHS OF APRIL, MAY AND JUNE, 1994 22. ORDINANCE NO. 1121 - DOGS IN PARKS Ordinance No. 1121 had first reading by title only and introduction at the February 9, 1994 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1121 (roll call vote): ORDINANCE NO. 1121 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS OF THE TUSTIN CITY CODE TO PERMIT DOGS IN PARKS UNDER SPECIFIED CONDITIONS 23. TOW TRUCK ORDINANCE REVISION The City's Tow Truck Ordinance has been revised by the City'Attorney To reflect changes in the law. ORDINANCE Nc. ,122 - AN ORDINANCE OF THE _.,]-Y COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REPEALING PART 3 OF CHAPTER 4 OF ARTICLE 3 OF THE TUSTIN CITY CODE AND REPLACING IT WITH A NEW PART 3 GOVERNING THE OPERATION OF TOW TRUCKS TUSTIN TILLER DAYS BLUE RIBBON COMMITTEE REPORT On April 5, 1993, the City Council appointed the Tustin Tiller Days Blue Ribbon Committee and requested a report addressing the relationship between the City and organizing committee, financial operation, administrative procedures, and event theme. Recommendation by the Community Services Department: a, Adopt Tustin Tiller Days Blue Ribbon Committee Report. b. Authorize staff to publicize recruitment of a Tustin Tiller Days Organizing Committee. C. Transfer, from the non-departmental budget, $6,000 seed money for the Tustin Tiller Days Organizing Committee for deposit into the Tustin Community Foundation's account. d, Request that the Tustin Community Foundation formally agree to act as an organizational "umbrella" for the Tustin Tiller Days Festival and receive event proceeds. GRAD NITE 1994 REQUEST FOR CONTRIBUTION The Tustin High School Grad Nite contribution in the amount of $2,750. 1994 Committee is requesting a financial Recommendation' Pleasure of the City Council. BANNER POLES ON MAIN STREET On December 23, 1993, extremely heavy winds buffeted the Southern California area. During those winds, the concrete marbelite banner pole located on the south side of Main Street east of Prospect Avenue were damaged and require repair/replacement. -- Recommendation.: Pleasure of the City Council. REGIONAL COMPREHENSIVE PLAN - ORANGE COUNTY REGIONAL ADVISORY PLANNING. COUNCIL (RAPC) RECOMMENDATIONS The Plan, authorized by Southern California Association of Governments (SCAG) Executive Committee, is proposed to set a broad set of goals for the six county .Southern California region and identify strategies for cities and counties to use in guiding decision making to meet those goals by shaping the area's growth and character. Recommendation: Cc r with RAPC's recommendatio. ~ SCAG on the Regional Comprehensive Plan by authorizing the City Manager to-transmit a letter to that affect to the Southern California Association of GovernmenTs as recommended by the Community Development Department. AUTHORIZATION TO INSTALL ALL-WAY STOP CONTROLS ON AUTO CENTER DRIVE WITHIN THE TUSTIN AUTO CENTER Staff has received a letter from the Manager of the Tustin Auto Center Association expressing concern with increased traffic on streets within the Auto Center and requesting that the City install stop signs at all Auto Center Drive intersections within the Auto Center. 29. 30. Recommendation: Adopt the following Resolution No. 94-31 authorizing the installation of all-way stop sign controls at the westerly Auto Center Drive intersection near Tustin Ranch Road and at the southerly Auto Center Drive intersection per Figure 1 of the subject traffic study as recommended by the Public Works Department/Engineering Division: RESOLUTION NO. 94-31 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING THE LOCATION OF CERTAIN ALL-WAY STOP CONTROL INTERSECTIONS MID-YEAR BUDGET REVIEW Report addressing issues related to review of the budget at the mid-year period. Recommendation: Receive and file subject report as recommended by the City Manager. U.S. DEPARTMENT OF THE INTERIOR (DOi) APPLICATION FOR PUBLIC BENEFIT TRANSFER OF SURPLUS FEDERAL REAL PROPERTY The subject site is a 25-acre portion of the Marine Corps Air Station-Tustin comprised of existing Marine Corps recreational facilities, buildings, and land use.
