WILSON, DIRECTOR, PARKS AND RECREATON SERVICES SUBJECT: TUSTIN AREA SENIOR CENTER TRANSPORTATION PROGRAM TITLE VI PLAN SUMMARY: In order to enter into an agreement with the California Department of Transportation for Federal Transit Administration (FTA) Section 5310 Elderly and Disabled Specialized Transportation Program grant funding, the City of Tustin must implement a Title VI Plan for the Tustin Area Senior Center's Transportation Program. As required by Title VI of the Civil Rights Act of 1964, this plan will establish policies ensuring that services and benefits are provided on a non-discriminatory basis. RECOMMENDATION: It is recommended that City Council: 1. Adopt Resolution 15-55 which authorizes the Director of Parks and Recreation to implement a Title VI Plan for the Tustin Area Senior Center's (TASC) Transportation Program. FISCAL IMPACT: The implementation of a Title VI Plan will ensure that the TASC Transportation Program is eligible for the Section 5310 Program Grant. These funds will provide 100% of the cost for two (2) new sixteen (16) passenger vehicles (approximately $146,000). There is no local agency match required for this grant. CORRELATION TO THE STRATEGIC PLAN: The implementation of a Title VI Plan which ensures that the City is eligible for senior transportation related grant funding advances Goal A of the City of Tustin Strategic Plan regarding Economic and Neighborhood Development in that it provides resources for future senior services to meet changing demographics and trends. BACKGROUND: In December 2014, the City of Tustin was awarded a 5310 Grant, for two (2) new passenger vans customized for the TASC Transportation Program. The State of California's Department of Transportation Division of Mass Transportation (Caltrans) has made these grants available to local transit agencies and non-profits that provide service to the senior and disabled population. It is expected that the City will receive these vehicles in November 2016. Staff was recently informed by representatives from the California Department of Transportation that in order to enter an agreement for these federal grant funds, the City of Tustin would be required to develop and implement a Title VI Plan for the TASC Transportation Program. This plan establishes non-discriminatory policies complying with Title VI of the Civil Rights Act of 1964, including new provisions detailed in U.S. Department of Transportation's FTA Circular 4702.113, "Title VI Requirement and Guidelines for Federal Transit Administration Recipients." Procedures: • Any person who believes she or he has been discriminated against on the basis of race, color, or national origin by the TASC Transportation Program may file a written Title VI complaint with the TASC Transportation Program, the Federal Transit Administration (FTA) or the Secretary of Transportation. • All complaints must be in writing and signed by the complainant or his/her representative before action can be taken. Complaints shall state, as fully as possible, the facts and circumstances surrounding the alleged discrimination. • A signed complaint must be filed within 180 days after the date of the alleged discrimination, unless the time for filing is extended by the Secretary of Transportation. • The TASC Transportation Program encourages complaints to be initially filed with the TASC Transportation Program for resolution. In cases where the complainant is dissatisfied with the resolution by the TASC Transportation Program, the same complaint may be submitted to the FTA or the Secretary of Transportation for investigation. Unless otherwise permitted, the final determination of all Title VI complaints affecting programs administered by the FTA will be made by the Office of the Secretary, Department of Transportation (DOT). • The TASC Transportation Program Supervisor investigates complaints received no more than five days after the alleged incident and completes the TASC Transportation Program Incident Contact Form and informs the City of Tustin Parks and Recreation Director, Deputy Director, and Human Resources (HR) Department. • Within three to five business days of receiving the complaint, the TASC Transportation Program will document and review the claim and determine jurisdiction. The TASC Transportation Program works closely with the below groups to outreach: • COT Tustin Area Senior Center Strategic Plan, case workers social workers, outreach services, Elderly Nutrition Program (ENP), and Meals on Wheels to address any special needs of COT Tustin Area Senior Center Transportation Program senior participants. Tustin Area Senior Center Advisory Board (SAB) members, who are active participants of the Senior Center and provide leadership to Senior Center Staff, fulfill its mission by continuously supporting programs which improve the quality of life for older adults of the Tustin area. They serve as ambassadors to represent the Senior Center and the COT Tustin Area Senior Center Transportation Program. The SAB members attend community events and resource fairs for older adults and persons with disabilities. City of Tustin Emergency Operation Services includes the TASC Transportation Program as part of the City's coordinated plan in which Transportation Program vehicles may be used in an evacuation emergency. 17 Tustin Area Senior Center (TASC) Transportation Program Title VI Program OUTREACH PLAN The TASC Transportation Program outreach plan implements proactive strategies and accommodations to encourage participation for Limited English Populations (LEP) to participate in our transportation services. The TASC Transportation Program provides inclusion opportunities for minority and limited English proficient populations by providing language assistance services such as on-site staff and volunteer interpreters and access to the City of Tustin's internal bilingual registry which consists of over 44 qualified bilingual employees covering 3 languages. LIMITED ENGLISH PROFICIENCY (LEP) PLAN This Limited English Proficiency (LEP) Plan has been prepared to address the TASC Transportation Program's responsibilities as a recipient of federal financial assistance as it relates to the needs of individuals with limited English language skills. The plan has been prepared in accordance with Title VI of the Civil Rights Act of 1964 and is implementing regulations which states no person in the United States shall be subjected to discrimination on basis of race, color, or national origin. There are two pieces of legislation that provide the foundation for the development of an LEP plan; Title VI of the Civil Rights Act of 1964 and Executive Order 13166. In some circumstances, failure to ensure LEP persons can effectively participate in federally assisted programs may constitute discrimination based on race, color, or national origin under Title VI. In order to comply with Title VI, the TASC Transportation Program will take reasonable actions for competent language assistance. Executive Order 13166 clarified requirements for LEP persons under Title VI. Executive Order 13166 requires that the TASC Transportation Program examine the services it provides and to develop and implement a system by which LEP persons can have meaningful access those services. As defined in Executive Order 13166, LEP persons are those who do not speak English as their primary language and have limited ability to read, speak, write, or understand English. M Tustin Area Senior Center (TASC) Transportation Program Title VI Program FOUR FACTOR ANALYSES The United States Department of Transportation (DOT) issued its Policy Guidelines Concerning Recipient's Responsibilities to Limited English Proficient (LEP) Persons (Federal Register: December 14, 2005, Volume 70, Number 239). This policy states DOT recipients are required to take reasonable steps to ensure meaningful access to programs by LEP persons. This coverage extends to the recipient's entire program. There are four factors the TASC Transportation Program considers when assessing language needs and determining what steps to take to ensure access for LEP persons: Factor 1: The number or proportion of LEP persons eligible to be served or likely to be encountered by a program, activity, or service of the recipient. The TASC Transportation Program transit services are exclusive to Tustin residents who are seniors or adults 18 years and older with disabilities. As a sub -recipient of FTA 5310 Grant funding, the TASC Transportation Program transit services are linked to participants who meet the criteria. Therefore, the TASC Transportation Program riders must be pre -qualified to actively register in the program to utilize its transit services. Although LEP participation in the TASC Transportation Program continues to increase, ridership data along with statistics from the 2010 U.S. Census Report determined English is the primary language used among residents in Tustin. The TASC Transportation Program has over 188 seniors and persons with disabilities enrolled in the program and 19 percent of the program participants represent five different ethnicities. The frequency with which LEP individuals come into contact with the program was determined by examining program participant language and ethnicity data, surveys, bi-lingual services and any significant percentage increase of LEP persons on the program. 19 Tustin Area Senior Center (TASC) Transportation Program Title VI Program TASC Transportation Program Uents by Umited EngHsh Speaking QLEPf Category English Speaking - Very Well All Other - Speaks English - Less than "very well" Spanish Speaking The TASC Transportation Program reservations and customer service office averages approximately 25 calls per day, and approximately five (5) percent of these calls are identified as calls from LEP persons. TASC Transportation Program Ridership Surveys are also used to determined LEP participants in the program. Factor 3: The nature and importance of the program, activity, or service provided by the recipient to people's lives. The TASC Transportation Program is one of only a few municipalities in Grange County that offer transportation services for its residents. The primary purpose of the TASC Transportation Program is to provide Tustin seniors and persons with disabilities, continued independence, opportunities to age in place, and promotes quality of life. The Program provides accessible, door-to-door transportation service transporting participants safely to Tustin Area Senior Center for classes, services, and the nutrition lunch program, to medical appointments, grocery and shopping shuttles, beauty services, social activities, and other appointments and events that promote quality of life. Factor 4e The resources available to the recipient for LEP outreach, as well as the costs associated with that outreach. The TASC Transportation Program has assessed that the service is available and a valuable resources to provide language assistance to LEP participants. The TASC Transportation Program provides assistance, and has resources to accommodate outreach services for LEP 20 Tustin Area Senior Center (TASC) Transportation Program Title VI Program participants at no cost to the customer. No participants are denied services due to language barriers. Outreach assistance programs include: • The City of Tustin's Internal Bi -lingual Registry: There are 44 qualified bi-lingual employees that are available for translation services to city staff and departments. Employees must pass oral and written tests to qualify for the registry. The list is updated annually and encompasses the following three languages. 1. Spanish 2. Mandarin 3. Vietnamese • The TASC Volunteer Registry: This program has designated 23 Older Adult Volunteers that aid with LEP individuals when requested. These include Japanese, Chinese, Spanish, and Sign Language. 21 Tustin Area Senior Center (TASC) Transportation Program Title VI Program Safe Harbor Provision The Federal Transit Authority Circular 4702.1 B states: "DOT has adopted DOJ's Safe Harbor Provision, which outlines circumstances that can provide a "safe harbor" for recipients regarding translation of written materials for LEP populations. The Safe Harbor Provision stipulates that, if a recipient provides written translation of vital documents for each eligible LEP language group that constitutes five percent (5%) or 1,000 persons, whichever is less, of the total population of persons eligible to be served or likely to be affected or encountered, then such action will be considered strong evidence of compliance with the recipient's written translation obligations. Translation of non -vital documents, if needed, can be provided orally. If there are fewer than 50 persons in a language group that reaches the five percent (5%) trigger, the recipient is not required to translate vital written materials but should provide written notice in the primary language of the LEP language group of the right to receive competent oral interpretation of those written materials, free of cost. These safe harbor provisions apply to the translation of written documents only. They do not affect the requirement to provide meaningful access to LEP individuals through competent oral interpreters where oral language services are needed and are reasonable. A recipient may determine, based on the Four Factor Analysis, that even though a language group meets the threshold specified by the Safe Harbor Provision, written translation may not be an effective means to provide language assistance measures. For example, a recipient may determine that a large number of persons in that language group have low literacy skills in their native language and therefore require oral interpretation. In such cases, background documentation regarding the determination shall be provided to FTA in the Title VI Program. " The TASC Transportation Program provides translation of written materials for LEP populations that constitutes five percent (5%) as well as for those fewer than (5%) free of cost. The City of Tustin agency is in full compliance with the Title VI Safe Harbor Provision. Requests for translation of written materials require advanced notice. When an LEP Individual contacts the TASC Transportation Program office for services and needs translation, the City of Tustin Internal Bilingual Registry is utilized to translate information first. Providing Notice to LEP Persons The TASC Transportation Program provides notice to LEP persons that language assistance methods are available, both oral and written: The program phone line (714) 573-3348 uses trained staff to answer phones and provide accessibility to bilingual staff when needed. Written documents including public meeting notices include a clause affirming the TASC Transportation Program will make reasonable accommodations to translate any material or to provide interpreter assistance. Monitoring The TASC Transportation Program maintains a communication accessibility plan which is monitored, designed to be flexible, and is considered as a work in progress. It is important to evaluate the demand for new documents and services needed to be created, implemented, and 22 Tustin Area Senior Center (TASC) Transportation Program Title VI Program made accessible for LEP persons. Monitoring changes in demographics and LEP participation growth in our services assist in updating the LEP plan when appropriate. The TASC Transportation Program will follow the Title VI Program update schedule for the LEP. Methods to assist in monitoring LEP Plan are to identify the following: • How many LEP persons were encountered? • Evaluate existing language assistance meeting the needs of the LEP persons? • Monitor LEP population in Tustin specifically through demographics and Census data? • Patterns, trends and gaps for LEP persons? • Any changes in the language types where services are needed? • Available resources such as technology changed? • Were complaints received? • Do staff members understand the LEP policies and procedures and training? • Conduct annual rider surveys for LEP participants in different languages. Training Staff The TASC Transportation Program staff team who are critical to the LEP plan: Transportation Program Para -Transit Drivers, Transportation Coordinator, Recreation Coordinator, Recreation Supervisor, Front Desk Volunteers, and Office Support Administration. The TASC Transportation Program Para -Transit Drivers (Recreation Leader B and P/T Driver to be hired FY 16/17) and the Transportation Coordinator have the most frequent contact with LEP persons through daily interaction with passengers. Front Desk Volunteers also have frequent contact with LEP persons, mostly by telephone. LEP training for the Transportation Program team occurs during their initial training and orientation and are to be reviewed at all driver safety meetings. Training topics include: • Understanding Title VI responsibilities. • What language assistance services are offered and resources available. • Specific procedures to follow when providing service to any LEP. • How to handle a potential Title VI complaint. In addition, the City of Tustin provides in-service training in several areas such as accessibility, sensitivity, cultural diversity, first aid, as well as any other pertinent training that will enhance their service delivery during the course of their employment. 23 Tustin Area Senior Center (TASC) Transportation Program Title VI Program Membership of Non -Elected Committees and Councils The TASC Transportation Program does not have a non -elected transit related advisory council at this time. However, the Tustin Area Senior Center Advisory Board (SAB) is a volunteer advisory board that does make transportation accessibility recommendations for Tustin seniors in the community. Any formal recommendations are brought to the City of Tustin Community Services Commission. One of Tustin's City Council members also serves as a Director on Orange County Transportation Authority (O.C.T.A) Board of Directors. TITLE VI EQUITY ANALYSIS The TASC Transportation Program does not have transit -related facilities; therefore, a Title VI equity analysis is not required. 24 Tustin Area Senior Center (TASC) Transportation Program Title VI Program RESOLUTION NO. 15-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE GOVERNING OFFICIAL, DIRECTOR OF PARKS AND RECREATION, TO APPROVE THE TITLE VI COMPLIANCE FOR THE AGENCY WHEREAS, the City of Tustin, Tustin Area Senior Center Transportation Program desires to comply with Title VI of the Civil Rights Act of 1964, including new provisions detailed in U.S. Department of Transportation's FTA Circular 4 702.1 B, "Title VI Requirement and Guidelines for Federal Transit Administration Recipients," WHEREAS, the City of Tustin, Tustin Area Senior Center Transportation Program Governing Official, Director of Parks and Recreation, wishes to authorize approval of the compliance plan developed by staff to comply with necessary provisions of the Civil Rights Act, NOW, THEREFORE BE IT RESOLVED, by the City of Tustin, Tustin Area Senior Center Transportation Program Governing Official, Director of Parks and Recreation, as follows: 1.
