HUSTON, CITY MANAGER COMMUNITY SERVICES DEPARTMENT LAMBERT S~L~E EXTENSION ~COMMENDATION: TO extend the current lease with the Tustin Unified School District for use of Lambert School for two months commencing on February 1, 1994, and ending March 31, 1994, and authorize the Mayor to execute the same. FISCAL IMPACT: The lease fee for the additional two months would remain the same asthe current lease which is $2,257 per month. Sufficient revenue is generated from the programs held at Lambert to cover the costs of the lease fee. BACKGROUND: At the January 24, 1994 Board of Education meeting, the Board approved the lease extension of Building C at Lambert School to the City of Tustin from February 1, 1994 through March 31, 1994. Traditionally, the City has leased Building C at Lambert School for one-year periods. This year the School District opted not to renew the lease for the entire year. Tustin High School would like to use this facility for classroom space after March 31, 1994. Since 1979, the City has leased approximately 6,000 square feet in classroom space from the Tustin Unified School District. Lambert School houses the City's many recreation programs for-children and -- adults. These activities also include the Child Development Program, day camp programs, and occasional meeting space or practice facilities for other community groups. As partofthe'Agreement, the School District provides maintenance, repairs and utilities. The lease is a cost effective way of providing Community'Services programs. The lease is inexpensive at 38 cents per square foot. This compares favorably to the cost of leasing the temporary City Hall at approximately 65-75 cents per square foot, which is below the average market price. The Community Services Department has been researching options for relocating the classes currently at Lambert School. Because plans and funding for the High School to take over the facility are not firm, Community Services staff is negotiating with the School District staff to continue using the Lambert facility until the project is ready to go. If this happens, a new lease would be negotiated and returned to the Council for approval. For the summer quarter, other school sites should be available because classes will be recessed for summer vacation. In September 1994, most of the classes at Lambert School, with the exception of Child Development, should be moved to the new gymnasium. Lambert has become a necessary recreation facility until the gymnasium is completed. Many youth programs are housed at Lambert. The extension of this lease is essential for the City to maintain the high level of service provided to the community at a reasonable cost. Ze~.~ez- ..AMENDMENT NUMBER This Amendment to the Lease is made and entered into as of the 25th day of January, 1994, between the Tustin Unified School District (hereinafter designated as "LESSOR") and the City of Tustin (hereinafter designated as "LESSEE"). WITNESS ETH : WHEREAS, LESSOR and LESSEE have previously entered into a Lease for the following: The premises and building thereon known as Building C of the C.E. Lambert School, located at 1151 San Juan Street, Tustin, California. AND WHEREAS, the parties hereto desire to amend said Lease. NOW THEREFORE, parties agree as follows: 1. The term of the Lease is hereby extended by a periOd of two months commencing on February 1, 1994, and terminating March 31, 1994. 2. The monthly rental for such period shall be at the rate of $2,257 (two-thousand two-hundred fifty-seventy dollars) and shall be payable quarterly in advance. 3. All other provisions of the existing Lease .are continued on the terms and conditions thereof. IN WITNESS WHEREOF, the LESSOR has caused this Lease to be executed by its duly authorized officer and the LESSEE has caused this Lease to be executed by having its name affixed by its duly authorized officer(s).
