RECOMMENDATION:
That the designated public hearing, which was opened on December 6, 1993
and ultimately continued until February 22, 1994, be conducted by the
Tustin City Council. After receipt of additional testimony on this
matter and closure of the public hearing, if the City Council ascertains
that public necessity, health, safety or welfare require the removal of
poles, overhead wires and associated overhead strUctures and the
establishment of the Red Hill Avenue Underground Utility District No.
14, the introduction of the attached Ordinance No. 1119 will be required
to be introduced.
FISCAL IMPACT:
The City will be required to provide funding in the 1994-95 Fiscal Year
Budget for the installation of five new street lights at an estimated
cost of $6,000.00.
BACKGROUND:
On November 1, 1993, the City Council adopted Resolution No. 93-121
which set the time and place for a public hearing to consider the
designation and adoption of an underground utility district requiring
the removal of poles, overhead wires, and associated structures within
the area of the City of Tustin located on Red Hill Avenue between
Copperfield Drive and Nisson Road. Resolution No. 93-121 set the time
and date for a public hearing on this matter at 7:00 p.m. on December 6,
1993, at the Tustin City Council Chambers. The time and place of the
public hearing was duly noticed.
On December 6, 1993 the City Council opened the public hearing as
scheduled and received testimony as followS: -'
Karl Kovac, owner of the property at 14322 Green Valley
Avenue, spoke in opposition to the formation of the Utility
Underground District No. 14 due to the cost to the property
owners.
Berklee Maughn, resident and owner of property at 14331 Green
Valley Avenue, spoke in oppOsition to the formation of the
Utility Underground District No. 14.

Jim Rems, owner of the property at 14232 Red Hill Avenue,
requested clarification as to what the impacts would be to his
property at that location. Staff responded that his property
would not require any utility service conversions and there
would be no cost to him with respect to the subject
underground district.
Pat Buttress and Mike ~Bedell, of the Southern California
Edison Company, stated that the Edison Company would provide
service/lateral conduit for each required service conversion
from the Edison mainline to the structure requiring the
service conversion up to a maximum length of 100 lineal feet.
The conversion work on the structure from the termination of
the Edison installation to the existing overhead service mast
would be the obligation of the property owner. This cost
related to the electric service was estimated to be $200.00.
After receiving the above mentioned testimony, the City Council
continued the public hearing until their meeting of January 17, 1994.
As a result of a request from affected property owners, the January 17,
1994 public hearing date was continued until February 22, 1994 by the
City Council at the January 17, 1994 meeting.
As a result of a July 1990 revision of the Rule 20 proceedings, which
the City was recently informed at the December 6, 1993 public hearing,
the Edison Company will now pay for no more than 100 lineal feet of each
property owners underground electrical service lateral occasioned by the
undergrounding. This would be the City's first undergrounding project
that this revision would apply. All previous underground projects
required the property owner to fund the cost of undergrounding between
the street right-of-way and their structure. As a result of this
revision the estimated cost for each property owner's share for the
conversion of the services to underground has been reduced from the
original estimate of $1200 -$1600 per conversiOn to $400 per conversion.
The City has used the services of an electrical contractor to estimate
the proposed conversion cost for each property as follows:

As of the preparation date of this report (January 31, 1994) the City
has received three (3) letters of protest (copies attached) to the
formation of the subject District No. 14 as follows:

Avenue.
Carolyn Santos (A.C. Burke), property owner of 14292 Green
Valley Avenue.

DISCUSSION:
After consideration of testimony at the public'hearing, the city Council
should determine whether or not to designate and adopt the Underground
Utility District No. 14 along Red Hill Avenue from Copperfield Drive to
Nisson Road.
Council introduction of the attached ordinance No. 1119 will initiate
the formation of the Red Hill Avenue Underground Utility District No.
14. If introduced, this ordinance would have a second reading and
adoption on March 7, '~1994 with an effective date occurring 30 days
thereafter.

That the Tustin City Council continue the Public Hearing for the
potential formation of the Red Hill Avenue Underground Utility District
No. 14 to Tuesday, February 22, 1994.
BACKGROUND:
On December 6, 1993, the City Council held a Public Hearing on the
potential formation of the Red Hill Avenue Underground Utility District
No. 14. Input was received from the affected property owners along Red
Hill Avenue between Copperfield Drive and the I-5 Freeway and the
Southern California Edison Company. Due to concerns received from the
affected property owners, with respect to the estimated costs of the
service conversions from overhead to underground, the City Council
continued the Public Hearing to January 17, 1994 so staff could provide
additional information on the service conversion costs.
DISCUSSION:
On January 3, 1994, staff received a verbal request from Mr. Berklee
Maughn to continue the Public Hearing to either February 7th or 22nd due
to the recent holiday season. Staff is in concurrence with this request
and suggests that the Public Hearing be continued to the City Council
meeting of Tuesday, February 22, 1994. Mr. Maughn, as well as all of
the affected residents has been sent a copy of this report.
Prior to the February 22, 1994 meeting, Mr. Maughn and all affected
property owners and the affected utility companies will be mailed a copy
of the meeting notice, revised engineer's report and staff re~rt.

At their meeting of November 1, 1993, the City Council of the City
of Tustin, California passed and adopted Resolution No. 93-121
calling for a public hearing at 7:00 p.m. on December 6, 1993, to
consider the merits of establishing an underground utility district
along Red Hill Avenue between Copperfield Drive and Nisson Road,
and more particularly described and shown on Exhibit "A" attached
hereto.
The City Council, at their meeting of December 6, 1993, continued
the public hearing to the City Council meeting on January 17, 1994
and ultimately to February 22, 1994.
Meetings have been held with both the Southern California Edison
Company and Pacific Bell to determine costs involved. Continental
Cablevision has some overhead facilities within the district, but
per the terms of the City's Franchise Agreement, they will be
required to underground their facilities at no cost to the
district. Funding will be provided by the Edison Company with Rule
20A Funds for their facilities and Pacific Bell will provide
funding for all of their company-owned facilities. The City of
Tustin will provide funding for five new street lights, which are
not eligible for Rule 20A Funds. The estimated cost of the
proposed underground work is as follows:

The above mentioned costs were estimated by an electrical
contractor and include both the electrical and telephone service
conversion costs.
There will be no other property owner conversion expense other than
those noted above. All other existing private utility service
lines are presently undergrounded and/or are ready to accept
underground service.

UNDERGROUND UTILITY DISTRICT NO. 14, RED HILL
AVENUE, AND DECLARING ITS INTENTION TO ORDER
THE CONVERSION
WHEREAS, by Resolution No. 93-121 a public hearing was
called for December 6, 1993, at the hour of 7:00 p.m. in the
Council Chambers of the City of Tustin, California, to
ascertain whether the public necessity, health, safety, or
welfare requires the removal of pOles, overhead wires and
associated structures, and the underground installation of
wires and facilities for supplying electrical, communication,
or similar or associated service, within that certain area of
the City of Tustin more particularly described in the legal
description and shown on a map marked Exhibit "A" attached
hereto.
WHEREAS, notiCe of such hearing has been given to all
affected property owners, if any, as such are shown on the
last equalized assessment roll and to all utilities concerned
in the manner and time required by law; and

WHEREAS, such hearing has been duly and regularly held
and all persons interested have been given an opportunity to
be heard.
NOW, THEREFOR, the Council of the City of Tustin does
hereby ordain;
1. The Council hereby finds and determines that the
public necessity, health, safety and welfare require the
removal of poles, overhead wires and associated structures, 1)
to eliminate concentrations of overhead distribution
facilities, 2) to clear streets used extensively by the
general public, which carry a heavy volume of vehicular
traffic, and to clear streets which pass through a civic area,
.and 3) to facilitate the underground installation of wires and
facilities for supplying electric, communication or similar or
associated service in the underground district described in -
Exhibit "A' attached hereto and made a part hereof by this
reference, and pursuant to the provisions of Ordinance No. 411
of the City of Tustin, such area is hereby established as
Underground Utility District No. 14, Red Hill Avenue.
II. The City Council hereby declares its intention to
order the conversion.

the line of the supplying utility or utilities at a
new location, subject to applicable rules, regulations and
tariffs of the respective utility or utilities or file with
the Public Utilities Commission of the State of California.
Such notification shall be made by mailing a copy of this
ordinance together with a copy of said Ordinance No. 411,
together with a statement that the City Engineer's Report
containing details of the district is available for inspection
by the public in the office'of the City Clerk, to all affected
property owners as such are shown on the last equalized
assessment roll and to all utilities affected by this
ordinance.
V. The City Council hereby requests that all utilities
which provide service within the Red Hill Avenue Underground
Utility District No. 14 underground up..to one hundred (100)
feet of .each property owner's service lateral, at the
utility's expense in accordance with the provisions of that
utility's applicable rule on file with the public utilities
commission.

SUBJECT: Prposed Red Hill Ave. Underground Util. Dist. # 14
This letter will formally convey my protest of the above
proposed Underground Utility District. As the property
owner of 14322 Green Valley, I feel the probable assessment
of approximately $1200.00 ($600.00 per unit) per parcel is
grossly unfair in light of todays economic times.
Based upon the average southern California property owners
circumstances in todays difficult .economy, I recommend that
either the proposal be postponed for a minimum of three to
five years. Or, alternatively, the city of Tustin pay for
such improvements out of its continuing increase in sales
taxes generated by the new ~usinesses that continue to
relocate into Tustin. This latter alternative makes the
most sense especially since the proposed change offers no
economic benefit to subject property owners but does
continue to make Tustin more aestheticly attractive to out
of town customers enjoying our many commerical interests.
Furthermore, adjacent property owners would aestheticly
benefit but bear none of the cost. As a result, the
principal gainer of such a change is the city of Tustin and
not just a few adversely affected property owners.
Via this letter, I am also requesting that you keep me
apprised of the status of other probable property protesters
and what other recourse may be available to us including
legal recourse should that become necessary. Should you

I attended the December 6th meeting. I did not address the council be-
cause I felt I needed more information. After Listening to all parties,
I nust agree with >~r. Kovac. After the discussion he gave me a copy of
hi~ letter dated Nov. 23rd. which says it as well as I could.
I ielieve that the council stated ~hat it would send letters stating
co~t to o~ers, I haven't recieved any information. Also the council
st~ed that they couldn't fund'~he underground work,why? I do not be-
lieve that this is a necessity to the health, safety, or welfare of the

My wife and I are the owners 14312 Green .Valley Ave., Tustin, CA 92680 and have been since
March 23, 1993. We only recently heard about Proposed Underground Utility District No. 14 but
have never been officially informed about it. From what I have heard, it appears that it does not
specifically benefit only the few properties whose owners will be financially impacted by it. Unless
the total costs are bom by all of the property owners in the City of Tustin, my wife and I oppose it.
